On March 15, 2007, the Division of Water Quality (DWQ) received your application dated March 14,
2007, to fill or otherwise impact 0.4946 acres of 404/wetland to construct the proposed residential
development. On May 18, 2007, and June 21, 2007,the DWQ received additional information from you,
however, the DWQ has determined that your application remains incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we
receive five copies of the additional information requested below, we will have to move toward denial of
your application as required by I SA NCAC 2H .0506 and will place this project on hold as incomplete
until we receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
Because Richland Creek is classified as a trout stream, General Certification 3631 requires that
all of the stormwater resulting from this development be treated by one of the following BMPs: a
wet detention pond followed by a level spreader and forested filter strip, a constructed stormwater
wetland, or a bioretention area. The DWQ will also allow any alternative BMP or combination of
BMPs that achieves 30 percent or greater removal of nutrients and 85 percent or greater removal
of TSS.
2. Many of the BMPs currently proposed for this project do not meet the requirements of General
Certification 3631, including: Stand-alone wet detention ponds, Routing stormwater through
grassed areas, and Utilizing existing natural wetlands for stormwater treatment.
3. Stormwater BMPs must be designed in accordance with the DWQ BMP Manual. Submittals
received by the DWQ prior to October 1, 2007 may use either the 1999 or 2007 version of the
BMP Manual. Submittals received by the DWQ after October 1, 2007, must use the 2007 version
of the BMP Manual. Please note that both versions of the DWQ BMP Manual require that wet

detention ponds and constructed stormwater wetlands be designed to retain the runoff resulting
from the one inch storm and releasing it over a period of three to five days.
4. The current submittal states that there is a 0.132 area that will not receive stormwater treatment.
However, General Certification 3631 requires stormwater treatment for the entire site; please
correct this in the resubmittal.
5. In your resubmittal, please include a completed BMP worksheet for each one of the proposed
stormwater BMPs. Links to these worksheets are available on the bottom of the following DWQ
web page: http://h2o.enr.state.nc.us/ncwetlands/regcert html
6. As you complete the worksheets, please provide all of the information listed in the "Required
Items" list so that the DWQ can review your application.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-
