A North Carolina Division of Coastal Management(DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The CAMA Major permit
application from Turner Westward, LLC and Taylors Creek Holdings proposes to expand the docking facility
and dredge footprint in Town Creek in Beaufort, NC., This area contains shellfish resources.
In July 2009,a similar dredge footprint was applied for and a shellfish survey was conducted by the applicant's
consultant in October 2009. Significant shellfish resources were located in the area (see attached), resulting in
the relocation of the proposed dock and the removal of slips and associated dredging in the southwestern
quadrant of the original dredge footprint. The proposed area of dock and dredge footprint expansion is in the
same area where high densities of hard clams were found in the 2009 survey.
On December 13t', 2013,shellfish survey results were confirmed and a significant shellfish resource continues
to be present at this location. Therefore,additional slips and dredging in the proposed area will likely result in
a significant adverse impact to shellfish and shellfish habitat.
If dredging is permitted, an in-water work moratorium of April 1st to September 30t'will be required for all
