Byron,
There isn't a time limit for variance reviews. Variance approvals typically take 6 to 9 months before a decision is
rendered by the EMC. We do our best to process applications in a timely manner, but the Division has no control over
the EIVIC's schedule. Because several EMC members appointments were scheduled to expire at the end of June, we
thought the July meeting would be canceled. The commission met in July, but we did not receive the revised application
in time for the EIVIC's June 15" deadline for receipt of agenda items. As far as your mitigation reserve letter, you can
contact the mitigation bank and ask them to extend its expiration.

So isn't there a limit on the amount of time between when an application is submitted and when it has to be
reviewed? these procedural delays have already added 6 months onto this project. I thought the new members
were voted in during the July meeting, which is why we got delayed until September?

0k, I just wanted to check with you in case the question came up during the EMC meeting.
Unfortunately, I found out yesterday afternoon that the EMC canceled the Water Quality Committee
meeting for September. Most of the members of the commission have been or will be replaced. The
EMC will meet to swear in new members, but there won't be any committee meetings until November.
Variance requests have been delegated to the Water Quality Committee. Therefore, we will not be able
to present your request until the November meeting.

I'm happy to put splash guards down for the gutters on the new screened porch, but we're already
treating 3/4 of the roof runoff in the rain garden. Since the other items are covered under
existing use, I wouldn't think either the variance or the covenant would impact them.

we can notify the EMC that a protective covenant will be recorded similar to ones that
have been approved in the past by the Division and EMC and a draft of which will be
reviewed and approved by the Division prior to recordation.
I believe we had discussed using a splash pad for the gutter discharge from the
proposed screened porch. I wanted to see if you would be willing to remove the direct
discharge to the stream from the existing gutter located in the area of proposed
screened porch and direct it to a splash pad. Many of the different protective covenants
that I reviewed prohibited any direct discharge of stormwater through the buffer.

these out if the variance is approved ?" As far as the other discharges, do you
mean any new ones from the new constriction?

of the document is available for their review. Also, would you be willing
