Dear Mr. Smith:
On January 9,2014 the Department of Environment and Natural Resources("DENR"),Division of Water
Resources("DWR") sent you a letter informing you that the DWR was rescinding the July 2,2013 letter
informing you that your request for a 401 Certification was waived. As noted in the January 9th letter,as
a result of the decision to rescind that letter,the DWR considers your request for a 401 Certification as on
hold. Consistent with 15A NCAC 2H .0507(a)(3),this letter is to inform you that our initial review of
your Request reveals that the DWR does not have all the information necessary to make a decision. Once
my staff completes its initial review of your pending request,they will provide a list of infonnation that
will be required to allow a decision to be made. Only after that information is received will the request be
processed and a final decision made.
