Bojangles' Restaurants Inc – Bojangles' located at Dawn Drive and Fayetteville Rd, Lumberton NC
Mrs. Burdette,
Primax Construction Inc, on behalf of Bojangles' Restaurants Inc, would like to request an additional 2,582 sq ft of
permanent wetland impacts for the referenced project. We are requesting this additional area permanent wetland
impacts due to the process of properly and safely backfilling the retaining walls required us to disturb beyond the
specified limits of disturbance. This was unavoidable as the retaining wall requires a minimum of 12" of backfill with a
maximum slope of 10:1 slope (see attached wall design drawing 6 of 7). The permitted area of disturbance was in
most cases only 8" to 12" behind the retaining wall.
It is our understanding that this project was permitted for 0.49 acre of permanent wetland impact, requiring a total
compensatory mitigation of 0.85 acre of riparian, non- riverine wetland credits. We are requesting an additional 2,528
sq ft of wetland fill and we propose to procure compensatory mitigation for this additional wetland impact at a 2:1
ratio from NCEEP. Based on discussions with Kelly Williams with NCEEP, it is our understanding that the additional
2,528 sq ft that we are requesting will still be within the original total square footage that Bojangles Restaurants Inc
had already paid a mitigation fee for. We were however informed that there has been a rate increase since and we
would be responsible and agree to pay the difference of $ 1,000 +/- (amount to be verified).
Attached we have included a copy of the original disturbance plan and a plan showing the additional disturbance area.
This plan also indicates the revised location of the outfall structure as you had requested we show.

Good morning,
Please reference the Individual Permit dated 2/20/2013 issued to Bob angles' Restaurants, Inc to construct a
Bojangles' commercial restaurant, including a 3,808 square foot building, drive -thru lane, and 74 parking
spaces, involving the discharge of fill material into 0 49 acre of riparian, non- nverine wetlands
On 12/16/2013, Pnmax Construction, Inc , on behalf of the permittee, requested a modification to the above
referenced permit The proposed revision entails an after - the -fact approval of backfilling the footings of the
originally permitted retaining wall a mimmum of 12 vertical inches, with a maximum horizontal slope of 10 1,
thus extending the wetland fill footprint between 5 and 21 linear feet outside of the original fill limits The fill
is designed to properly and safely backfill the retaining walls on site, which are 8 feet tall in some locations and
contain fill for the parking lot of the restaurant

The proposed extension would impact an additional 0 058 acre of wetlands adjacent to Saddletree Swamp,
Bottomland Hardwood Forest according to the NC Wetland Assessment Method (NCWAM) If authorized, the
revised total project would result in the permanent discharge of fill material into 0 548 acre of riparian, non -
riverme wetlands
The permittee proposes to compensate for the additional wetland fill by purchasing riparian wetland credits in
Lumber River Basin (03040203) at a 2 1 ratio from the North Carolina Ecosystem Enhancement Program
(NCEEP)
Threatened and Endangered species and Historic and Archeological Resource concerns are not expected to be
affected by the proposed project modification as the additional wetland fill would occur no more than 21 linear
feet outside of the originally permitted footprint The District Engineer, based on available information, is not
aware that the proposed activities requiring DA authorization will affect any species, or their critical habitat,
designated as endangered of threatened pursuant to the Endangered Species Act of 1973 The Corps has
consulted the latest published version of the National Register of Historic Places and is not aware that any
registered properties, or properties listed as being eligible for inclusion therein are located within the project
area of will be affected by the proposed work
Given a lack of applicable comments received during the original Public Notice period and the relatively small
magnitude of the proposed additional impacts, I will not place this project back on a formal Public Notice
However, I am requesting feedback from the included agencies regarding the project modification
Please send any comments or responses to this project modification, especially related to the expanded purpose
and need and potential secondary and cumulative impacts, within 2 weeks (by Thursday, 1/2/2014) If you have
