III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps maybe included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules. USACE Action ID 2006 00316. 52 acre site W 87' of stream impact
and 0.092 acres of riparian wetlands. The mitigation was conservation and payment to NCEEP.

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures talcen to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

The purpose of this Letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for impacts associated wish the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NCEEP will be approved.
This acceptance is valid for six months from~the date of this letter and is not transferable. If we have not received a copy of
the issued 444 Permit/441 CertificatiodCAMApcrmit within Wis time flrame, this acceptance will expire. It is the
applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice
will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized
work. The amount of the in Lieu Fee to be paid to NCB1:P by an applicant is calculated based upon the Fee Schedule and
policies listed at www.nceep.net.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies
require mitigation credits greater than indicated above, and the appl"scant wants NCEEP to be responsible for the additional
mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. G. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4,1998.

Impact minimization /Justification
The wetlands and stream impacts for Section II are required to interconnect Kanton Hills
subdivision and the Dawson Place subdivisions. The road is designed as low as possible and as close
to perpendicular to the stream as possible to reduce the amount of fill in the wetlands area. Old photos
of the area indicate that there was an existing crossing, likely a ford, at or near the proposed crossing.
The proposed crossing will be permanent and stable replacing the previous ford.
The wetlands impact #1 in Section III attempts to use the existing road crossing as much as
possible to reduce the wetlands impact. The existing soil road is narrow and could not be upgraded to
meet DOT standards without impacting the wetlands. The road is designed to take advantage of the
existing grades and impact a minimum amount of wetlands.
At this culvert crossing a wetlands creation area is proposed. The culvert outlet invert is set
near the existing wetlands grades. An area between the culvert outlet and the wetlands will be graded,
matching existing wetlands grades, then seeded with a wetlands mix, to create additional wetlands.
The wetlands and stream impact #2 is to create intereonnectivity between section II and Section
III. This crossing also occurs at or near where aerial photo indicates a crossing may have been. This
crossing was designed to keep the road as low as practical, and as perpendicular to the stream as
practical. The stream is sinuous in this area and the loss of stream is greater than the length of pipe
installed
There are many wetlands fingers in section III. Additional wetlands impacts were avoided by
shifting the road, such that impacts would not occur.
Previous Section I has an existing Nationwide 39 for the wetlands impacts in section I (USAGE Action
ID 200600316) At that time the future stream impacts for Sections II, and III were indicated, however,
the exact size of the crossings was not known. These future crossings were therefore not permitted at
that time.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions, application dated 10/4/2006, and your submitted plans (Sheet 1-4 of 4, dated 10/11/2006, sheets 2 and 3 sealed by
M.J. Klinker 11/8/2006). Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification is valid until the NWP is modified, reissued, or revoked. All of the existing NWPs are scheduled to be modified,
reissued, or revoked prior to March 18, 2007. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a
public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to commence this activity before the
date that the relevant nationwide permit is modified or revoked, you will have twelve (12) months from the date of the modification or
revocation of the NWP to complete the activity under the present terms and conditions of this nationwide permit. If, prior to the
expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid
until the expiration date identified below, provided it complies with all new and/or modified terms and conditions. The District
Engineer may, at any time, exercise his discretionary authority to modify, suspend, or revoke a case specific activity's authorization
under any NWP.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management .

Special Conditions:
1) The permittee shall execute and cause to be recorded in the Onslow County Register of Deeds restrictive
covenants acceptable to the Corps of Engineers (Draft received October 19, 2006 prepared by Frank W.
Erwin) for the purpose of maintaining the conservation areas depicted as wetlands, as shown on the
reviewed plat (dated 10/11/2006 printed 11/8/2006) in their natural state in perpetuity, prior to the sale or
conveyance of any lots or other property within the subdivision. The permittee shall enforce the terms of
the restrictive covenants and, prior to conveyance of the property, shall take no action on the property
described in the covenants inconsistent with the terms thereof. The permittee shall provide a copy of the
recorded restrictive covenants to the Corps of Engineers within 15 days of recording.
2) In order to compensate for impacts to 0.092 acres of riparian wetlands and 871inear feet of stream channel,
the permittee shall make payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in
the amount determined by the NC EEP, sufficient to perform the restoration of 0.092 acres of riparian
wetlands and 871inear feet of stream channel in the White Oak River Basin, Cataloging Unit 03030001.
Construction within jurisdictional areas on the property shall begin only after the permittee has made full
payment to the NC EEP and provided a copy of the payment documentation to the Corps, and the NC EEP
has provided written confirmation to the Corps that it agrees to accept responsibility for the mitigation
work required, in compliance with the MOU between the North Carolina Department of Environment and
Natural Resources and the United States Army Corps of Engineers, Wilmington District, dated November
4, 1998.

