Dear Mr./Mrs. Cody:
On November 23, 2021, during a discussion at an adjacent site, it was observed that a retaining
wall was in the process of being constructed along the bank of the lake. In addition, concrete had
been placed along the bank. A review of our database fails to show any approval for the
observed impacts. These unapproved impacts are not allowed without authorization per the
Catawba Riparian Buffer Rule (15A NCAC 02B .0614) and without a 401 Water Quality
Certification (15A NCAC 02H .0500). Based on the observation at the site this letter is being
issued as a Notice of Violation of the aforementioned regulations.
The Catawba Riparian Buffer Rule was established in June 2001. Two Zone were created. Zone
1 governs the first 30 ft. landward from top of bank of the Catawba River and associated lakes.
Zone 2 is an additional 20 ft. landward, creating a potential 50 ft. buffer along the river/lakes.
Properties platted prior to June 2001 are subject only to Zone 1 requirements. Please note the
corrective actions below.
Required Corrective Actions:
1) An After the Fact Application for the placement of the concrete along the
shoreline may be requested. You can find the information at the following link:

Scroll down until you find the heading for Shorelines. Include in the After the
Fact application the following: plat of property, photos prior to impact, current
photos of impact, and location map.
2) The retaining wall must be removed. It may be relocated beyond 30 feet from top
of bank of the stabilization. The impacted area must then be returned to the pre-
existing grade and elevation.
3) All actions shall be completed by January 15, 2021. Photos may be provided upon
completion via email.
If you have an explanation or any information/documentation related to the noted issue that you
wish to present, please respond within fifteen (15) days of receipt of this Notice. Your response
should address the items identified in this Notice.
