This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request an individual permit by submitting an individual permit application. Unless such demand is made, this certificate of coverage shall be final and binding. - Please take notice that this certificate of coverage is not transferable except after notice to the Division of Environmental Management. North Carolina General Statute (NCGS) 143-215.1(c) requires that an application for permit renewal be filed at least 180 days prior to the expiration date. As of the date of this letter, the Division of Environmental Management had not received an application for renewal. If operation of a discharge or waste treatment facility is to occur after the. permit's expiration date, or if continuation of the permit is desired, it must not be allowed to expire. A renewal request must be submitted no later than 180 days prior to the permit's expiration date. Operation of the waste treatment works or continuation of a discharge . after the expiration date would constitute a violation of NCGS 143-215.1 and could'result in assessment of civil. penalties of up to $10,000 p'er day. If continuation of the permit is desired, failure to request renewal at least 180 days prior to expiration will result in a civil assessment of at least $250;00; larger penalties may be assessed depending upon the delinquency of the request. A renewal application shall consist of the following information: 1. A letter requesting the renewal. 2. The completed application form (copy attached), signed and submitted in triplicate, referenced in Title 15 of North Carolina Administrative Code (15A NCAC) Subchapter 2H .0105(a). 3. A processing fee (see attached schedule) in accordance with 15A NCAC 2H .0105(b). The application processing fee is based on the design or permitted flow, whichever is appropriate, listed in the first categories of facilities. 4. Primary industries listed in Appendix A of Title 40 of the Code of Federal Regulations, Part 122 shall also submit a priority pollutant analysis in accordance with Part 122%.21. 5. Facilities which have not been constructed within the last permit cycle and are therefore, considered "new" facilities, shall also submit an Engineering Alternatives Analysis, referenced in 15A NCAC Subchapter 2H..0103 and Subchapter 2B .0201(c). 6. If the facility covered by this permit contains some type of treatment works, a narrative description of the sludge management plan must be submitted with the application for the renewal. In addition to penalities referenced above, a permit renewal request received after the expiration date will be considered as a new application and will require the higher application fee. 15A NCAC 2H .0105(b)(2) requires payment of an annual Administrative and Compliance Monitoring fee for most permitted facilities. You will be billed separately for that fee (if. applicable), after your permit is approved. PURPOSE: The purpose of the dam construction is to provide a second siltation reservoir for the B, V. Hedrick Gravel and Sand Company. The first reservoir is in service and appears to be functioning as planned. II. LOCATION: The location of the dam site is on Island Creek, some 1300 feet South of U. S. 74, and approximately 4.5 miles West of the concurrence of Island Creek and the Pee Dee River. III. WATERSHED CHARACTERISTICS: The drainage area is composed of some 2,070 acres. The area is approximately 11,700 feet in length and 10,500 feet in width, at its widest point. Slopes are moderate to steep, except along the creek bottom, which is relatively flat. There are two sand and gravel companies that have their operations within the drainage area. Reservoirs already exist above the pro- posed dam site, in addition to the newly constructed siltation re- servoir owned by B. V. Hedrick Gravel and Sand Company. Borrow pits exist within the drainage area, and the best estimate that the Engineers could obtain is some 300 acres that will not contribute to the run-off of the area. These three hundred acres were sub- tracted in the initial design procedures, but were later considered in the final design with the use of two spillways. IV. EXPLANATION .OF DESIGN PROCEDURES: .After the initial design of the dam was completed, a conference was held with representatives of the B. V. Hedrick Company and Koonce, Noble & Assoc., Inc. The result of the conference was that (1) The final elevation of the dam was increased to 301 feet instead of 293.5 feet as originally planned; (2) Mr. Weaver of B. V. Hedrick Gravel and Sand Company, also requested that we study the possibility of using two spillways instead of one as we had shown. In complying with the request of the Hedrick Company, we first checked with Geotechnical Engineering. Company, and were assuredthat the increased heightof the dam would not affect the stability of the dam as long as the dam was constructed as recommended. Our firm thenstudiedthe proposal of the use of two spillways and con- curred that using two