Dunn, Coastal Coordinator Habitat Conservation Division DATE: December 22, 2021 SUBJECT: CAMA Dredge/Fill Permit Application for Sargent Investment Group LLC, Beaufort County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the pen -nit application with regard to impacts on fish and wildlife resources. The project site is located at 598 East Street along a man-made canal and Battalian Creek in Belhaven, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S-C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 ct seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U-S-C_ 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq). The applicant proposes to install 200' of bulkhead, 264' of retaining wall, 1,838 sf of wetland fidl for driveway access, a gravel parking area, 6' by 200' pier landward the bulkhead, two 13' by 13' boatlifts, upland fill and grading, and maintenance excavation within Battalian Creek and the than -made canal. The water classification in this area is SC HQW NSW by the Environmental Management Commission, it is subject to the NC Division of Water Resources Tar/Pamlico Basin Buffer Rules and is designated an anadromous fish spawning area (AFSA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the permit application and does not believe the project will have significant impacts to aquatic resources if better management practices are implemented. Therefore, we support the April 1 — September 30 moratorium recommended by the NCDMF to minimize impacts to environmental resources.
