Sullins, Director Division of Water Quality August 2, 2007 DWQ Project # 01-0034, Ver. 3 Cumberland County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Sol Rose Kings Grant Club 104 Gillespie Road Fayetteville, NC 28301 Subject Property: Lionshead Condominiums At Kings Grant Ut to Carvers Creek [030615, 18-24, WSIV, B] REQUEST FOR MORE INFORMATION Dear Sol Rose: On July 26, 2007, the Division of Water Quality (DWQ) received your application dated July 14, 2007 (Public Notice issued July 13, 2007, was received by the DWQ on July 13, 2007), to fill or otherwise impact 0.17 acres of 404/wetland to construct the proposed condominium development. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide complete site plans on full plan sheets with elevation contours at a scale of no smaller than 1 inch = 50 feet. 2. Since the imperviousness of your project will exceed 30 percent, please provide plans, profiles, worksheets, calculations and signed and notarized Operations and Maintenance agreements for all the stormwater management devices as required for your 401 Certification. Because Carvers Creek is located within and therefore classified as a Water Supply watershed stream (WSIV), your 401 Certification will require that all of the stormwater resulting from this development be treated by one of the following BMPs: a wet detention pond followed by a level spreader and forested filter strip, a constructed stormwater wetland, or a bioretention area. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
