Dear Ms. Steenhuis,
In your letter to us dated 12 July 2007, you requested additional information for
the proposed Bayberry Farms at the Preserve Subdivision. Specifically, you
requested large copies of the overall subdivision map, a detail drawing of the
proposed arched culverts, and cross-sectional drawings for roads sections that
would be created by filling wetlands. Since your letter, revisions have been
made to the site plans that eliminated the proposed arched culverts. Attached to
this letter is a copy of our 31 July 2007 letter to Mr. Brad Shaver, which spells out
the changes made to the site plan. The remaining materials you requested are
also included with this correspondence.
Submission of these materials should complete the informational requirements
for 401 Certification. Please continue with the processing of our application.

Dear Mr. Shaver,
It has recently come to our attention that some of the technical aspects of the
plans originally submitted for the Bayberry Subdivision were not feasible. For
example, the bridges that were shown for Crossings R1, R6 and R7 cannot be
constructed without wetland impacts. Footers needed in the wetlands to support
the bridges would result in additional impacts to those previously calculated.
Since the addition of these footers would result in total wetland impacts of greater
than 0.5 acres, the design engineers. have wor4ced diligently to bring impacts
below this threshold without drastic alteration of the site plans. Arched culverts
were also planned originally, but the wetland crossings were too wide to be
spanned. Therefore, bridges are now proposed at these locations,. with the
exception of Crossing R4, which has been eliminated. The road at Crossing RS
has been realigned and a portion of the wetland bridged to further reduce
impacts. Crossing U4, which was previously overlooked, has now been
accounted for and added to the proposed impacts.
A table summarizing the wetland impacts at each crossing and a site plan
illustrating the revised subdivision layout and the wetland and upland
conservation areas are included with this letter. Typical cross-sections of cut and
fill areas are also included. Cross-sectional drawings for each of the wetland
crossings are currently being prepared by the design engineers and will be
forthcoming. With submission of these materials we are requesting a permit
modification which will reflect the design changes.
In previous correspondence, Lots 46 through 76 were identified as areas that the
USFWS has not yet granted clearance to permit development. The lots in this
area have been renumbered and the new corresponding tot numbers are Lots 43
through 71. The area previously occupied by Lots 75 and 76 no longer has lots

planned, but will still remain off limits until USFWS grants clearance to devFlop
them.
The permit modification requests--d should note that total wetland impacts
proposed has been reduced from 6.494 acres to 0.471 acres. Exclusion of the
0.027 acres proposed for Crossing U2 would allow for 0.444 acres of wetland
impacts. Currently, 0.467 acres are permitted. Also the total number of lots in
the subdivision has been reduced to 232.
