Dear Christy,
Attached is the PCN for the proposed repairs to Ledbetter Lake Dam on Hitchcock Creek, three
miles northeast of downtown Rockingham. On Novemeber 18 1 emailed you a brief project
description and figures, and on November 21 you replied, concurring that the work was eligible
for Section 404 permitting using NWP -3 for repair and maintenance.
As documented in the attached PCN, I found no wetlands along the affected lake shoreline,
stream banks below the dam, or off -site borrow area. The receiving stream (Hitchcock Creek)
and the lake are the only jurisdictional waters affected. The lake was drawn down in 2012 as
requested by NC Dam Safety Program (see enclosed figures) and most of the lake bed is
currently dry, except for a small pool just in front of the old spillway gates. Let me know if you'd
like to arrange a site visit to confirm my findings or discuss the project.
The project will include the following much - needed structural and safety improvements to the
dam: 1) demolish the deteriorated upper portion of the primary spillway, outlet gates, training
walls, powerhouse, and penstock; 2) rebuild the primary spillway at the existing crest elevation,
encasing it in a concrete monolith and widening the base to improve structural stability; 3)
rebuild the outlet works and non - overflow dam section (left abutment) between the primary
spillway and the mill building, installing new gates and controls; 4) rebuild the earth
embankment and training wall between the primary spillway and Ledbetter Rd (right abutment)
with a drain system to capture and convey seepage. The project as described herein, designed
by Schnabel Engineering of Greensboro, will include the following unavoidable impacts to the
stream and open waters (lake).

The "temporary" lake impacts do include permanent changes to the lake bed elevation
(excavation of Borrow Area 1 north of the dam, and fill, excavation and grading in front of the

spillway and embankment) but these changes do not result in loss of waters or impairment of
function, and are thus tallied as temporary impacts.
The State Historic Preservation Office (SHPO) sent a project response letter stating that the
Ledbetter Manufacturing Company mill building might be eligible for listing in the National
Register of Historic Places. However, the deteriorated condition of Ledbetter Dam would make
it a non - contributing element if the mill is proposed for NRHP listing. SHPO concurs that the
proposed dam repair will have no effect on historic properties.

3. Project Description
3a. Describe the existing conditions on the site and general land use in the vicinity of the project at time of this application:
Ledbetter Dam was built on Hitchcock Creek about 1910, replacing a smaller mill dam built in the 1800s. The dam provided
power for Ledbetter Manufacturing Company, a textile mill that operated until 1979. The existing dam is approximately 35 feet
high with a 120 foot long concrete- masonry primary spillway crest. To the left (south) of the primary spillway is an 80 foot
long concrete- masonry non - overflow segment that connects to the north wall of the old mill building, and includes the
hydroelectric penstock, wet well, turbine and powerhouse. The hydroelectric facility has not been functional for several
decades, and the dam is not regulated by FERC. The right abutment is earth -fill, and extends northward from the primary
spillway about 400 feet toward Ledbetter Rd. The dam's auxiliary (emergency) spillway is 150 feet long and located near the
north end of the right abutment. Flood -stage flow from the auxiliary spillway flows southward parallel to Ledbetter Rd,
entering the north bank of Hitchcock Creek immediately east of Ledbetter Rd (SR- 1442).
Ledbetter Dam has a 73 sq.mi. drainage basin area and is designated a High- Hazard Dam by the NC Dam Safety Program. The
lake serves as an amenity for adjacent property owners, including condominiums in the former mill building, and provides
supplementary water supply storage for the City of Rockingham's intake on Roberdel Lake about 2 miles downstream, which
has far less storage capacity than Ledbetter Lake. Ledbetter Lake was drained in late 2012 to early 2013 following inspection
by NC Dam Safety Program staff that revealed leaks, structural damage and deficiencies that might result in dam failure.
Currently (Fall 2013) the lake level is about 22 feet below normal pool and the lake bed is mostly a dry mudflat, with the
original two stream channels and a few isolated shallow pools remaining. In 2013 the lakefront property owners established an
LLC to purchase the dam from the previous owner (R.E.C., LLC) and to obtain funding to repair the dam.
Hitchcock Creek is 120 feet wide at the toe of the dam, and narrows to 50 feet wide at the Ledbetter Rd bridge about 200 feet
downstream (west) of the dam. Sand and gravel are the predominant stream bed materials, plus some cobble apparently placed
for erosion control along the banks. A powerline parallels the road east of the bridge, and the stream banks between the dam
and the bridge are non - forested except for a few large trees along the south bank, between the powerline and the left abutment.
The flow pathway below the auxiliary spillway is grassed, and follows the powerline southward from the north end of the dam
embankment to the creek. Except for the mill condominiums, the surrounding land is low density rural residential and forest.
The proposed soil borrow site west of Ledbetter Rd is recently clearcut land.

