Dear Mr. Myers:
On November 20, 2021, Mr. Edward Watson with the North Carolina Division of Water Resources'
(Division) Mooresville Regional Office (MRO) contacted Mr. Alex Chinery with contract operations firm
Terracon via telephone. During this telephone conversation, Mr. Alex Chinery indicated that the
subject groundwater remediation system was turned -off (ceased operation) in March 2021, due to
mechanical issues with the system. Division records indicate that no notification was provided detailing
that the groundwater remediation system was being taken out of service and/or ceasing operation.
NPDES Permit No. NC0089206, Part II, Section E, Item 9(b) states the following: "Noncompliance
Notification — The Permittee shall report by telephone to either the central office or the appropriate
regional office of the Division as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the following:
(b) Any process unit failure, due to know or unknown reasons that render the facility incapable of
adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators,
compressors, etc. Persons reporting such occurrences by telephones shall also file a written report
within 5 days following first knowledge of the occurrence. Also see reporting requirements for
municipalities in Part IV.C.2.c of this permit." The Division hereby issues a Notice of Violation to the

failure to notify the Division, by telephone and in writing, that the groundwater remediation system
had ceased operation in March 2021.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action,
to the Director of the Division of Water Resources, who may issue a civil penalty assessment of not
more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in
accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.
You are requested to respond in writing within fifteen (15) days of receipt of this Notice indicating
measures implemented, or to be implemented, to resolve the noted violation.