would be feasible due to the following reasons: (1) The combined capacity of two spillways asshownon the final drawings would give a total spillwaycapacity greater than the one spillway as originally designed. Due to upstream conditions of the watershed, such as the possibility of an existing dam failing the added capacity of the spillways is a definite advantage. (2) Under normal conditions, no release of any effluent should be necessary, but during severe weather conditions, or if water is being released from one of the upstream reservoirs, a release of water will occur. By using two spillways, the current in the sil- tation reservoir can be controlled to assure a better coverage of silt throughout the reservoir. In the absence of more precise information on rainfall data, stream gauging, time of concentration, and -other pertinent factors affecting this particular watershed, empirical formulas have been used the design procedures. Intensity of rainfall, therefore, has been selected ata higher rate than would be used if a unit hydrograph was developed. Using Talbot's formula, a rate of six inches per hour is used since the rate covers unusual design conditions which might occur in this drainage area. For this particular drainage area, the U. S. Department of Commerce's Technical Paper No. 40 gives the following one hour intensity rainfalls for the frequencies shown. 1. 50-year - 1-hour rainfall - inches - 3.3 - Chart 13. 2. 100 year - 1-hour rainfall - inches - 3.6 2. 50 years- 2-hour rainfall - - 4.0 Usingthe design method we have chosen, the spillway capaci- ties should be conservatively adequate for at least a 50-year frequency storm of a one -hour intensity. 3 SPILLWAY DESIGN B. MATERIAL: Fill material may be obtained from the on -site over burden or from approved unusable material as mentioned in the soil inves- tigation. All fill material shall be free of organic matter, debris, and boulders. 4. TOE DRAIN: Construct toe drain as recommended in the soil investigation report The width of the toe drain may be as shown on the plans,. or as recommended in the soil investigation report. The 8-inch perforated pipe should be installed at a minimum grade of 0.5% culminating at a manhole or junction box in the centerline of theold stream bed as shown on the plans. A. 1 12-inch pipe should be extended downstream at least 40 feet from the manhole or junction box. 5. CONSTRUCTION METHODS: Construct dam to proper grade and x-section as shown on the plans. Place fill material in lifts not to exceed eight inches. Place fill material at a moisture content that will allow optimum compaction with a sheepsfoot roller. 6. EROSION CONTROL (DAM): :Place a two (2)-foot section of "sugar quartz," quarry waste material, \on both slopes of dam. 7. SPILLWAY CONSTRUCTION: Construct both spillway sections in original soil at elevations and location shown on plans. Prepare all slopes for turfing by proper disking, liming, and fertilizing. Recommended rates for lime and fertilizer: Lime - 2,000 #/acre - Fertilizer - 1200 #/acre - complete mix 8-8-8 Seeding - seed all slopes of spillways. Recommended rate for fall seeding: Kind % PLS % Max. S. 143-215.2.8, the construction of the dam will have to be under the supervision of -a Registered Engineer. The plans and design data, as. submitted on November•22, 1974, are adequate and this letter constitutes approval for B. V. Hedrick Gravel and Sand Company to construct the proposed dam. However, a visit to the dam site by J. C. Bumgarner of this Division on December 13,.1974 revealed that the dam was under construction. This construction is in violation of GS ]J43-215.26 (copy of the Law enclosed) which prohibits the construction of dam not exempt from the Lax without the approval 4 of the Environmental Management Division-. B. V. Hedrick Gravel and Sand Company is hereby required to provide immediately to this Division the name and address of the registered professional engineer who grill supervise construction and who will submit as -built drawings to this Division. Goodman, Jr. requesting a 90-day extension to allow for the completion of design, approval, and construction of the final settling pond. The writer asked Mr. Billy Weaver with B. V. Hedrick to make such a request in a letter so that this Office might change the completion date proposed in a pending permit. Please find enclosed a copy of a Report of Investigation conducted by William Larry Elmore, Chemist on May 29, X974. Mr. Elmore°s review reveals that the company is in compliance with assigned water quality standards and that the request for a 90-day extension is reasonable. Mr. Elmore makes reference to a bottom drain existing in the present pond which is referred to as the first pond. After evaluation of the situation and Mr. Elmore's report, the writer recommends the following: 1) Pending permit be changed to allow a 90-day extension in the completion of the second pond. This would mean a change in the date from June 30, 1974 to September 30, 1974. 