We have spoken several times on the phone regarding my lot (105 Symphony Ct) in Regency Park Estates in
the town of Cary. We also own the home that is built on the adjacent property - 107 Symphony Ct. I recently
had an inquiry from a buyer regarding purchasing the 105 Symphony lot with the intent to build a house on it.
The deal fell through when questions arose regarding the buffer zone requirements arose.
When my wife and I purchased the lot in 2002, there was no mention of a buffer zone nor are there any
notations on the survey. It is my belief (hope) that the "creek" running along the length of the property is in
fact a drainage ditch. I have checked the USGS topo map and while the creek is identified running aa~oss the
back of the property, no mention is given to the "creek" running the length of the property. The gentleman
(Tom Hill) at the Wake Soil and Water Conservation District did not believe that the drainage was part of the
creek (based on his reading of the Soil map), although he noted that it would be up to your interpretation. The
"creek" originates at the street (multiple runoff grates located on and near the street); has two large drain pipes
under the street and is surrounded by rip rap (see photos). The °creek" only has water during a heavy storm
and I have never seen any standing water. The rip rap is spread throughout the "creek" until it connects with
the more obvious creek at the rear of the property
I have also included an imaps rendering (Wake County & the City of Raleigh) showing the lot with the
Soil mazkers superimposed, a USGS map and the Soil map as you requested. I would like to get an
opinion regarding whether the "creek" is a subject to the 50' boundary restrictions.
