Dear Mr. Shaver, EE 11, E #, :N 1 Please find the attached updated PCN for the above referenced project, Several concerns about the previous submittal and present construction have been brought to my attention. This letter has been written in response to these concerns and request for additional information. The updated PCN has been revised to account for temporary impacts that are typically present when culverts are installed. In my previous PCN I did not account for the rip rap apron on the stream crossings. This apron is present on both stream crossings and will be sufficient to account for any temporary impacts. The revised mitigation request form includes this impacts as permanent, since no plan is currently in place to remove the rip rap once the culverts are installed. 1 have also modified the PCN in reference to Impact #2, where no wetlands are present, and it will only be a stream impact. A clearer image of the proposed sewer lift station has been attached which shows that no impacts are associated with its construction or design. Presently the project is under construction by Morton Trucking. Mr. John Pierce contracted with Mr. Morton to construct the subdivision. Two of the crossings have been installed and the remaining crossing has been prior to the issuance of an approved fill permit by the proper agencies. Mr. Pierce was unaware of the installation of this culvert, until I notified him that it had been installed. Mr. Pierce would not have authorized this activity until the proper permits were issued, but understands that it is his responsibility as the owner to ensure that unauthorized discharges do not occur. To protect himself in the future Mr. Pierce is currently rewriting his standard contracts to include language that would make the contractor responsible for any wetland impacts that have not received authorization. At this time we have requested additional stream mitigation credits for 47 linear feet of stream impacts and a 3:1 mitigation ratio for wetland impacts associated with the temporal losses incurred by this unauthorized activity.
