Wilmington, NC 28403 Wilmington, NC 28405 Subject: Courtesy Notification for Section 404 Nationwide Permit 3 and Section 401 General Certifications 4132 for proposed replacement of Bridge No. 201 over Island Creek on SR 1946 (Northeast Road) in Duplin County; Federal Project No. BRZ-1946(002), WBS No. 45596.1.2; TIP B-5641 Dear Mr. Shaver and Ms. Sprinkle: The North Carolina Department of Transportation (NCDOT) is proposing to replace Bridge No. 201 over Island Creek on SR 1946 (Northeast Road) in Duplin County. The existing three span - 91 ft. bridge will be replaced with two span - 105 ft. bridge. A preliminary jurisdictional determination (PJD) was acquired on this project on April 24, 2017 and the project was assigned Action Id No. SAW-2017-00463. A preapplication site visit was conducted on December 1, 2021. Impacts associated with the project include 0.030 acres of fill, 0.009 acres of mechanized clearing and 0.018 acres of excavation to relocate an existing drainage ditch. There is also 38 linear feet of bank stabilization proposed for stabilization of the ditch outlet. Total permanent wetland impacts (loss) for this project are 0.057 acres. The only utility relocations associated with this project include an CenturyLink and Waterline bore and overhead powerline relocation. There are no impacts associated with the bores however there are 0.020 acres of hand clearing associated with a powerline relocation. The attached permit drawings and utility plans provide more details on the proposed impacts. Protected Species: Based on field observation made on December 1, 2021, habitat for wood stork is not present within the project study area. A biological conclusion of “No Effect” for wood stork is suggested by the Department. As you are aware, the US Fish and Wildlife Service has revised the previous programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. Although this programmatic covers Divisions 1-8, NLEBs are currently only known in 22 counties, but may potentially occur in 8 additional counties within Divisions 1-8. NCDOT, FHWA, and USACE have agreed to two conservation measures which will avoid/minimize mortality of NLEBs. These conservation measures only apply to the 30 current known/potential counties shown on Figure 2 of the PBO at this time. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO will ensure compliance with Section 7 of the Endangered Species Act for ten years (effective through December 31, 2030) for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Duplin County , where B-5641 is located. Regulatory Approvals: Section 404 Permit: NCDOT is proposing to construct this project under the conditions of Nationwide 3. Based on the current design and impacts, notification requirements are not applicable for this project and written approval from the USACE is not required. NCDOT will abide by all conditions listed in NW 18 and will include a copy of the certifications in the permit package and/or contract. Section 401 Permit: The associated 401 General Certification 4132 will also apply to this project. Notification thresholds or circumstances for these certifications are not applicable to this project therefore written concurrence from the Division of Water Resources (DWR) is not required. NCDOT will abide by all conditions listed in GC 4132 and will include a copy of the certifications in the permit package and/or contract. Existing bridge 201 is 1@30'6''; 1@30'0''; 1@30'6'' PPC channels with PPC caps on timber piles. Proposed bridge 201 is 1 @ 65'; 1 @40'-24'' Cored Slab with 4' caps. The proposed bridge will not have any deck drains. The pipe outlets have rip rap pads to dissipate energy. Proposed ditches in and around wetlands match the natural ground elevations to minimize impacts to wetlands.
