For reference, the history is summarized in the attached Bay Lake Docs attachment. In short, a manmade lake/pond was connected to an established natural creek without approval/authorization. Take a look at the attached topomap. You won't see a connection between Taylor Creek (and area canals) and the subject lake. Aerial photos are also provided for reference. With the "connection" made between the lake and creek/canals, "waterfront" lots with river access were created. Mr. Whichard stopped by our office recently unannounced (within the last couple of weeks) and met with me and David Moye (district [AMASupervisor). Mr.VVhichardvvasundertheimpressionthatourofficehadreceivedarecent^water quality evaluation report" summarizing surface water monitoring data related tothe project. We let Mr. VVhichard know that we hadn't received the report, but would be glad to review the data once received. Shortly thereafter, vve received a "draft/prelimi nary" report, but still to my knowledge haven't received the official final report. Once we receive the final surface water evaluation report and have chance to evaluate findings, | believe we'll be in a position to make recommendations on how to proceed with the matter (as related to the course of action to address the "connection" between the creek/|ake/cana|sin the area). Given that the project overlaps with CAMA, we're working to coordinate with them also. Please call if anyone needs more background or further information on where we are now with the matter. Regarding Rose Acre Farms, it's my understanding that the existing case is still open and we're still working on things. Please let me know if there are questions or comments. Thanks David May, LG. That means that the Army Corps would have to approve whatever is being proposed. I have copied the DWR Washington Regional Supervisor, David May, to see if he has any insights into this. Regarding Rose Acres, we basically had a deal but then Rose Acres backed out on the advice of their corporate attorneys. Lacy is meeting with staff on trying to resolve that. Thanks.