2. WETLANDS AND CONSERVATION SPECIAL PROVISIONS:
A. Compliance with Wetlands Regulations: It shall be the responsibility of each
owner, prior to alteration of any lot, to determine if any portion of the Lot shall have been determined
to meet the requirements for designation as a regulatory wetland. Any subsequent fill or alteration
of this wetland shall conform to the requirements of state wetland rules adopted by the State of North
Carolina in force at the time of the proposed alteration. The intent of this deed restriction is to
prevent additional wetland fill, so the property Owner should not assume that a future application
for fill will be approved. The property Owner shall report the name of the subdivision, in any
application pertaining to wetland rules. This covenant is intended to insure the continued
compliance with wetland rules adopted by the State of North Carolina, therefore benefits may be
enforced by the State of North Carolina. This covenant is to run with the land and shall be binding
on all parties and all persons claiming under them.
B. Conservation Areas: The areas shown on those plats recorded in Map Book
_, Page _, and Map Book ,Page as conservation areas shall be maintained in
perpetuity in their natural or mitigated condition. No person or entity shall perform any of the
following activities on such conservation area:
(1) fill, grade, excavate or perform any other land disturbing activities
(2) cut, mow, burn, remove, or harm any vegetation
(3) construct or place any roads, trails, walkways, buildings,
mobile homes, signs, utility poles or towers, or any other
permanent or temporary structures
(4) drain or otherwise disrupt or alter the hydrology or drainage
ways of the conservation area
(5) dump or store soil, trash, or other waste

(6) graze or water animals, or use for any agricultural or horticultural purpose
This covenant is intended to ensure continued compliance with the mitigation condition of a Clean
Water Act authorization issued by the United States of America, U.S. Army Corps of Engineers,
Wilmington District, AID# 200600316 and therefore may be enforced by the United States of
America. This covenant is to run with the land, and shall be binding on the Owner, and all parties
claiming under it.
5. GENERAL PROVISIONS:
Section 1. Term: These covenants are to run with the land and shall be binding on all parties
and all persons claiming under them for a period of twenty (20) years from the date these covenants
are recorded, after which time such covenants shall be automatically extended for successive periods
of ten (I O) years.
Section 2. Enforcement: In the event of a violation or breach of any of these restrictions,
covenants, agreements and conditions by any person or concern claiming by, through ar under the
undersigned, or by virtue of any judicial proceedings, the Declarant, its successors and assigns and
the owners of the number lots in the subdivision, or any of them, jointly or severally, shall behave
the right to proceed at law or in equity to compel compliance with the terms thereof or to prevent the
violation or breach of any of them. Costs and reasonable attorney fees shall be recoverable by the
person or party seeking to compel compliance with these restrictive covenants as part of any
judgment or order issued. The failure to enforce any right, reservation, restriction or condition con-
tainedherein, however long continued, shall not be deemed a waiver of the right to do so thereafter
as to the same breach or as to a breach occurring prior or subsequent thereto and shall not bar or
affect its enforcement.
Section 2.1. Remedies Extended to the State of North Carolina• To ensure that this
subdivision is maintained consistent with the laws of the State of North Carolina, the State of North
Carolina is specifically empowered to take such acts necessaryby and through its officers to enforce
any of these covenants against an Owner. The State of North Carolina is specifically made a
beneficiary of these covenants.
Section 3. Modification of Restrictive Covenants: Except as to specific rights retained by
Declarant, these restrictions are subject to being altered, modified, canceled or changed at any time
as to said subdivision as a whole or as to any subdivided lot or part thereof during the first twenty
(20) year period by written document executed by the Declarant or their successors in title and by
the owner of not less than ninety percent (40%) or mare of the subdivided lots, the Declarant may
alter or amend these covenants without consent of anyone. After the expiration of the initial twenty
(20) year period, these restrictions are subject to being altered, modified, canceled or changed at any
time as to said subdivision as a whole or as to any subdivided lot or part thereof by written document
executed by not less than seventy-five percent (75%) of the Lot Owners, and recorded in the office
of the Register of Deeds of the County in which this Declaration is recorded.

Section 4. Special Provision Relative to Amendment: No amendment shall be valid to
affect the provisions of this Declaration (Wetlands and Conservation Special Provisions) without
the execution and recording of an amendment upon the authorization and approval of the United
States of America, U.S. Army Corps of Engineers, Wilmington District, or successor regulatory
agency or authority.
Section S. Severabilitv: Invalidation of any one of these covenants or restrictions by
judgment or court order shall in no way affect any other provisions which shall remain in full force
and effect.
