Hello Brian,
So we finally received the application, which is good, however there are a few comments/concerns.
First, I will need you and the homeowner to fill out, sign, and return to me the attached Catawba Riparian Buffer form. I
have attached it in two formats. Please fill out whichever one works best for you.
Second, we typically only approve 2' (maybe 3') of rip rap ABOVE full pond, not 5'-6' like you have on your diagram.
Third, you can't just clear the buffer. You are allowed to remove nuisance and/or invasive plants. You are allowed to
remove trees which are below 3" in diameter at breast height (which we classify as 4.5'). You are allowed to remove dead
trees. Everything else needs to stay within the buffer.
With that being said, it does look as if the shoreline is pretty steep. Now you can attempt to lay back the shoreline, say at a
3:1 ratio (or more) in order to better stabilize the shoreline. This however has two ramifications. First, it pushes the buffer
further back up into the property. This means where once there was no buffer, now there may be. Second, any and all trees
that are 3" or greater in diameter that you take out to do this, will need to be replanted back into the buffer with at least 6"
of mulch covering the ground.
Another option would be to place a seawall instead of just rip rap. This would prevent you from having to impact and
replant the buffer as it keeps the current shoreline where it is.
If you would like to meet at the site, just let me know and we can set something up.
Either way, if you could back to me on this that would be most appreciated.

The approval is for the purpose and design described in your application. Impacts not indicated in the
application is a violation of the Buffer Rule. Site specific work should be provided in the application. [15A NCAC

Trees are not allowed to be removed from Zone 1 of the Buffer (within 30 ft of the full pond elevation), unless
approved. Exception, those trees that are severely undermined along the immediate shoreline can be removed.
Minimal shaping and sloping along the immediate shoreline is allowed. [15A NCAC 02B .0243(6)]
Benching and grading in the buffer is not allowed. Excessive disturbance of ground cover. [35A NCAC 028.0243
(6)]
Beaches, impervious patios, impervious walkways, etc. are not allowed in the buffer unless specifically approved
by the Division. There are limitation on size for decks. [15A NCAC 02B .0243(4) and (6))
Work to be conducted from land must indicate an access and indicate any trees that are to be removed. The
work corridor should be described. The approved access corridor shall be restored. Staging, spoil, construction
material must be outside the buffer. (15A NCAC 02H .0502 and 15A NCAC 02B .0243 (4), (6), (8)]
Stormwater cannot be piped or channeled for direct discharge to the lake. All constructed stormwater
discharges must be at the natural elevation and discharged prior to entering the buffer directed as diffuse or