2) The issuance of this permit should supersede any existing temporary permit or of the approval document. 3) Proposed permit should carry a special condition requiring that no discharge be permitted from the drain in the bottom of the first pond without priorwritten approval of the Office of Water and Air Resources. Maintenance and operation of the facilities were satisfactory. The following list of suggestions are recommended: (1) As stated in NPDES Permit No® 0004421,.B..V. Hedrick Sand & Gravel Company was to complete their second pond by June 30, 1974. It appears that they will be unable to complete said pond by the agreed date due to various reasons. Since the first pond is presently maintaining water quality, it is my opinion that they should be given a three-month extension in order to completethe second pond. (2) In correspondence dated March 25, 1974, it was agreed that the bottom drain built into the dam of the first pond would be closed to dis- charges by a metal plate. When inspected, the said drainage pipe had not been closed to discharges. Also, Mr._ Billy Weaver admits that he has opened the drain to "see if any silt had collected". In order to halt the discharge from this pond, the drainage pipe must either be clamped or welded shut immediately. It is recommended that the leasees of B. V. Hedrick Sand & Gravel Company be notified of violations of their permit by discharging silt from the first pond and not welding or clamping the drainage pipe of the first pond. Although you saw fit to not give us adequate time to handle this in the manner in which we desired, the system is working in closed circuit as we intended and during this two -month period, the small amount of water that has overflowed our spillway has been extremely clear and free of solids and much cleaner than the rain water run offs and/or other intake graters. All in1icatiens are that we will have a minimu of three years settling in this area, which is somewhat more than the 90 days your learned engineering department gave us as the estimated life in your letter of April 5, 1974. We feel that we are presently complying with any clear water requirements for both State and Federal regulations and are at a loss as to why your office ccntinues to ask that we go beyond these requirements. From the inception of our plans your office has assumed an unreasonable attitude Federal agencies gave us until December, 1975, to complete our project -- you insisted on December, 1973, and only after uncalled for pleadings on cur part were we given a short extension of 90 days to April 1, 1074. Although we have graduate civil engineers on our payroll with varying degrees of dam building experience, this did not suffice and you add( $8,000 to $10,000 to the cost of building these dams by insisting that an independent registered engineer draw the plans and supervise the construction of our lower dam. Their time could better he event in insuring that all grater that flows into our system is clean and free from silt, since it is our intention and promise, that no matter what is required, any water leaving our plant will be cleared up and if any water does go over our spillways in rainy season, it wil'- be cleaner than that which come; into our system originally. Turbidity determinations should be performed on a laboratory turbidimeter (Bach Model 2100-A or equivalent). Procedures for using such equipment are provided in the literature accompanying it. Determinations for settleable matter and turbidity must be made by your staff on a 5-day per week basis, but since the suspended solids determinations must only be performed quarterly you may find it more convenient to have this done_ by a commercial laboratory. For the past six weeks (the last two weeks of December and the four weeks of January), we have had constant rain which has halted completely the installation of our water recovery system tied into our number one settling area. In addition to this we have been unable to put any grading equipment to work one single day since the middle of December. Each time we attempt to resume our grading, we have more rain. Our consulting engineers on the lower dam have been unable to complete their ground work survey because of the weather, and he has just advised us that he will be unable to meet the February 1 deadline, but Mr. Koonce P. E. of the firm of Koonce, Noble and Associates assures me that they are proceeding with all haste possible in the completion of the engineering for this dam, and they are this week completing the ground survey necessa3 for his plans. In addition to the weather problems, we received this week a rejection of our request for increased diesel oil allocation for our Lilesville Plant to enable us to handle excavation work necessary to our plans. I am enclosing copies of our application to the Federal Energy Office and their reply. In view of all of the above and the fact that we are conscientiously making an all out effort to