Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project Site consists of approximately 90.04 acres located off of NC Highway 55 near Fuquay-Varina, North Carolina within Wake County. The project Site is bound by agricultural lands and residential homes to the north; to the east by Maude Stewart Road; to the west by South NC 55 Highway; and to the south by residential homes and undeveloped forest. The Site is comprised of agricultural lands, Denson Road, mixed hardwood -pine forest, and man-made agricultural ponds. The proposed residential development will consist of single-family homes, stormwater control measures, utility improvements (i.e. public water supply and sanitary sewer alignment), and other amenities like open green space. A delineation of the Site was completed by Timmons Group on September 23 and 28, 2020. A confirmation Site visit was conducted with April Norton of the USACE and Josh Brigham of the DWR on December 17, 2020 confirming the boundaries utilized for avoidance and minimized during project planning. The site was known as Hidden Valley East at that time. Josh Brigham, DWR, provided a Buffer Determination Letter on December 18, 2020. April Norton, USACE, provided an informal confirmation email of the Project Study Area on January 5, 2021. 4b. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: The proposed development is a single -phased residential development project that is located off NC Highway 55 near Fuquay-Varina, North Carolina within Wake County. The proposed residential development will consist of single-family homes, stormwater control measures, utility improvements (i.e. public water supply and sanitary sewer alignment), and other amenities like open green space. Roadway improvements are proposed for NC Highway 55 and Denson Road. In addition, a new road (Ranch Drive) is proposed to connect to Maude Stewart Road to the east in order to provide a secondary access for emergency vehicles. All work will be conducted in accordance with local, state, and federal regulations. Total Permanent Wetland Impact 0.473 Impact 1 consists of 14,168 square feet (0.325 acres) of permanent impacts and 2,179 square feet (0.050 acres) of temporary impact to construct a road (Warhorse Road) that will connect to another proposed road (Ranch Road) that will connect to the existing Maude Stewart Road. These roads are necessary to provide a secondary access to the residential development for emergency vehicles. Impact 2 consists of 119 square feet (0.003 acres) of temporary impacts from the construction of a boardwalked greenway. This boardwalk is proposed to cross Wetland G and connect a proposed greenway to a sidewalk parallel to Warhorse Road. Because a boardwalk is proposed to cross this wetland, no permanent impacts are proposed. Note that Impact 2 also consists of temporary impacts for the grading of a lot that is near the proposed greenway. Impact 3 consists of 1,915 square feet (0.044 acres) of permanent conversion of PFO to PEM wetlands impacts in order to install a sanitary sewer via an open trench method. A 20' maintained easement is proposed for this sewer line after construction. The Town of Fuquay-Varina is requiring that this sanitary sewer easement be stubbed and terminate within the wetland near the property boundary. Impacts 4, 6, 11, 14, and 17 consist of temporary impacts associated with the construction of various stormwater control measures (SCMs) that are required for the project. Impact 6 also consists of 175 square feet (0.004 acres) of permanent wetland impact for the installation of a riprap dissipator pad at the outlet of a stormwater pipe. This pipe will carry water that is treated in a wet pond. These permanent and temporary impacts are requested to be approved under a Nationwide Permit 18 for Minor Discharges. Impact 5 consists of 1,038 square feet (0.024 acres) of permanent impacts and 227 square feet (0.005 acres) of temporary impacts to construct a road. This road is necessary to provide access to lots and was required by the Town of Fuquay-Varina to terminate at the property boundary. Impacts 7, 10, 12, 15, 16, 18 consist of temporary impacts associated with a 5-foot construction buffer for grading for lots, amenities, and roads. Impact 13 consists of 5,214 square feet (0.120 acres) of permanent impacts and 949 square feet (0.022 acres) of temporary impacts to construct a road. This road is necessary to provide access to lots and provide a cohesive roadway connection throughout the proposed development. All temporary impacts (except for temporary impact #6 associated with the sanitary sewer easement) will be stabilized following construction and will be allowed to grow back into pre -construction conditions. 