Hello Mr. Jackovich,
On December 06, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. The Division has not received the application review fee. The application is not complete until the fee is
received. Please ensure the application review fee is paid. [15A NCAC 02H.0502(a)(10)]
2. The shoreline stabilization application received December 09, 2021 proposes impacts of 500 square feet above
and 1800 square feet below normal lake level. Accompanying site plans indicate impacts greater than these
calculations, see plan details at the bottom of this email.
Please provide the total amount of disturbance above and below the normal lake level, and the linear feet of
shoreline to be stabilized. If impacts are different then submitted plans, provide updated plans that reflect these
changes. [15A NCAC 02H .0502(c)]

Embedded below are sections from your submitted plans. Linear feet as calculated using the surveyed distances resulted
in 466.95 linear feet. This is greater than the distance within the submitted plan and side views.

The plan view included with your application indicates 250 linear feet of shoreline stabilization with 750 square feet
below and 1,250 square feet above the normal lake level. Your application provided difference calculations.
The side view included with your application indicates an extra foot of impact above the normal lake level in comparison
to the plan view above. This also results in different impact calculation.

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