complete this project, we respectfully request that we be placed on the time table as established on Page 5 of our Discharge Permit No. NC004421 as issued to us on December 17, 1973, by the Regional Administrator, Region IV, U. S. Environmental Protection Agency and the recommended time schedule as attached to N. C. Department of Natural and Economic Resources confirmation of this schedule to NPDES, copies of which are enclosed. If this is not possible, we then request that we be given at least an additional 90 days to complete our primary close circuit settling pond, and an additional period to complete our second dam. HOLSHOUSER, JR. GOVERNOR Enclosed for your information is a copy of a map that we made of B. V. Hedrick's new settling pond and a copy of a stage storage curve showing the area and volume. Total storage appears to be 198 acre feet (319,000 cubic yards). Theoretical life of this pond appears to be 66 working days based on 230 ml/L settlable solids and 5,800 GPM wash water. This calculation does not consider any improved efficiency because of compaction from the weight in a tall column of slimes. This compaction is the major unknown factor. Some experts believe that there will be no compaction if the sand fraction is segregated from the clay forming a very loose sediment in which the forces of portiere repulsion and gravity are in equilibrium. Other experts believe there will be some compaction, but do not know how much or what length of time will be necessary for compaction to occur. The operation of Hedrick's pond lends itself to the segregation of sand from clay. Theoretical calculations indicate that the volume of slimes is greater that the dry volume of the same material by a factor of ten. It will be very - interesting to observe the performance of this pond in actual practice. I have arranged for a representative of EPA to look at this problem in the field on April 16, 1974. We will be at W. R. Bonsal at approximately 10:00 A.M. and at B. V. Hedrick shortly after lunch. We will be at —the Ramada Inn — Coliseum in Charlotte the nights of April 15 and 16, 1974. - I am hopeful that they will assist us with research in this area. Hedrick Gravel and Sand Company, and with Mr. Craig McKenzie and other staff members of the Mining Division for the purpose of determing the progress toward completion of .settling ponds for silt removal at the B. V. Hedrick operation in Lilesville, Anson County. The dam and other structures for the first pond are complete and excavation'of all salvagable material is approximately 90% complete. This pond can go on line by March-31, 1974; as scheduled, and Mr. Weaver informed the writer that this would be done. According to the engineer for Hedrick, Koonce, Noble & Associates .from Lumberton, plans and specifications, are nearing completion for the second dam and. pond. Mr. Weaver stated that construction of the second dam could be completed by the June 30, 1974 date, but that complete excavation would not be possible by that time. The following understanding, which should be confirmed by letter and in the State permit, was reached: The Lessees of B. V. Hedrick Gravel and Sand Company will comply with the March 31, 1974 date by ceasing all non-extaordinary discharges at that time through utilizing the first settling pond and recycling all clear water. The company will proceed with construction of the dam and related structures for the second pond, completing such by June 30, 1974 and thus complying with the date given in the NPDES Permit. The company, however, will not be required to immediately utilize this second pond unless necessary and can proceed to do what- ever excavation and recovery of usable material the company desires until such a time that the failure of the first pond is imminent and the second pond must be used for adequate wastewater and protection of water quality. continued Memorandum Mr. John C. Bonsal Company mining area, Lilesville, Anson County. 2. Description of Site: (a) Size: Approximately 100 acres for pond construction. (b) Topography: Strip mined area sloping from both north and south ':`_sides to creek bottom. Steep on north side, gentle sloping on south. (c) Construction suitability: Adequate - settling ponds are to be constructed in bottom area both where mining has been carried out and in untouched areas now covered by pines and scrub oak. (e) Growth Potential: Slight growth potential. Area will continue to be mined as has been done for past 30-40 years. 