Please be aware that, depending on the type and installation of the proposed gravel, the portions of the path that will be driven on or adjacent areas that will be routinely parked on could be considered built -upon area per the definition provided in GS 143-214.7(b2) and provided below: (b2) For purposes of implementing stormwater programs, "built -upon area" means impervious surface and partially impervious surface to the extent that the partially impervious surface does not allow water to infiltrate through the surface and into the subsoil. "Built -upon area" does not include a slatted deck; the water area of a swimming pool; a surface of number 57 stone, as designated by the American Society for Testing and Materials, laid at least four inches thick over a geotextile fabric; a trail as defined in G.S. 113A- 85 that is either unpaved or paved as long as the pavement is porous with a hydraulic conductivity greater than 0.001 centimeters per second (1.41 inches per hour); or landscaping material, including, but not limited to, gravel, mulch, sand, and vegetation, placed on areas that receive pedestrian or bicycle traffic or on portions of driveways and parking areas that will not be compacted by the weight of a vehicle, such as the area between sections of pavement that support the weight of a vehicle. The owner or developer of a property may opt out of any of the exemptions from "built -upon area" set out G.S. 143-214.7 Page 2 in this subsection. I have also included a copy of the post -construction stormwater permit for this site. In this permit, Condition 1.10 requires any changes from the approved plans to be submitted to and approved by this Division prior to construction. Since this site is permitted as a low density development and limited to a 25% density across the site, any improvements must demonstrate continued compliance with the requirements. You might also find several chapters of the NC DEQ: Stormwater Design Manual to be a useful resource, including Chapter A-4. The application forms necessary to modify the permit can be found on the following website: NC DEQ: New Permits & Permit Modifications. We do not currently have the supporting documentation for this project (the application, approved plans, and other information on file) available electronically. However, our paper files are considered public record. If you need further information, we can either arrange a time to make the file available for review here in the office or can arrange to have the file scanned at your expense. The cost to scan depends on how big the file is ($35/inch of file thickness). Please advise if you would like to take advantage of either of these options. Since this will be a CAMA Major, it will trigger the need to get a State Stormwater permit. But, there is already a permit for the subdivision. (I do not have the signed version, but the text of the permit is attached.) I do not see any mention of building impervious area. This seems to be a water dependent structure, which will not impact this permit. The only thing that needs to be done for Stormwater is to foliow the existing permit. This is a new process to me so I was hoping you (or someone in your office) could help me navigate. This property owner allowed the subdivision HOA to build a neighborhood dock on the a lot adjacent to his (which he also owns) and would like to add 3 finger docks to the existing structure, as the neighborhood's need for access has increased. I've read through the application process and it seems there are a lot of areas that first-time applicant could get lost so I would appreciate any guidance you could offer.
