Cavanaugh & Associates, P.A., on behalf of the Town Of Surf City, has reviewed your comments for the
Surf City Crossing Stormwater Management Permit Plan Revision dated October 12, 2016, and has
developed responses and additional supporting information to address each item in your comments.
For your convenience, we have repeated the comments below in bold font, followed by the responses in
italicized font.
1. 15A NCAC 02H.1003(e): The plan revision application form identifies yourself as the property
manager. However, in the case of a corporation, the application must be signed by a principal
executive officer of at least the level of vice-president. Applications that must be signed by
another agent shall be accepted on the application only if accompanied by a letter of
authorization. Please provide one of the following:
a. Official documentation demonstrating yourself as a principal executive officer of at least the
level of vice-president.
b. An originally signed plan revision application form from a principal executive officer of at least
the level of vice-president.
c. A letter of authorization from the principal executive officer allowing you to sign on their
behalf.
Please note that if the documentation available on the Secretary of State Corporations Database
does not list the designated person as holding a position of at least the level of vice-president,
official documentation must be provided supporting their position.

The Wilmington Regional Office received and accepted a revision to State Stormwater Management
Permit for Surf City Crossing — Harris Teeter on August 19, 2016. A preliminary in-depth review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:

Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to November 18, 2016, or the application
will be returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information, which shall be no later than 30
days past the original due date. The Division is allowed 90 days from the receipt of a completed
application to issue the permit.

In response to the email you sent me on Friday 2016-8-26, and as a follow-up to our phone conversation
earlier this morning, this letter is to serve as clarification for the stormwater permit processing for the
proposed Town Of Surf City US 17 Forcemain project.
The project proposes to demolish the existing'Lowe's Pump Station' (referred to in old permitting
documents as 'Highway 210 Pump Station') and upgrade the 'Harris Teeter Pump Station' (larger
pumps). In addition, a new 8" forcemain will be installed along US 17 and Shepards Rd., and gravity pipe
will be installed to direct wastewater flow from the'Lowe's Pump Station' to the 'Harris Teeter Pump
Station'. Along the 3.6 mile forcemain, there will be 10 air release valve manholes. The proposed
gravity sewer line includes 2 proposed manholes. Per my file review at the Wilmington Regional office,
the impervious area for the pump stations was accounted for in previous stormwater permits, as further
described below. With the exception of the manhole covers, there will be no proposed impervious area
for this project.
The BUA associated with the'Lowe's Pump Station' will remain until the surrounding properties are
further developed. While the impervious area was originally accounted for in SW8 050502 (Lowe's Surf
City) as part of Drainage Area #4, that area was eventually sold to the Harris Teeter landlord, which
resulted in the removal of Infiltration Basin #4 and the subsequent construction of Harris Teeter, where
the stormwater runoff was redirected to a new stormwater management system located behind Harris
Teeter, permitted as SW8 090310.
Also, 'Harris Teeter Pump Station' is shown on the SW8 090310 plans.
Ultimately, the file review documents indicate that the impervious areas associated with these two
pump stations has been accounted for on previous permits, so we've submitted a Plan Revision to
document the upgrades being made on the site, but the existing amount of impervious area will remain
the same.
For the proposed forcemain and gravity sewer line, we'd like to request an exemption, as the only
proposed impervious area is for the 10 air release valve manholes and 2 gravity sewer manholes. The
'General Permit To Construction A Linear Utility Line' form that we previously submitted, and the $505
check, is not necessary; please disregard those items for our submittal and return them back to Surf City
as we discussed on the phone earlier this morning.

The notice of intent (N01) form for SGW04 is to be used when you are looking to obtain a general permit for a linear
utility project that proposed the minimal amount of BUA (like a pump station). If your project does not propose BUA,
then you could submit for an exemption by submitting a cover letter (be sure to list the owner, location of the project
and a description of the project demonstrating it doesn't need a permit) and a set of plans.

I realized I have a small gap in understanding regarding permitting the Surf City forcemain project I'm working on. I'm

There will improvements at the pump stations, but no proposed impervious area. More specifically, 'Lowe's Pump
Station' will be demolished; 'Harris Teeter Pump Station' will be upgraded, but the impervious area will not
change. Based on your response, I think it's clear that I should submit a plan revision to document the changes to those
sites.
The utility line work will only include minimal amounts of BUA, but does not overlap the limits of SW8 050845. As was
done with SW8 050845, it sounds like an exemption is the way to go, with a new stormwater permit number. By the
way, in my email below, yes I meant SW8 050502 (instead of SW8 050845).
Assuming I have this correct that I'll be submitting plan revisions for SW8 050502 and SW8 090310, and I'll be submitting
for a new exemption utility line permit, does that mean there will be two permit modification fees as well as one new
permit that will be exempted from the fee, resulting in two $505 permit fees? Please clarify the appropriate fee.

I don't recall enough of what is proposed to provide a solid answer. Are there improvements to be done at the pump
stations? Is the utility line work proposed overlapping the limits of SW8 050845?
If the pump stations were approved and permitted under SW8 050502 and SW8 090310 but you are now altering them
from its permitted condition without increasing the BUA or changing the drainage patterns, then it probably would also
be best to submit a plan revision to document the changes to those sites. As for the utility line work, if it is limited to
just the underground portion with minimal amounts of BUA associated with it AND it overlaps or is an extension of the
area exempted under SW8 050845, then you can request a modification to that exemption letter for the proposed work.

After doing my file review of the Surf City Harris Teeter area today, I want to follow up with you regarding the
appropriate stormwater permitting for our proposed project.
I know you're not interested in getting into the weeds of it, but I've saved the files that I thought were relevant at

If you remember from our phone conversation yesterday, the proposed forcemain project includes existing impervious
area at the two relevant pump stations, namely'Lowe's Pump Station', and 'Harris Teeter Pump Station'.
According to page 4 of https://www.dropbox.com/s/ffyhkIOigs3i2iu/Harris%20Teeter%20File%20Review.rdf?dl=0, the
impervious area for the 'Lowe's Pump Station' was accounted for in the existing Lowe's stormwater permit (SW8
050845). DoYou mean SIMS 050502?
The Harris Teeter documents show the 'Harris Teeter Pump Station' on the site plans (labeled as 'Sewer Pump Station'),
so all indications are that the impervious area was accounted for under SW8 090310.
Our proposed project is not adding any additional impervious area, with the exception of 3 sanitary sewer manhole
covers and 10 air release valve manhole covers along the 3.6 mile forcemain. The NC 210 forcemain project was done
by Exemption (SW8 050845), so since we are in a similar situation with impervious area accounted for in existing permits
(except for proposed manhole covers), it sounds like an exemption is applicable.
Please confirm if an exemption is the correct permitting pathway. I have the SWG04 prepared, but I'll need to confirm
whether the SWU-101 form is required as well. Thanks.
