Due to the site being adjacent to our quarry and surrounded by Quarry property, we are proposing to use a Declaration
of Restrictions instead of a Conservation Easement. The Corps has a model of this on their website that we would start
with. The declaration would be slightly different due to this area being more of a mitigation site instead of a natural
system. Our legal team and the Corps office of council will have to approve the declaration before it is recorded.

Hi Thomas,
In reviewing this response and the entire file again, I realized that DWR neglected to ask for clarification on how the
relocated streams and protected buffer/floodplain will be permanently protected. My recollection from the site visit is
that we discussed a permanent conservation easement.
