Due to the new pipe that was placed without approval/permitting I am going to leave this project on hold until this issue
has been resolved.
The new pipe will need to be permitted through a modification of the existing application and installed correctly, if it has
not been. If the applicant does not want to permit the pipe it will need to be removed and area restored (including any
sediment clean-up).
I appreciate your willingness to meet on the 19th to resolve and discuss.

Attached isa letter addressing the comments received for the Elk Creek at Banner Elk Project and a revised plan sheet
showing a wet pond instead of the sand filter previously proposed, the wet pond supplement and calculations are

included as well. I will mail hard copies to Raleigh with a more complete set of plans. Please let me know if you have any

I'm sending you this to let you know where we are in preparing our response to your earlier comments and meeting the
extension deadline noted below. The engineer has redesigned the SWM plan and I just received it this morning, based
on my review so far I think it will work and satisfy state SW rules. I have found a couple of things we need to add/change
however, so I will not be able to get it to you by today. With this email I would like to request an additional week to
submit our response Monday the 101h would be my preference. Please let me know if this is acceptable.

On behalf of my client, Elk Creek Development Company of Banner Elk, LLC, I am sending you this request for an
extension to the 12 -19 -13 deadline noted in the Request for More Information letter dated 11 -20 -2013 we received for
the referenced project. We have reviewed all the comments and have been in the process of reviewing the site plan and
revising the stormwater management plan in an effort to address all the comments provided. Given the amount of work
and coordination needed to provide the requested information, and with the holiday season upon us, we would request
an extension until the end of January, 2014.
