Hey Bob,
Thank you again for calling me back. My particular question had to deal with a project for which S&EC had been the
consultant. That project name is Seagrove Farm in Apex, NC. There is a 401/Buffer Authorization for this project and
that DWR# is 2005-1985. The issues are as follows:
the 401/Buffer Authorization Approval Letter 2005-1985, Condition #4 (see letter attached) states that the
applicant (David Goracke with Westfield Homes of the Carolinas, LLC) will need to mitigate for 29,529 square
feet of Neuse riparian buffer impacts in Neuse 03020201.
the 401/Buffer Authorization Approval Letter Condition #4 also states that the applicant chose to use NCEEP to
satisfy their mitigation requirement
As of October 28, 2011, the applicant had failed to pay their mitigation required by the 401 and so was sent a
Failure to Comply with 401 WQC Condition letter from DWQ (now DWR) (see Request for Info letter attached).
Today, January 6, 2013, DWR was notified by EBX Neuse 1, LLC, a private mitigation banker, that Mr. Grey
Methven of Standard Pacific of the Carolinas, LLC has provided payment to satisfy the 29,529 square feet of
Neuse riparian buffer impacts associated with the 401 noted above.
The problem, which is no biggie, is that in order to be compliant and in order to remove NCEEP from their obligations of
being the mitigation provider for these impacts, Mr. Grey needs to request a 401/Buffer Authorization Modification of
Condition #4, stating they he wishes to satisfy his buffer mitigation requirement by using a private mitigation bank
instead of NCEEP. DWR must then, approve his request, which we will, and he will then receive a receipt from EBX
confirming payment for the mitigation. Please advise your client of his need to submit a modification to us in order to
resolve the complexities of the Seagrove Farm mitigation requirement. We would like to remove Seagrove Farm’s
permit from the “non compliant” status to “compliant” status since they have already actually paid for their mitigation.
I will be more than happy to contact Mr. Methven if needed. Please keep me informed & let me know if you need
anything further.
