My apologies for the confusion. The only area in the water we will be affecting is the 30’ X 30’ or 900 square foot area
under the current location of the boat house.
There will be 0 square feet of area temporarily affected in the water.
There will be 900 square feet of area permanently affected in the water.
Our equipment is a floating dredge which is launched from a boat ramp. The only impact we will have outside that 30’ x
30’ area will be where we place anchors on shore to secure the dredge, where our 6” diameter pump line goes to the
filtration bag located on shore and the filtration bag location itself. I mistakenly approximated 1 acre of area for the
entire project including all of the shore based areas. That 1 acre includes the work area, the corridor the pump lines will
occupy, the retention area, equipment access to the retention area and the locations on each bank where we will place
anchors to secure the dredge equipment. No clearing of any kind will take place for any part of the project. The only
equipment used will be to carry materials to the retention area which already exists. When we leave the only visible
evidence we have been there will be the filled filtration bag which is being left in place and seeded to incorporate it into
the clients lawn.

Hello Mr. Taylor,
On November 17, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project, with the appropriate fee received on November 24, 2021.
The Division has determined that your application is incomplete and cannot be processed. The application is on‐hold
until all of the following information is received:
1. The submitted plans received on November 17, 2021 indicate 900 square feet of proposed dredging within Lake
Hickory. This would calculate to 0.021 acre of impact below the normal lake level.
The PCN application received on November 17, 2021 proposes impacts of 1.00 acre below normal lake level.
Please clarify the total amount of disturbance below the normal pool lake level:

Temporary:________sf. (Include all clearing for construction corridors, etc. expressed in square feet.)
Permanent:________sf. (Include all back fill, excavation, dredging, rip rap, retaining walls, and the like
expressed in square feet)
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
