The Preserve at White Oak Creek project is a planned residential development consisting of single and multi - family homes and a recreational center. Open space and adequate room for stormwater BMPs have been reserved throughout the site to provide environmental protections and a high quality of life for residents. The project will help to meet the high demand for residences around the Town of Apex. The attached PCN form provides information for use in your review of the impacts to streams and wetlands associated with this site. Supplemental information is provided in this cover letter including a detailed breakdown of proposed impacts and mitigation. Additional information is contained in the attachments including a Project Information Sheet, Pre - Construction Notification form, Vicinity map, USGS map, NRCS Soil Survey map, and Impact Locations map. BNK has provided the attached overall site plan (Sheet C.1.1) and wetland and stream impact drawings for your review of this project. Proposed Impacts and Mitigation Based on prior conversations with you and NC Division of Water Resources (NCDWR) staff and our review of the proposed impacts, it is our professional opinion that the project qualifies for a Nationwide Permit 29 and General Certification 3890. Please note that Impact Site C (PCN Impact S3) was determined to be a jurisdictional stream lacking significant aquatic function. Therefore, the impacts to this channel, 129 linear feet, are not considered to count toward the threshold for the Nationwide Permit 29. Total linear footage of impacts to streams with important aquatic function for this project is 287 linear feet. Impacts to waters of the U.S. total 416 linear feet of stream impacts and 0.19 acres of wetland impacts. A breakdown of permanent and temporary impacts is provided in the attached Site Impacts and Mitigation tables, along with Mr James Lastinger Page 2 of 3 January 22, 2014 proposed mitigation based on our discussions during the field verification visit Permanent stream impacts include linear footage of stream within culvert areas and riprap outlet protection areas Permanent wetland impacts include roadway and embankment fill to the toe of slopes, and permanently maintained sewer corridor Temporary wetland impacts include areas needed for construction access and installation of erosion and sediment control measures These temporary impact areas will be restored to pre - construction grades and stabilized using appropriate annual species or a wetland seed mix Impact site C (PCN S3) was determined during field verification to not exhibit significant aquatic function Therefore, no mitigation is proposed to satisfy Nationwide 29 requirements for this channel However, NCDWR will require I 1 mitigation for this impact. As impact site A (PCN S 1) was determined to be a perennial stream, requiring 2.1 mitigation by your standards and 1 • I by NCDWR, the overall total for mitigation is similar and compensatory mitigation has been requested to satisfy the larger amount of 439 mitigation units No mitigation banks with available credits are present within the same basin as this project Therefore a request for mitigation from the NC Ecosystem Enhancement Program was made, and the approval is attached. As the construction of this project will be phased, the compensatory mitigation payments are proposed to be phased as well Payment will be made to compensate for all Phase 1 impacts prior to construction in those areas Similarly, payment will be made for all Phase 2 impacts prior to construction Proof of payment for each phase will be forwarded upon receipt and prior to construction The phasing is shown on the attached Site Impacts and Mitigation table Riparian Buffers & Stormwater Management The Town of Apex has authority under the Jordan Lake watershed rules for the review of riparian buffer impacts and stormwater management plans A No Practical Alternatives Demonstration is being submitted to the Town concurrently with this permit application for their approval of the proposed buffer impacts, which are provided for informational purposes on the impact drawings in this application The general location of BMPs has been provided in the attached site plan. Final design of these measures, along with associated forms and documentation, will be submitted to the Town for review.
