Regional,Office of the Division of Water Quality (DWQ) is considering taking an enforcement action for violations found on the subject p~opertyof Oxford Square. On June 12, 2007 Kyle Barnes and Amy Yount of the Division of Water Quality (D1/VO) met with Lisa Merritt, Neal Floyd, Ricky Dixon and yourself and inspected the property known as Oxford Square: The property is located off Cuyler Best Road in Wayne County located within the Neuse River Basin and. bordered by Reedy Branch. During the site visit, investigators observed impacts to the riparian buffer along Reedy'Branch. Vegetation removal consisted of clear-cutting in Zone 1 and Zone 2 of the riparian buffer, which is prohibited in the buffer rules. Investigators also observed rip-rap placed in the channel of Reedy Branch as well as rip-rap placed in a created channel in the wetland. A DWQ file review confirms impacts to the riparian buffer occurred without any notification or authorization from the Division of Water Quality. Item III. Wetland Standard Violation Investigators observed that a temporary channel through the wetland was created and has not been returned to grade. Additionally, the temporary channel has been armored with rip-rap, which is a violation of 15A NCAC 02B .0231 (b) (1) Liquids, fill or other solids or dissolved gases may not be present in amounts which may cause adverse impacts on existing wetland uses;(5) Hydrological conditions necessary to support the biological and physical characteristics naturally present in wetlands shall be protected to prevent adverse impacts on: (C) The chemical, nutrient and dissolved oxygen regime of the wetland;(D) The movement of aquatic fauna;(F) Water levels or elevations. Item IV. Failure to Secure a 401 WQC DWQ site visits and file review confirmed that a 401 Water Quality Certification has not been issued for the impacts observed on site. APre-Construction Notification submitted to DWQ and a Certification was required prior to the above-mentioned impacts pursuant to 15A NCAC 2H .0500. Item V. NCG010000 Conditions Violation- The Division of Land Resources (DLR), Land Quality Section has informed our office that you are in violation of the Sedimentation Pollution Control Act for failure to follow your approved Erosion and Sedimentation Control Plan. Our office would like to remind you that in conjunction with the, Erosion and Sedimentation Control Plan approval issued by DLR, you were issued a General Stormwater Permit (NCG0100000) under the National Pollutant Discharge Elimination System (NPDES) in accordance with Title 15A North Carolina Administrative Code 2H.0100. Adherence to the approved Erosion and Sedimentation Control Plan is an enforceable component of the General Stormwater Permit. Therefore, failure to follow your approved Erosion and Sedimentation Control Plan constitutes a concurrent violation with the Division of Water Quality (DWQ). Removal of Use 1. Please provide documentation (including a detailed site map/survey) depicting all jurisdictional water features (e.g. streams, wetlands, buffers) on the site. This documentation should describe and quantify the impacts to those.jurisdictional features, and should include plans to avoid further stream and wetland impacts on the site. 2. Please submit the following documents for review and approval: a. Stream Restoration. Plan- Please explain how you plan to restore the pattern, profile and dimension of the impacted stream channels to include the removal of riprap. The streambed must be restored to the original profile, the stream banks must be stabilized, and any fill material must be removed from the riparian zone. Replanting of the riparian zone will be required. b. Permit Application - If you wish for any impacts to remain in place, you must contact the U.S. Army Corps of Engineers (USACOE) for information on the type(s) of permit required. Depending on the type of permits USACOE requires, application fora 401 Water Quality Certification to DWQ will also be required. Please note that sediment impacts to streams are not permittable. c. Please indicate in your response a detailed schedule with dates explaining when the restoration will be accomplished, and if you plan to seek a permit for the permittable impacts, when an application will be submitted. 3. It is required that you contact the Division of Land Resources and the U.S. Army Corps of Engineers. These contacts are necessary to ensure that your restoration efforts are in compliance with the Sedimentation Pollution Control Act and Section 404 of the Clean Water Act. III. Wetland Standards Violation and Failure to Secure a 401 WQC 1. Please explain when construction (excavation, grubbing, and clearing) began at the site. 2. Please clearly explain why appropriate '401 Water Quality Certification was not secured. 3. Please provide a map that exactly details the wetlands on the tract, the areas of wetlands that were impacted, and the length and location of ditches. ~ .. , . ~ _ 4. Please submit a Restoration Plan to'this offiice:for review and approval. You are encouraged to secure a consultant to assist you with your plan development; permit; :certification and authorization necessary to achieve compliance. This plan should include the following a.) All ditches located within or adjacent to wetlands must be backfilled, returned to natural grade and stabilized with a thick vegetative cover. Also, any fill placed in wetlands must be removed . Please thoroughly discuss your plans for backfilling all ditches that are in or adjacent to wetlands on the site. Also, please address the measures that will be used for temporary stabilization/ sediment control while this work is under way. Please provide a schedule with dates by which this work will be completed. Note: Fill material not used for bacldilling of ditches must be removed from wetlands, placed on high ground and stabilized. This restoration effort must also be addressed in a manner that is in full compliance with the Division of Land Resources and the US Army Corps of Engineers; b.) Satisfactory wetland restoration requirestttietreplanting.of at least 2 native,hardwood wetland species and the maintenance of a stem density/survivorship of at least 320 trees per acre~at~the end of 5 years. Also, this plan will require an herbaceous wetland seed mix for all wetlands that are disttarbed: c.) NCG010000 Permit Condition Violations As listed above, the NCG010000 stormwater permit requires inspection and record keeping requirements for the project site. Your response should address the following items: 1. Please provide information detailing your compliance with the minimum monitoring and reporting requirements as requested above for each phase of the project... This information must include monitoring records through to the date of your written response to this letter. Specifically, it is requested that DWQ be provided a copy of all rain gauge data and weekly inspection/monitoring reports related to your inspections of the approved sedimentation and erosion control facilities and stormwater outtalls. Copies of all corresponding inspections subsequent to rain events greaterthan 0.5 inches are requested as well. Failure to provide this information will constitute violations of the subject NPDES NCG010000 stormwater permit. 