3b. List the total estimated acreage of all existing wetlands on the property:
RJG &A biologist Gerald Pottern examined the Ledbetter Dam project area for wetlands and waters on 10 Sept 2013. Neither
the stream nor the lake shoreline was found to have wetlands, other than the typical line of hydrophytic herbs, shrubs, and
saplings that occur along most stream and pond shorelines. The transition from upland to open water (lake) or stream is abrupt
throughout the dam repair construction area. Wetlands occur elsewhere along the lake shoreline, well beyond the project
construction area. The lake bed was mostly dry to a depth of 20 feet below the normal pool elevation at the time of RJG &A's
field visit. Borrow Area 1 is within the drained lake bed and is presently dry, but shall be considered "open waters" for
quantifying impacts. Borrow Area 2 is on cleared uplands west of Ledbetter Rd, across the street from Carolyn's Mill.
3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property:
The only stream in the project area is Hitchcock Creek, which flows 200 feet on the project site from the toe of Ledbetter Dam
to the Ledbetter Rd bridge, and varies in width from 120 feet at the dam to 50 feet at the bridge. It is obviously a perennial
stream, with a sand and gravel dominated substratum and aquatic life including sunfish, darters, crayfish, benthic insects,
salamanders, and tadpoles. This stream is mapped on both the USGS Topographic Quadrangle (Hamlet) and the USDA Soil
Survey of Richmond County (Sheet 8).
3d. Explain the purpose of the proposed project:
NC Dam Safety Inspectors examined Ledbetter Dam during April and July 2012 and issued a Notice of Deficiency (NOD) on
20 July 2012 identifying several problems and maintenance issues that could result in dam failure during high flow events or
seismic activity. Reported problems include cracks and leaks on the left side of the spillway, concrete deterioration, seepage
through the embankment, stability of the embankment, impaired bottom drain operation, and inadequate spillway capacity. The
NOD instructed the owner to prepare an Emergency Action Plan and to drawdown the lake at least five feet until permanent
repairs are completed. During 2013, the lake was drawn down to the lowermost gate to remove accumulated logs and debris, in
preparation for repairs.
The proposed repair work designed by Schnabel Engineering will bring Ledbetter Dam into compliance with current NC Dam
Safety Program structural and hydraulic safety standards for a high- hazard dam. The deteriorated upper portion of the concrete -
masonry spillway will be partially demolished and rebuilt at the existing normal spillway elevation (230.1 feet). The normal -
stage spillway width will be widened from 85 feet to 120 feet by removing the mid -stage steps at each end, thus increasing flood
capacity. The downstream face of the spillway and non - overflow sections will be buttressed with a mass concrete overlay,
widening the dam footprint. The existing penstock and intake will be modified into a dual - purpose low -level outlet and
penstock capable of future hydroelectric use, should the owner decide to rehabilitate the hydroelectric facility at some time.
(Hydroelectric rehabilitation is not part of this proposed project). The new outlet gates will include a trash rack and operating
platform for the gate controls. The right embankment will be raised slightly and the auxiliary spillway improved to provide
hydraulic capacity for 1/3 Probable Maximum Precipitation (PMP) loading conditions without overtopping the dam. A new
stability berm and drain system will be installed to reinforce and collect seepage from the embankment. The rebuilt spillway and
outlet structure will provide non - erosive flow velocity in the receiving stream. The lake's normal pool elevation will remain the
same at 230.1 feet.
3e. Describe the overall project in detail, including the type of equipment to be used:
Stage 1 Construction (Left Side): 1. Install erosion and sediment control features, while maintaining the lake in its current
dewatered condition, about 20 to 22 feet below normal pool. 2. Remove wood, debris and unsuitable soils in front of the dam
using an excavator. 3. Establish haul roads on both sides of the embankment with access from Ledbetter Road at the north end
of the dam. 4. Construct the Stage 1 upstream and downstream cofferdams to isolate the left side of the spillway, using a
combination of earth fill and inflatable "Super Sack" cofferdams. 5. Convey flow through the two existing rectangular low -
level gate openings on the right side of the spillway. 6. Demolish selected upper portions of the existing spillway, left non -
overflow section, generator building, penstock, and ancillary structures identified in Figures 7A -7E. 7. Excavate and prepare the
spillway foundation for the new concrete buttress upstream and downstream, and grade the lake bed to create an approach
channel upstream of the new low -level outlet. 8. Construct the left side of the new primary spillway (elev = 230.1 ft), concrete
buttress, non - overflow wall, and outlet works, including a new 72 -inch diameter steel conduit (invert elev = 208.0 ft). The
outlet gate on the conduit will be installed at end of Stage 2 after NC Dam Safety approves the dam repair work. 9. Remove the
upstream and downstream cofferdams to convey flow through the new 72 -inch outlet.

