I've confirmed that the mitigation plan described in the Public Notice issued on December 12, 2013 by the US Army
Corps of Engineers was approved by DWR as part of the 401 approval issued on December 20, 2012. Therefore, a 401
modification is not necessary. Please disregard our December 13, 2013 letter requesting an application and fee to
process a modification.
