Skvarla, III Secretary DWR Project # 06- 1804v7 Johnston County On February 22, 2013, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification and Authorization Certificate per the Neuse River Buffer Protection Rules (15A NCAC 2B .0233) to place fill within or otherwise impact the following: Type of Impact Amount Approved (units) 404/Wetlands 0.122 (acre) — permanent 404/Wetlands .005 (acre) — temporary Stream — permanent 1,242 (If) Stream — temporary 200 (If) Buffer —Zone 1 76,644 (sf) Buffer — Zone 2 38,891(sf) In order to meet Condition 9 (stormwater management) of the Water Quality Certification and Buffer Authorization for this project, a stormwater management plan (SMP) for Pod NW8, dated February 1, 2013, was received on February 1, 2013. This plan was approved on March 18, 2013 (a revised approval letter was issued March 27, 2013). A revised stormwater management plan for both Pod NW8 and Pod 9, dated April 4, 2013, was received April 4, 2013. This revised plan was approved on May 7, 2013. On August 16, 2013, a SMP for POD NW8 -Phase II, dated August 16, 2013, was received. The DWQ approves the SMP for POD NW 8 Phase II as meeting Condition 9 of the Water Quality Certification and Buffer Authorization. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new SMP. The SMP approved by the DWQ consists of one (1) bioretention cell and all associated stormwater conveyances, inlet and outlet strictures, and the grading and drainage patterns depicted on plan sheets dated August 6, 2013. The plans and specifications for Pod NW8 (Phase II) approved by DWR are incorporated by reference into this approval and are enforceable by DWR, provided however that any modification of the design for the bioretention cell that is accepted by DWR shall take precedence over the original plans and specifications. The maximum allowable drainage area for the approved bioretention cell shall be 361,981 square feet and the maximum allowable built -upon area within that drainage area shall be 130,500 square feet. Built -upon area includes, but is not limited to, roofed structures, asphalt, concrete, gravel, brick, slate, coquina and parking areas, but does not include raised, uncovered open slat decking or the water surface of swimming pools. Any changes to these maximum areas shall require the applicant to submit and receive approval for a revised stormwater management plan by the DWR. 3. The footprint of the bioretention cell as well as an additional 10 -foot wide area on all sides of the devices shall be located in public rights -of -way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights -of -way, common areas and easement areas shall be in accordance with the approved plans. 4. Maintenance activities for the bioretention cell shall be performed in accordance with the notarized 0 &M agreements signed by you on August 7, 2013. The 0 &M agreement must transfer with the sale of the land or transfer of ownership /responsibility for the BMP facility. DWR must be notified promptly of every transfer. S.