3. The box culvert will be approximately 76 feet in length and will have a slope of 1.58 % . No riprap at the culvert outlet is proposed because of the low slope % and the use of a box culvert instead of circular pipes. This road is necessary to eventually provide a connection to Maude Stewart Road. This connection is necessary for a secondary access to the residential development for emergency vehicles. A temporary pump -around system will be used during the construction and details of the culvert construction process is given in Sheet CWI-1.9 of the attached Impact Maps. Comments: Impact 1 is associated with a perpendicular road crossing. The total Zone 1 and Zone 2 impacts from this crossing are 0.247 acres. Impact 6 is associated with a stormwater ouffall from a primary SCM that will treat the drainage area prior to conveyance and thus complying with Item (9) of the Neuse Buffer Rules. The Zone 2 impacts are considered allowable upon authorization, but the Zone 1 impacts are considered allowable with mitigation upon authorization, since vegetation will be removed to install a riprap dissipator pad. Impacts 8 and 10 are associated with grading for lots in Zone 2. This activity will not compromise the health of vegetation in Zone 1, will comply with Item (9) of the Neuse Buffer Rules, and any disturbed areas will be stabilized and revegetated. Thus, these activities are considered allowable. Impact 9 is associated with a stormwater ouffall from a primary SCM that will treat the drainage area prior to conveyance and thus complying with Item (9) of the Neuse Buffer Rules. Impact 9 is limited to only Zone 2 impacts; thus this activity is considered allowable upon authorization. E. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts proposed are necessary in order for the project's goals to be realized. For this project, the road crossing of Stream M was proposed to occur at close to a 90-degree angle as possible to minimize impacts. This crossing was also designed to occur with the least amount of riparian wetlands. Unfortunately, due to the requirements to have a secondary access, impacts to this stream/wetland complex was unavoidable. Retaining walls have also been used wherever possible to minimize wetland and buffer impacts. Sanitary Sewer and other utility lines were designed to parallel roads in order to minimize disturbance. A boardwalk is proposed to minimize disturbance to Wetland G. The Town of Fuquay-Varina is requiring two road stubs at the property edges outside of jurisdictional areas. However, the current project has no plans for further off -site development. Any off -site development will be completed by others and permitted separately if impacts are to occur. Based on observations made during the delineation, no jurisdictional features are anticipated to be located in these immediate off -site areas. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owners representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? A USFWS IPaC Report and NC Natural Heritage Program (NHP) Database Report were utilized for review of potential protected species in the vicinity of the project Site. Species identified by IPaC as potentially occurring the vicinity of the Site include the red -cockaded woodpecker (Picoides borealis), Neuse River waterdog (Necturus Iewisi), Cape Fear Shiner (Notropis mekistocholas), Carolina madtom (Noturus furiosus), Atlantic pigtoe (Fusconaia masoni), and Michaux's sumac (Rhus michauxii). Additionally, the monarch butterfly (Danaus plexippus), listed as a candidate species, is also identified as potentially occurring within the vicinity of the Site. Additionally, the NCNHP report did not identify occurrences of federally listed species within the project limits or a 1-mile radius. A Protected Species Report was prepared by Froehling & Robertson on November 10, 2020. This report noted that field observations performed by Froehling & Robertson personnel did not identify obvious suitable habitat for any protected species (except for the Monarch Butterfly, which was not listed at the time of field observations). This report is included as an attachment. Due to the absence of forested areas of an appropriate age and size, it is the opinion of Timmons Group that the proposed project will have no effect on the red -cockaded woodpecker. Occurrences of the aforementioned protected species or their habitat were not observed during the Site inspections performed by Timmons Group in September 2020. Therefore, it is the opinion of Timmons Group that this project will have no effect on any Endangered Species or Designated Critical Habitat. 