Salisbury Street, Office 640 E Raleigh, NC 27604 RE: SW5200701; Bojangles at Spring Hope, NC - Modification This letter is written in response to the comments and recommendations from Jim Farkas dated November 101", 2021. A reply or explanation for each comment issued by your office is provided below and follows the original format of your memorandum. NCDEQ Stormwater Program Jim Farkas Jim. Farkas(a)-ncdenr.gov (919) 707-3646 Please clarify the property owner arrangement for this project. It appears the area covered by this permit is owned by It's Farm Time, LLC, Heritage, LLC, and Redco Properties, LLC (all of which appear to have the same registered agent, office location, and managing member). NOTE: The original permit requires permit modification/approval prior to any subdivision of the permit area or transfer in ownership. The owner of this property is Redco Properties, LLC. This information has been adjusted on the application and the updated deed is included in this response. 2. Application comments a. Section IV, 8 — If 3.4 ac of BUA are being added to a project area of 74.11 ac, the %BUA would be a lot less than 42.9%. If the entire property area is not being used as the project area, please let me know. The entire property area (74.11 acres) is not being used as the project area. The project area for this job is 7.83 acres. Therefore, 3.42 acres (BUA)/7.83 acres = 43.6% Project % of impervious area listed in Section IV, 8. The value for Section IV, 7 has been changed to 7.83 acres as well. b. Section IV, 10 — Please show the Total Drainage Area, On -site Drainage Area, and Off -site Drainage Area values in square feet, instead of acres. Please include the off -site drainage area (from SW5210603) value in this table. Done, the table has been adjusted to show the values in sf and not acres. Please see Section IV, 10 of the application form. 3. Supplement-EZ Form comments i. Cover Page: 1. Line 2 — The project area is shown as 8.08 ac which does not match the project area as shown in Section IV, 7 of the Application (74.11 ac). We have adjusted the value in line 2 of the Cover page to be the correct project area of 7.83 acres. The 8.08 originally listed was including the 11,051 sf from the Duck thru Project. Per your comments below, we now understand this value must only be the Bojangles project area of 7.83 acres. ii. Drainage Areas Page: 1. Entire Site Column, Lines 5, 7, 8, & 9 — Do not include off - site drainage areas or BUA in the entire site column since these areas are not part of the entire site (they are part of a different site). The values in Lines 5,7,8 and 9 under the entire site column have been changed so that the off -site drainage areas are not included. 2. Entire Site Column, Line 16 — See earlier comment about %BUA. Line 16 under the entire site column has been changed so that the %BUA, strictly relating the impervious area on the Bojangles site (148,803 sf) to the entire area of the Bojangles site (340,914 sf), is now 43.6% or 44% in the excel calculation. iii. Wet Pond Page: 1. Line 25 — This value (247.98) does not correspond to the temporary pool elevation as shown in the calculations/stage-storage table (248.33). Line 25 on the Wet Pond page has been changed to the correct value of 248.33. 2. Line 26 — This item should only include the surface area of the main pool (3,899 sf) not the entire permanent pool. Line 26 on the Wet Pond page has been changed to the correct values of 3,899 sf. 3. Line 27 — Please exclude the sediment storage zone from the main pool volume calculation (The sediment storage zone should not be included in this volume since the sediment storage zone is designed to become filled with sediment and therefore does not provide storage capacity). Done, we have adjusted the forebay and pond volume calculations so that the sediment storage zones (242- 243 in the forebay, 240-240.50 in the pond) are not included. Please see the updated Wet Detention Forebay Volume Comparison for the results. The new values have been updated on the EZ form. The main pool volume is now 14,134 cf, which is still adequate for the calculated WQV requirement of 12,803 cf. 4. Line 32 — Please exclude the sediment storage zone from the forebay volume calculation. Done, we have adjusted the forebay and pond volume calculations so that the sediment storage zones (242- 243 in the forebay, 240-240.5 in the pond) are not included. Please see the updated Wet Detention Forebay Volume Comparison for the results. The new values have been updated on the EZ form. The Forebay volume is now 2,869 cf, which is 16.9% of the pond's volume of 14,134 cf. 5. Line 34 — The cleanout depth of the forebay is the distance from the permanent pool to the top of the sediment storage zone in the forebay. Understood, Line 34 has been adjusted so that the cleanout depth is the permanent pool elevation of 246.5 to the top of the new sediment storage elevation of 243. Making the correct value is 42". 6. Line 37 — This cell rounds to the nearest whole number. Please list the actual orifice diameter (1.3") in the additional information section. Done, 1.3" has been typed out in Line 37 to display the correct value. 4. Design: As designed, the volume of the forebay and main pool are calculated incorrectly (see above). Excluding the sediment storage zone from the volume calculations results in a forebay that is larger than 20% of the main pool volume (violating Wet Pond MDC 5a). Since this design was already reviewed/approved by our office (and is not being altered by this modification) you can keep it the way that it is, however, since this SCM has not yet been built, it is strongly recommended to reconfigure the wet pond to be compliant with the MDCs. It is also recommended to clearly show the top elevation of the sediment storage zone in the cross-section of the pond We understand this concern and we have adjusted the Forebay to have a sediment storage zone of 1' in depth from 242-243' in elevation and the pond to have a sediment storage zone of 6" in depth from 240'-240.5' in elevation. These adjustments still allow for the forebay volume to constitute 16.9% of the main pond's volume. The updated main pond's volume (14,134 cf) still meets the required WQV of 12,803 cf. The sediment storage zones are now shown on CE-10 of the plan set. The values in line 21 and 28 have also been adjusted on the Wet Pond page of the EZ form for this calculation change. Please provide the following - 1x electronic copy of each item provided in the hard copy submission. - 1 x hard copy & 1 x electronic copy of the revised pages of the Application. - 1x hard copy & 1x electronic copy of the revise pages of the Supplement-EZ Form. Any items required to address the property ownership arrangement for this project (1x hard copy & 1x electronic copy). Any items related to the redesign of the wet pond, if applicable (2x hard copies of plan sheets, 1x hard copy of anything else & 1 x electronic copy of everything).
