Avoidance and Minimization 1a Specifically describe measures taken to avoid or minimize the proposed Impacts In designing project Attached is an original 86 -lot conceptual subdivision plan proposed for the property, the City approved 85 -lots & 3 additional lots were removed from the plan to avoid the majority of the jurisdictional wetlands and pond As a result the current plan only proposes 82 lots The grading plan was designed to maintain hydrologic connectivity between the avoided jurisdictional wetlands and the downstream pond bottom The stormwater pond was located in upland areas and at an elevation that would ensure that it will not potentially drain the adjacent avoided, groundwater fed wetlands lb Specifically describe measures taken to avoid or minimize the proposed Impacts through construction techniques The pond dam was classified as high hazard The owner determined that upgrading it to a safe dam was not feasible, as such DENR has approved a dam breach plan However, no fill will be placed in the pond bottom beyond that requested in this application The lowenng of the pond will aid in the environmentally safe construction of the requested 3 lots & utilities within the footprint of the jurisdictional pond The project will obtain a land disturbance permit from the City and use proper erosion & sediment control measures Wetlands will most likely form in the avoided pond bottom 2. Minimum thickness of NCDOT Class 1 riprap where specified shall be twenty five inches (1.5 times maximum stone size of 17 inches) and eighteen inches for NCDOT Class B nprap is specified (1.5 times maximum stone size of 12 inches). 4. The minimum depth of all riprap channel lining shall be 2.75 feet 5. In accordance with GS 143- 215.29 and NCAC 15A-2K.0203,.0212,.0215, and .0216, within 30 days of completion of the project, Mr Patrick K Smith, PE shall inspect the completed work and upon finding (a) that the work has been done as specified and (b) that the breach has been sufficiently stabilized to restrain accelerated erosion, and (c) the remains of the dam are safe, shall file with the Division of Energy, Mineral, and Land Resources two sets of record drawings and a certificate stating that the work has been completed in accordance with the approved plans and other requirements, and the remains of the dam are safe. 6 This approval does not convey the right to access the private property of others.
