(SEGO, on behalf of Focus Realty Services, Inc. (herein referred to as the "Applicant "), is submitting the attached Pre- Construction Notification (PCN) and accompanying documents, with hopes of securing US Army Corps of Engineers' (USACE) and Division of Water Resources' (DWR, formerly DWQ) approvals to utilize the Nationwide Permit (NWP) 29 and corresponding Water Quality General Certification (GC) 3402, which are necessary to facilitate the completion of construction activities at Tidewater on the Bay subdivision, in Sneads Ferry, Onslow County, North Carolina. In addition, this PCN is being submitted in order to resolve outstanding wetland violations. Due to the length of time that has elapsed and the complexity of the project, it is important to provide some background information, to help understand how we got to this point. In 2006, Colorado Coastal Development (CCD) secured USACE and DWR verification to utilize NWP 39 and GC 3402, respectively. These permits authorized the permanent fill of 0.429 acre of 404 jurisdictional wetlands. During construction, it was determined that utilization of a bottomless culvert, at impact area A, was not possible. In order to account for the impact associated with installing twin concrete culverts at this crossing, SEGi submitted a request to modify the permits, to include 39 linear feet of warm water stream impact. In addition, an overlooked driveway impact (Impact Area N) was included in the request. While the DWR issued a modified GC 3402, the USACE did not, as open enforcement actions had not been resolved. Those actions consisted of the discharge of sediment into wetlands; failure to properly record the preservation mechanism; and make payment to the NCEEP, for 78 linear feet of warm water stream restoration credit. In addition, the installation of the culvert, at impact area E, were suspected to be installed improperly (i.e., not at the right elevations). While trying to resolve the USACE's violation action, the property was foreclosed on and abandoned. Consequently, the outstanding violations were never resolved and exist today. Nationwide Permit (NWP) 39 to fill 0 429 -acre of 404 wetlands and 0 059 acres isolated wetlands for the development of a subdivision The permitted impact areas were comprised of culverted road crossings, and fill to allow construction of roads The contractor tasked with the installation of the sediment and erosion control devices proposed in the approved stormwater plan, failed to take into consideration the previously verified wetland limits, and subsequently impacted wetlands during construction of many of the sediment traps These impacts include such disturbances as excavation of wetland material and deposition of fill material within wetlands and waters of the U S (see attached impact Map) Site Conditions Soils Soil types mapped within the vicinity of the impacts are Pactolus fine sand and Wando fine sand According to the Soil Survey of Onslow County, North Carolina', the Pactolus series consists of moderately well drained and somewhat poorly drained soils on uplands and stream terraces Included with this soil in mapping are small areas of Wando and Leon sods The Wando series is an excessively drained soil found on undulating areas on uplands Most areas are 10 -25 feet above sea level Included with this soil in mapping are small areas of the moderately well drained Pactolus soils in narrow dramways, the poorly drained Muckalee soils in narrow drainageways, and scattered small areas of Alpin and Kureb soils The majority of the soils within the delineated wetlands, and in the regions of the impacts, appear to correspond with the soils mapping and their corresponding soil inclusions Vegetation The wetlands that these sediment ponds and swales drain to can be characterized as pocosm wetland or riverme swamp forest using the N C Wetland Assessment Method 'Soil Survey ofOnsloti+ Countv, North Carolina, issared 1991 2 (NCWAM) These areas are typically comprised of vegetation including pond pine (Prnus serotma), swamp gum (Nyssa aquatrca), red maple (Acer rubrum), tulip poplar (Driodendron luhprfera), loblolly bay (Gordonra lasianthus), red bay (Persea palustris), sweet bay (Magnolia vtrgtnrana), swamp cyrilla (Cyrilla racemtflora), tall gallberry (Ilex coriacea), highbush blueberry (Vacctnrum cotytnbosum), fedder bush (Lyons lucrda), cinnamon fern (Osmunda cmnamomea), and laurel- leaved greenbriar (Smilax laurtfoha) Marginal areas of these wetland types typically contain vegetation more frequently encountered in uplands such as long leaf pine (Ptnus palustrts), loblolly pine (Prnus taeda), bracken fern (Ptertdtum aqutltnum), wire grass (Arrsttda strtcta), and creeping blueberry (Vacctnrum crasstfohum) Hydrology The hydrologic regime of the areas impacted and the surrounding wetland/upland matrix consists of primarily of precipitation driven sheet flow The extreme interiors of the wetland areas approaching the marsh bordering Alligator Bay are affected by tides to a small degree Proposed Restoration Activity There are 14 impact areas associated with stormwater structures within areas designated wetlands by the COE that are the focus of this report See table below for details Restoration of the above areas will be varied, but all will involve returning the impacted areas to original grade and contour Some areas have spoil matenal (hydric soil) within wetlands, which will be used to repair the impact areas If no suitable organic material can be salvaged from the immediate area, suitable material will be located from one of the many upland spoil sites within the property All areas will then be finish graded, silt fence installed to prevent further sedimentation into restored areas, and seeded with an approved wetland seed mix No planting of shrubs or trees is proposed as part of the restoration activities
