Rob-
I feel that this disturbance would exceed 2,500 sq feet. Although we would not clear the entire footprint, we'd like to
request a buffer authorization for work area within the buffer to total: 8, 800 sq ft (8,400 sq ft in BZ 1 and 400 sq ft in BZ
2). Would you need a PCN to process this request? The WBS number for the authorization fee would be WBS 5.203211.

Heather,
Temporary Access that disturbs less than 2500 sq feet, provided that woody vegetation is Restored within 6 months, is
categorized as "Exempt" in the rules. So long as you can do that, and you do not need any 404's from the Corps, then
you are good to go.

Rob and Eric-
Durham County Maintenance proposes to clean out 280ft of a stream below the cross line outlet at 36.0257N, -
78.8722W, to alleviate flooding concerns in the area. A letter on file from NCDWQ dated 03/12/08 states this stream is
intermittent and subject to the Neuse Buffer Rules. The proposed access will be from the west side of the creek. The
disturbed area will include a width within 30ft of the channel and will extend the length of stream cleanout 280ft with
Buffer Zone 1, plus the access path through Buffer Zone 2 that would measure roughtly 20ft x 20ft. Approximately 10
trees will need to be removed for equipment access. Equipment may include an excavator and or a backhoe, with dump
trucks used on the roadway. Only clearing no grubbing will be involved. Following the work, any disturbed portion of
riparian buffer will be seeded and mulched and then replanted with hardwood seedlings. The clean out will be
conducted in the dry, sandbags will be used for dewatering and site containment. Any standing water within the channel
will be pumped out first. Material excavated from the channel will be hauled offsite. The banks of the newly cleaned
channel will be sloped and not left vertical and will be seeded and matted with coir fiber matting. Note that no wetlands
exists within the work area. Additionally no habitat for protected species exists at this location. Oversight from both the
Environmental Staff and REU Field Operations Unit will ensure that standard BMPs are followed.
As discussed previously we anticipate no mitigation requirements and no written permits necessary from the USACE. By
copy of this email with are requesting confirmation from the USACE. Also we request indication from NCDWQ on
whether or not a written buffer authorization would be required. Thank you.