4. Description of Receiving Stream (in case of overflows or dam failure only): (a) Name: Island Creek (b) Classification: D (c) 7-10 Flow minimum discharge: 0.0 cfs (d) Average Discharge: 1.7 cfs (e) Present Downstream Use: Agriculture - slight usage; otherwise none. (f) Flood level: Not known/not applicable 5. Description of Proposed_Treatment Plant: (a) Type of Waste: Silt laden wastewater from sand and gravel washing operation. Flow approximately 7,000 gpm or 4.2 MGD for a 6 day work week. (b) Size of Plant: Lagoons to be large enough to provide 6 months solids holding capacity and a minimum of 24 hours detention time for settling with 36u freeboard. (c) Type of Treatment Proposed: Settling ponds with recycle of clarified water and use of holding basins to contain any excess clarified water. No discharge is proposed except during periods of high rainfall. Dragline dredging will be used to remove solids accumulation in ponds. (d) Ultimate Development of Industry: Continued mining operation at present levels of production is anticipated for the future. 6. Other Pertinent Information: (Points that influence recommendation; points for conditional approval) (a) Applications have been filed with the Corps of Engineers and subsequently EPA for a discharge permit. This application will have to be updated to reflect current plans for only occasional discharge during periods of high rains. (b) During the past 30 years since this area has been mined, tremendous amounts of silt has been and is being discharged to the Creek and thereby to the Pee Dee River, approximately 3 miles away. Construction of the proposed ponds will stop the last major source of silt to the river in this area. -3 (c) Temporary Permit No. T-593 was issued to B. V. Hedricks Sand & Gravel Co. on July 16, 1973 with an expiration date of December 31, 1973 for the continued discharge of silt laden wastewater until adequate facilities could be provided. 7. Recommendations: It is recommended that a plant site approval be granted for the construction of settling ponds to serve the wastewater treatment needs of B. V. Hedricks by providing 6months solids holding capacity, a minimum of 24 hours detention time and at least 36" freeboard on the ponds. Hedrick Gravel & Sand Company Anson County, North Carolina _ The subject company has a high turbidity discharge contravening water quality standards in Island Creek as described in the attached report of investigation dated April 5, 1973. JAMES E. HOLSHOUSER, JR. GOVERNOR . The proposed pollution abatement program, also attached, is already underway and the company anticipates having the new settling areas complete by or__before_ December, 1973. The new earthen dams under construction will not be large enough to come under the dam safety act regulations and permit requirements. It is recommended that a Temporary Permit be issued to allow for thecontinued discharge of the silt laden wastewater until these new and_adequate areas are constructed. Sketches and a narrative description by the Company of the proposed new facilities which accompanied the Temporary Permit application will be forwarded to the Engineering Section. A change in any condition that requires either a temporary or permanent reduction or elimination of the authorized discharge. 3. Notwithstanding (2) above, if a toxic effluent standard or prohibition (including any schedule of compliance specified in such effluent standard or pro- hibition) is established under the provisions of General Statute 143-215 for a toxic pollutant which is present in the discharge authorized herein and such standard or prohibition is more stringent than any limitation upon such pollutant in this permit, this permit shall be revised or modified in accordance with the toxic effluent standard or prohibition and the permittee shall be so notified. 4. The permittee shall allow the Director of the Office of Water and Air Resources, the Regional Administrator of the Environmental Protection Agency and/or their authorized representatives, upon the presentation of credentials: a. To enter upon the permittee's premises where an effluent source is located or in which any records are required to be kept under the terms and con- ditions of this permit; b. To have access to and copy At reasonable times any records required to be kept under the terms and conditions of this permit; c. To inspect at reasonable times any monitoring equipment or monitoring method required in this permit; or, d. To sample any discharge of pollutants. 5. The permittee shall at all times maintain in good working order and operate as efficiently as possible all treatment or control facilities or systems installed or used by the permittee to achieve compliance with the terms and con- ditions of this permit. 6. The issuance of this permit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Federal, State or local laws or regulations. 7. This permit does not.authorize or approve the construction of any onshore or offshore physical structures or facilities or the undertaking of any work in any navigable waters. 