Dear Mr. Smith..
In accordance with your letter of request received February 17, 1984, we
are forwarding herewith Permit No, 7007R, dated May 22, 1984, to R. S. Corporation
of Raleigh for the construction and operation of the subject non -discharge waste-
water treatment and disposal system.
This permit shall be effective from the date of issuance until May 31, 1988,
and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing before a
hearing officer upon written demand to the Director within thirty (30) days
following receipt of this permit, identifying the specific issues to be
contended. Unless such demand is made, this permit shall be final and binding.
One (1) set of approved plans and specifications is being forwarded to you.

In accordance with the provisions of Article 21 of Chapter 143, General
Statutes of North Carolina as amended, and other applicable haws, Rules, and
Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of approximately 475 lineal feet of 6-inch and 430 lineal feet
8-inch gravity sewers, approximately 865 lineal feet of 4-inch force main, a 125
t_1 influent pump station with dual pumps, high water alarm and standby power and
the modification and operation of the wastewater treatment system to include a 52,950
GPD wastewater treatment and disposal system with dual treatment (aeration) tanks
(one 36,000 gallon and one 18,000 gallon), dual blowers, dual clarifiers, dual aerated
sludge holding tanks, dual chlorine contact tanks, tertiary filters, a modified dosing
tank and pump system serving the existing spray disposal areas and the new rotary
distributor, dual effluent disposal distributor units (each with approximately 2,425
square feet of disposal area), a new rotary distributor with a diameter of 65 feet,
stand-by power, an effluent flow meter, piping, fittings, valves, and appurtenances
to serve Point Emerald Villas on Emerald Isle, North Carolina with no discharge to
the surface waters of the State
pursuant to the letter of request received February 17, 1984, and in conformity with
the project plans, specifications, and other supporting data, subsequently filed and
approved by the Department of Natural Resources and Community Development and con-
sidered a part of this Permit.
This Permit shall be effective from the date of issuance until May 31, 1988, shall
be subject to the following specified conditions and limitations; and shall void Permit
No. 7007, dated November 30, 1981:
1. This Permit shall become voidable unless-the_faciiiti.es are constructed in ✓
accordance with the approved plans, specifications and other supporting data.
This permit is effective only with respect to the nature and volume of wastes
described in the appliction and other supporting data.

facilities"shall be properly maintained and operated at all times.
V 4. This Permit is not transferable.
5. This permit shall become voidable unless the facilities are installed, maintained,
and operated in a manner which will protect the assigned water quality standards
of the surface waters and of the ground waters.
6. In event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective action
" as may be required by this Division, including the construction of additional
or replacement wastewater treatment or disposal facilities.
7. The sludge generated from these treatment facilities must be disposed of in
V accordance with G. S. 143-215.1 and in a manner approvable by the North Carolina
Division of Environmental Management.
8. The Permittee shall employ a certified wastewater treatment plant operator in
responsible charge of the wastewater treatment facilities. Such operator must
V hold a certificate of the grade at least equivalent to the classification assigned
to the wastewater treatment faciltties by the Certification Commission.
Diversion or bypassing of the untreated wastewater from the treatment facilities
is prohibited.
10. This Permit shall become voidable unless the Tri--Party Agreement covering the
operation and maintenance of this system between the R. S. Corporation of Raleigh,
X Point Emerald Villas Association, Inc. and the North Carolina Division of Environ-
mental Management is in full force and effect.
11. Monitoring wells shall be constructed and sampling schedules arranged as required
V by the Division of Environmental Management and constructed in accordance with
10 NCAC 2C 0.0100.
12. The Permittee shall provide and maintain monitoring facilities and a ground water
monitoring program such as may be required by the Division of Environmental Manage-
ment. Initially, the monitoring shall be done using three wells (one up gradient
l,lJ� and two down gradient). The siting of these wells should be obtained from the
✓`� Wilmington Regional Office:
a. The wells shall be monitored on a quarterly basis with a copy of the reports
forwarded to the Wilmington Regional Office within 60 days of each sampling.
b. The parameters to be monitored are fecal and total coliform, total dissolved
solids, chlorides, nitrate -nitrogen and nitrite -nitrogen.
13. Low areas (swales) approximately 200 feet from the distributors shall be filled
to a level of at least 8 feet above sea level before operating the rotary distributor.

14 -the-Permittee,-. at _least -six (6) months prior to the expiration of this permit,
/ shall request its extension. Upon receipt of the request, the Commission will
J -reveiw-the adequacy. -of the facilities described therein, and if a.ndicated, will
eytend the Permit for such period of time and under such conditions and limitations
as it may deem appropriate.