3e. Continued:
Stage 2 Construction (Right Side): 1. Install the Stage 2 upstream and downstream cofferdams (combination of earth fill and
Super Sack cofferdams) to isolate the right side of the spillway, and convey flow through the new 72 -inch conduit on the lel't
side. 2. Excavate and prepare the spillway foundation for the new concrete buttress upstream and downstream, and reconstruct
the right side of the spillway and buttress, sealing off the old gate openings. 3. Excavate lake sediment from borrow area 1 (1.50
acres), and redeposit it adjacent to the right abutment, grading the lake bed to create a stable 3:1 slope. 4. Rebuild the right
spillway training wall with structural concrete and install drain system. 5. Clear and grub borrow area 2 within project limits as
necessary (2.0 acres). 6. Place earth fill, bedding stone and riprap along the upstream embankment wrap - around on the right
side of the spillway, with 3:1 slope. 7. Remove the upstream and downstream cofferdams on the right side of the spillway. 8.
Place earth fill, drain fill, and riprap slope protection on the downstream face of the right embankment. 9. Restore the site, apply
topsoil and re -seed disturbed areas, then remove equipment and temporary erosion control features. 10. Install railings, stairs,
control platform and other improvements on the left side of the spillway. 11. During a period of low flow with favorable
weather forecast, insert stop logs upstream of the 72 -inch outlet pipe and install the steel bulkhead plate and new gate.
Minimum in- stream flow (13 cfs) will be maintained via pump or siphon during gate installation while the outlet pipe is
blocked. 12. Once the gate is installed and approved by the engineer, remove the stop logs to restore flow through the outlet
pine. 13. Obtain aaaroval from NC Dam Safetv Program before closing the gate to refill the lake.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The spillway and embankment must be stabilized and widened to meet current safety requirements, so it is not possible to avoid
impacts in the stream and lake. The rebuilt structures are designed to occupy the existing dam footprint to the extent practicable,
and the existing normal pool elevation and area will be preserved. The rebuilt outlet will include a minimum flow release pipe, and
both outlets are designed to protect against erosion of the stream channel. Open water impacts within the lake will he mostly
temporary (dewatering, cofferdam, excavation and backfill), relocating lake bed sediment from one area to another. Depths will
change but no loss of lake bed area or function will occure. Required fill material for the downstream embankment improvements
till will be taken from a previously - cleared upland site across the street from the dam.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Temporary cofferdams in the lake bed and stream will isolate half of the spillway during each stage of construction, keeping the
work area dewatered to minimize erosion, turbidity, and potential concrete toxicity. Flow to the stream will be maintained through
the existing low -level outlet while the left side is repaired, then through the new left side outlet pipe while the right side is repaired.
A siphon or pump will maintain the required minimum flow (13 cfs) while the gate on the new outlet pipe is being installed.
Appropriate DLR- approved erosion and sedimentation controls will be implemented to protect waters and adjacent lands along the
stream, lake shore, and soil borrow areas.

Michaux's Sumac. No suitable habitat for these species exists in or adjacent to the project area, based on field surveys by
RJG &A in September 2013, and none of these species is likely to be affected (see attached report).

Ledbetter Dam is part of the Ledbetter Manufacturing Company textile mill historic site, as recognized by Richmond County and
the NC State Historic Preservation Office (SHPO site # RH0384). It is not listed on the National Register of Historic Places, but the
mill building may be eligible for listing. In response to a project scoping letter submitted by RJG &A, SHPO stated that the
deteriorated condition of the dam would make it a non - contributing element for NRHP listing, and SHPO concurs that the proposed
dam repair will have no effect on historic properties (SHPO letter 17 Dec 2013 attached). However, SHPO did request copies of
any available documentary materials on the dam for their files, including recent and historic photographs (.jpg files), existing and
proposed site plans, and any elevation drawings of the dam (.pdf or .tif files).

modeling which shows a "no- rise" condition.

Dear Mr. Pottern:
Thank you for your letter of November 18, 2013, concerning the above project, which proposes the substantial
rehabilitation of the existing dam to correct severe structural deterioration.
As you know, the dam was part of the Ledbetter Manufacturing Company complex, although earlier mills and
their dams occupied the site since the late 18''' century. The dam's original construction date is unknown, but it
was greatly enlarged, from 5 to 27 feet high, when the present mill building was constructed on the south shore
of the lake, circa 1910 -11.' The Ledbetter Manufacturing Company building was identified during the 1999-
2001 Richmond County Architectural Survey, and despite some insensitive alterations when the building was
renovated for residential use, the mill appears to be polenlialy eligible for listing in the National Register of
Historic Places.
When intact, dams are significant contributing resources to historic mill complexes. However, given the
severely deteriorated condition and lack of structural integrity, this dam would be considered a non-
contributing resource. The mill building itself will not be affected by the proposed protect. Therefore, we
concur that the project as proposed will have no fled on historic properties.
We do request that any readily available documentary materials on the dam be submitted to add to Our files.
These materials may include )PEG files of the photographs enclosed with your letter, historic photographs, a
PDF or TIF file of the existing and proposed site plans, and any elevation drawings of the dam.