8. The specific effluent limitations and other pollution controls applicable to the discharge permitted herein are set forth below in the special conditions. Also set forth below are self -monitoring and reporting requirements. Limitation of Discharges of Oil and Hazardous Substances in Harmful Quantities The permittee shall not discharge oil into or upon surface waters or adjoining shorelines except in accordance with the provisions of North Carolina General Statute 143, Article 53 or regulations adopted thereunder. In addition, the permittee shall not discharge toxic substances into or upon surface waters or adjoining shorelines in quantities defined as harmful in regulations promulgated by the North Carolina Board of Water and Air.Resources pursuant to General Statute 143-215. Nothing in this permit shall be deemed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject under the provisions of North Carolina General Statute 143-215, or under any other Federal or State law or Regulation. Limitations of Visible Floating Solids and Foam The permittee shall not discharge floating solids or visible foam. Disposal of Collected Solids (a) Intake Water Treatment. Solids, sludges, dirt, sand, silt, or other pollutants separated from or resulting from treatment of intake or supply water prior to use by the permittee shall be disposed of in such manner as to prevent any pollutant from such materials from entering the State's surface waters except as may be allowed by a permit issued therefor. Any live fish, shellfish, or other animals collected or trapped as a result of intake water screening or treatment may be returned to their natural aquatic habitat. (b) Wastewater Treatment. Solids, sludges, filter backwash, or other pollutants removed from or resulting from treatment or control of wastewaters shall be disposed of in such manner as to prevent any pollutant from such materials from entering the State's surface waters. Noncompliance with Effluent Limitations (a) If for any reason the permittee does not comply with or will be unable to comply with any daily maximum or daily average effluent limitation specified in this permit, the permittee shall immediately notify the Office of Water and Air Resources by telephone at Fayetteville, N. C. 919-485-8117 and provide the permit issuing authority with the following information in writing within five days of such notification: (1) Cause of noncompliance; (2) A description"of the noncomplying discharge including its impact upon the receiving waters; (3) Anticipated time the condition of noncompliance is expected to continue, or if such condition has been corrected, the duration of the period of noncompliance; (4) Steps taken by the permittee to reduce and eliminate the noncomplying discharge; and -12- (5) Steps to be taken by the permittee to prevent recurrence of the condition of noncompliance. (b) Permittee shall take all reasonable steps to minimize any adverse impact to navigable waters resulting from noncompliance with any effluent limitation specified in this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the noncomplying discharge. (c) Nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance, whether or not such noncompliance is due to factors beyond his control, such as equipment broken, electric power failure, accident, or natural disaster. Provision for Electric Power Failure The permittee shall either (a) no later than , certify in writing to the permit issuing authority that the permittee has installed or provided for an al- ternative electric power source and appurtenant facilities sufficient to operate all facilities utilized by permittee to maintain compliance with the terms and conditions of the permit; or (b) no later than thirty days after the effective date of this permit, certify in writing to the permit issuing authority that upon the reduction, loss, or failure of one or more of the primary sources of electric power to any facilities utilized by the permittee to maintain compliance with the terms and conditions of this permit, the permittee shall halt, reduce, or otherwise control production and/or all discharges in order to maintain compliance with the terms and conditions of this permit. Prohibition of Bypass of Treatment Facilities The diversion or bypass of any discharge from facilities utilized by the permittee to maintain compliance with the terms and conditions of this permit is prohibited, except (i.) where unavoidable to prevent loss of life or severe property damage, or (ii) where excessive storm drainage or runoff would damage any facilities necessary for compliance with the terms and conditions of this permit. The permittee shall immediately notify the North Carolina Office of Water and Air Resources in writing of each such diversion or bypass in accordance with the procedure specified above for reporting noncompliance. Spill Prevention and Containment Plan - Within 90 days of the effective date of this permit, the permittee shall pre- pare and submit to the permit issuing authority, a Spill Prevention, Containment, and Countermeasure Plan for the facility covered by this permit. Such plan shall • include the following information and procedures relating to the prevention of spills and unauthorized discharges of oil and hazardous or toxic substances: (a) a description of a reporting system to be used to notify immediately persons responsible for management