2. .Finally, you should include in your response an explanation of how you propose to prevent these problems from reoccurring on this project and on future projects. Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement to the Director of the Division of Water Quality regarding these issues and any future/continued violations that may be encountered. Your above-mentioned response to this correspondence will be considered in this process. This office requires that the violations, as detailed above, be abated immediately.. These violations and any future violations are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Dear Mr. Hodge, In response to your Notice of Violation dated June 21, 2007, Real Estate Management Services, Inc. would like to reply to questions 1 & 2 in Section III in the notice. It was our understanding that we had done everything we needed to. We had two different consultants (S&EC and Neal Floyd). S& EC had been working on this project since 2003. It appeared that at the rate they were going we would never get this project started. They did forward you a copy of the 404 application. Jason Payne, Tracey Wheeler and Lisa Merritt met on site for wetland line verification. At that time Tracey with the Army Corp explained that mitigation would be necessary for this project. We began working with her on that. In the meantime we were also dealing with Neal Floyd on some other subdivisions within Wayne County. Lisa explained what was going on with Oxford Square. He explained that sewer crossings were exempt when the disturbance was 20'. He even called someone in the Raleigh office while Lisa was with him and they confirmed it. Lisa and Neal inet with Tracey Wheeler on another project and talked to her about resubmitting the application to her and asked her opinion. It was their impression that she agreed with what Neal said. S&EC was let go and Neal and Lisa proceeded. S&EC had calculated the disturbance the whole length instead of just the wetlands and buffer area. Jeffrey Kornegay, REMS engineer for the project, recalculated the areas and gave theirs to Lisa Merritt. She prepared a new 404 permit application. Jeffrey Kornegay and Neal Floyd reviewed the application prior to it being sent. We received our 404 permit on or about November 6r', 2006. When the permit was received Lisa noticed that Tracey had said that it may also require a 401 permit. She called Neal and Jeffrey. She was assured that it was a form letter and that we were fine to start construction. During this time I had been hospitalized and was not available to give any advice. So work began and according to the contractor he began construction on the sewer crossing around the 3'~`~ of December 2006. As this is not an excuse but a fact I was unavailable from October 5, 2006 until mid January. I was battling cancer and my assistant, Lisa Merritt, was watching over the project. She was relying on the assistance of Jeffrey Kornegay, Bobby Kornegay, Neal Floyd and the contractor, Earthworks, to make sure the project ran smoothly. It was her inexperience that she did not question the width of the crossing and did not realize the ramifications of not following the plans. Although, I think she should have received better advice from Jeffrey Kornegay about what was taking place. When the sewer crossing was finished Lisa found a company to seed the area. It looked great. We had one trouble spot on the slope but we were finally getting that resolved. I thought the project was fine until we got the phone call from Amy Yount. I have been in the business for over 26 years and I think I have a good track record. If I had known for sure that I needed a 401 permit I would have gotten one. You can be assured you will be copied on everything that might need a permit from now on. There will be more monitoring on site and I think Lisa now understands how important it is not to just go on someone's word but to be active in the construction. Measure behind the contractors, ask questions because ultimately we are responsible for what they do and read the permit and make sure it is followed. Dear Mr. Hodge, Enclosed is a map showing the area that was disturbed during the sewer crossing. The total are disturbed is 7094 sq. ft. Of that, 3522 sq. ft. was permitted disturbance so the total additional disturbed area is 3572 sq. ft. According to Section I number 1 the amount of trees that would need to be planted is 57. Following is the proposed restoration plan: a. Work will start within two weeks of receiving approval from DWQ & Army Corp of Engineers. b. To approach the project with a minimal damage as possible, we will come down the power line easement and the city sewer easement off of Cox Boulevard. This should avoid any additional damage to the wetlands and riparian buffer. c. No heavy machinery will be sued in the wetlands. A small rubber tracked bobcat will be used. d. The diversion ditch will have all rip-rap removed by hand. It will then be filled to the original grade using the rubber tracked bobcat. e. It will be replanted with a herbaceous wetland seed mix and wheat straw will put down to help from the seeds being eroded away. £ 28 River Birches and 2~ Cherrybark Oak trees will be planted in the south side of the branch. We did not clear the other side of the branch. It was part of the city's sewer easement and was already cleared. g. The rip-rap will be removed from the original creek bed. It will be replanted with herbaceous wetland seed mix and have rosary mat placed on the slopes to help prevent erosion. h. All work should be completed within 30 days, weather permitting, from date started. We will send an email to Kyle Barnes when restoration begins and when it is complete. Also, enclosed are the rain gauge data and weekly inspection/monitoring reports for Oxford Square. All job sites have a job site box at the entrance of the project. All M A permits are posted and a rain gauge is on the back of the 4X4 post. Each site is checked after each rainfall. All erosion control measures are checked and repair is done if needed. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
