ADDITIONAL, CONDITIONS
Wooden Bridge/Drive
The authorized construction of the wooden bridge /drive shall adhere to the alignment depicted on the
attached workplan drawings
Any portion of the permitted wooden bridge /drive built over wetlands shall be elevated a minimum of
three feet over the wetland substrate as measured from the bottom of the decking.
If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
Stabilization
The alignment of the retaining wall shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction.
The authorized retaining wall shall adhere to the alignments depicted on the attached workplan
drawings.
The bulkhead shall be constructed prior to any backfillmg activities
The retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
The retaining wall shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by division personnel
All backfill material shall be clean and free of any pollutants except in trace quantities.
All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead
Ocean hazard Area
The permittee shall, in coordination with the Division of Coastal Management, determine the static
vegetation line and corresponding structural setback requirements. All authorized development shall be
located landward of the appropriate setback lines. Construction shall begin within sixty days of this
determination or the determinations shall be considered void, and new setback lines shall be re-
established. In the case of a major shoreline change within that period, a new setback determination
may be required before construction begins

ADDITIONAL CONIDITIONS
In accordance with T15A:07H.0306(K). The authorized structures shall be relocated or dismantled
Y - y when they become imminently threatened by changes in shoreline configuration. The structures shall'be
relocated or dismantled within two years of the time when it becomes imminently threatened, and in any
case upon their collapse or subsidence However, if natural shoreline recovery or beach renourishment
takes place within two years of the time the structures become imminently threatened, so that the
-' structures are no longer imminently threatened, then the need not be relocated or dismantled at that

time. This condition shall not affect the permit holder's right to seek authorization of temporary

protective measures allowed under Rule T15A:07H 0308 a 2

X14) 15A NCAC 07H .0308(a)(1)(B) prohibits permanent erosion control structures within the Ocean Hazard
= Area of Environmental Concern (AEC) Therefore, in order to ensure compliance with this rule, the
design of all retaining walls within the AEC shall be the absolute minimum necessary to retain the
backfill material. In order to ensure compliance with this condition, the permittee is encouraged to
coordinate final retaining wall design with the Division of Coastal Management.

if round, or 8 inches to a side if square; and the first floor level of the sills and joists shall meet the 100 -

148) Dune disturbance shall be allowed only to the extent necessary for development and if the dune's
`h protective value is not weakened or reduced. Disturbed dune areas shall be immediately stabilized
All buildings constructed within the ocean hazard area shall comply with the NC Building Code and the
` Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any
" provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the
following AEC standards, the more restrictive provision shall control.
20)r;. In order to avoid unreasonable danger to life and property, all development shall be designed and placed
` so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm.
Cantilevered decks and walkways shall meet this standard or shall be designed to break -away without
structural damage to the main structure.
Sedimentation and Erosion Control
V21)� "` Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
. ` diversion swales or berms, etc.).

General
No vegetated wetlands shall be excavated or filled outside the area indicated on the attached workplan
drawings
"24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the

written approval of the Division of Coastal Management.
The permittee and/or his contractor shall meet on site with a representative of the Division prior to
project initiation.
-26) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals
or authorizations that may be required including any authorization needed from the NC DEMLR
Stormwater Section and any Building Permits needed from the Town of Oak Island