of the facility and appropriate State and Federal authorities; (b) a description of equipment or facilities (including overall facility plot) for the prevention, containment, or treatment of spills and unauthorized discharges; (c) a list of all oil and hazardous materials used, processed, or stored at the facility including the normal quantity maintained on the premises for each listed material; (d) a brief description of any spills or unauthorized discharges which occurred during the 36-month period preceding the effective date of this permit and subsequent measures taken by permittee to prevent or to reduce the possibility of further spills or unauthorized discharges; and (e) an implementation schedule for additional equipment or facilities which might be required for (b) above, but which are not yet operational. Hedricks sand and gravel pits in Anson County and met with Mr. E. A. Goodman. IN later telephone conversations t1}e writer conferred with Mr. Billy Weaver, the chief engineer and general superintenden Sand and gravel mining operations have been carried out for over 50 years at the present site and the only official contact with this Office has been through the submitting of copies of Corps of Engineers permit applications. The present water usage in the gravel washing operation is 10,000 gal/min obtained from Island Creek as that Creek leaves the property of W. R. Bonsal Sand & Gravel Operations upstream. There are ponds to settle and clarify this water before use. On the day of the investigation this stream from Bonsal was exceptionally high in silt. After usage of the water in gravel washing it is discharged to another series of ponds for clarification. Approximately two-thirds of the water is recycled from surface drains and reused in the gravel washing. The remaining one-third (approximately 2 MGD) is drained off the bottom with the settled silt and is discharged into Island Creek. On the day of the investigation a measurement of settleable solids in Island Creek at N.C. 145 approximately 12 miles downstream of the discharge point was 250 ml/1. Mr. J. L. Chocklett of this Office measured a turbidity of >500 jtu and a settleable solids of 200 ml/1 at this point on May 9, 1972. The present plans of the company are to completely end the discharge, of wastewater to the receiving stream by a system of total recycle through the construction of two ponds with dredging capability. A tentative date for the completion of these facilities and ending of the discharge was stated by Mr. Weaver as December 1973. The original plans included only one dam and one large pond, but to facilitate dredging aswell as to circumvent the necessity for WQ ;:19 Revised 4/26/72 Page 2 a dam construction permit, two smaller ponds were decided upon. It is recommended that the Lessees of B. V. They do not have a dam right now, but have been advised' that they must stop discharging turbid material(actwolly a clay slurry) into, the stream, and they are planning to build a dam on Island Creek about 3 miles meet of N. C. 145 for this purpose, with. construction planned for this fall. Mr. Weaver agreed to make some sketches and send them to me for dam safety approval; he does not so far plan to use a professional engineer on the plan- ning,, but we left it that we would have to discuss this requirement of the Dam Safety Law further. . Craig McKenzie has some calculations worked out with Page Denton whi.lh show that the sOl ds to be -trapped by the dam will amount to about 736 scx'e- feet per year, and that with the size dam proposed (60435 feet deep at the dam), this will last for only a year or two. Craig M. Feels that this is not a solution and will in fact be money wasted; and that the real solution would be to pump the slurry back over the hill into mined -out pits and have an a7.-. most closed system, like Bonsal has. We should consider this point when we receive anything from Billy Weaver for construction of the dam. This is a case of aanpraval of a new dam, and not one for which consultant services are needed. GOVERNOR SUBJECT: Siltation in sland Creek below W. R. Bonsal & Company Anson County, North Carolina_. _ On April 5,_1973, while inspecting the settling ponds and siltation problems of B.V. Hedricks & Company, the writer noted the condition of Island_Creek as it was leaving the property of W.R. Bonsal_&_Company and coming on to the .property of B. V. Hedricks. The creek was very heavy in silt and although no measurements of turbidity or settleable solids were taken, it is felt that water quality violations were_ _ present. Both Mr. E. A. Goodman of B. V. Hedricks & Company and Mr.. J. Craig_McKenzie of. the Mining Division, Office of Earth Resources, said that the stream from Bonsal is normally clear and the silt removing methods satisfactory. _ It is recommended that a letter be sent to Bonsal & Company re— questing explanation for the causes of the problem and notification of the steps taken by Bonsal & Company to correct it.