6. Essential Fish Habitat (Corps Requirement) 6a. This listing is further described as a 1900 one-story triple-A frame, traditional/vernacular house. Additionally, one SO site, named only as "house" (Site ID WA0580), is also described as a 1900-1910 one-story Triple -A frame, traditional/vernacular house. Froehling & Robertson consulted with the North Carolina State Historic Preservation Office (SHPO) and submitted a Request for Comments (RFC) letter to SHPO concerning the Site. A response was received from SHPO stating "no comment on the project as proposed" and "are aware of no historic resources which would be affected by the project." The Property is developed for residential and agricultural use and contains two residential structures, two storage structures, and three tobacco barns situated within a rural area of residential, commercial, and institutional development. The remaining portions of the Property consists of an agricultural pond, fallow and agricultural fields, and unimproved wooded land. The Property is bound to the north by residential development, agricultural land, and J & J Mulch Company (mulch supplier); to the east by residential development, agricultural land, and a pond; to the south by wooded land and residential development; and to the west by South NC Highway 55, beyond which is residential development, NC Sod and Mulch (sod and mulch supplier), Harte Electric (electrical contractor), and Manna Church. SCOPE OF WORK This informal Review of Historic Resources and Protected Species was conducted in general accordance with F&R's Proposal No. 2059-00681, dated September 29, 2020. INFORMAL SURVEY HISTORIC RESOURCES REVIEW F&R visited the SHPO GIS Website to review the most current information. Based on F&R's review of 7.5 — Minute USGS Topographic Quadrangle Map and the supporting literature available at the SHPO GIS website, the project site is not currently listed on the National Register of Historic Places (NR) nor determined eligible for listing (DOE) on the National Register of Historic Places. Furthermore, the project site is not on the Study List (SL) for the National Register nor does the project site have a Local Designation (LD). However, a site on the Surveyed List, R.B. Saunders House (WA0579), was identified on the Property and Farm (Gone) (WA0578) was identified within 1,500 feet of the project site. Pulte Group Saunders Property — Protected Resources F&R Project No. 59Y-0447 2 November 10, 2020 f&R F&R sent a Request for Comments (RFC) Letter to SHPO. The letter, dated November 10, 2020 included the above project information and the results of F&R's review. SHPO responded with "no comment on the project as proposed" and "are aware of no historic resources which would be affected by the project." This evaluation included a review of known cemetery sites. A copy of the response letter is attached. PROTECTED SPECIES REVIEW F&R visited the NC NHP Data Explorer to review the most current information regarding protected species. Based on F&R's review of the 7.5 — Minute USGS Topographic Quadrangle Map "Fuquay-Varina, NC" and the supporting literature available in the NC NHP Data Explorer, the project site is not located within an officially designated wilderness area or wildlife preserve. In addition, listed or proposed listed threatened species, or listed or proposed endangered species, or designated critical habitats are not mapped at the project site. Additionally, Managed Areas or NHP Natural Areas were not depicted within the project site or in the vicinity of the project site on the Data Explorer map. Additionally, the U.S. Fish and Wildlife Service (USFWS) IPaC list did not identify critical habitat areas within the project area. However, six threatened, endangered, or candidate species are included on the official USFWS list of protected species that may occur in the proposed project location. Listed species include: • Red -cockaded Woodpecker (Picoides borealis) — Status: Endangered (bird) • Neuse River Waterdog (Necturus lewisi) — Status: Proposed Threatened (amphibian) • Cape Fear Shiner (Notropis mekistocholas) — Status: Endangered (fish) • Carolina Madtom (Noturus furiosus) — Status: Proposed Endangered (fish) • Atlantic Pigtoe (Fusconaia masoni) — Status: Proposed Threatened (clam) • Michaux's Sumac (Rhus michauxii) — Status: Endangered (flowering plant) F&R's field observations did not identify obvious suitable habitat for the above -identified species. However, if suitable habitat is determined to be present within the disturbance area during future development of the site, a formal survey may be required in order to determine the species' presence or absence within the project area. Based upon this information, it appears that the proposed project is not likely to adversely affect federally or state listed threatened and endangered species or their designated critical habitats. CONCLUSIONS The North Carolina State Historic Preservation office (SHPO) responded with "no comment on the project as proposed" and "are aware of no historic resources which would be affected by the project". The Natural Heritage Program has provided a response that includes a table of Potential Occurrences that may occur within a one mile radius of the project site. Based on a review of this information, there do not appear to be protected species listed by NHP that would be adversely affected by the proposed project. Based on a review of the USFWS IPaC official species list for the project site, six federally protected species have been identified that may occur in the proposed project location.
