Dear Mr. Walker:
Reference the Department of the Army (DA) permit issued to the Yadkin Soil and
Water Conservation District on July 27, 1998, authorizing the discharge of fill material
into South Deep Creek associated with the construction of a dam and subsequent flooding
of Deep Creek and several of its tributaries, for the purpose of constructing a
municipal /industrial water supply and flood control reservoir, known as Structure 5D.
Specifically, the project is located off SR 1314, approximately 4 miles west of
Yadkinville, Yadkin County, North Carolina.
Reference is also made to your permit modification request dated September 24,
2013, to impact an additional 0.03 acre (1272 square feet) of jurisdictional wetlands
subject to our regulatory authority pursuant to Section 404 of the Clean Water Act.
Specifically, your modification involves the discharge of fill material (rip rap) into
freshwater marsh wetlands surrounding the lake edge associated with the construction of
two 8' X 12' gravel pads (480 square feet) for 2 floating piers and docks. The project also
involves the discharge of 7 cubic yards of fill material below the ordinary high water
mark below the fishing piers for fish attractants. Finally, the permit modification involves
the discharge of sand, concrete and rip rap for the construction of a sandy beach and boat
ramp, impacting an additional 792 square feet of freshwater fringe wetlands.
We have completed our evaluation of your request and concur with your request for a
change in impacts associated with your referenced DA permit. Construction drawings
are enclose with this letter and will act as special permit conditions for this modification.
It is understood that all other conditions of the permit, including the permit expiration
date, remain applicable. The Corps has completed the evaluation of your request and
