On November 29. 2021, we received the Pre -Construction Notification you submitted on behalf of The City of Charlotte
on a property located in Mecklenburg County, North Carolina. I have completed my initial review of the report and I
have determined that it is incomplete. The following information is necessary before I will issue a determination:
a. The PCN lacked additional supporting information to complete understand the project as proposed. The
application only included 1 construction drawing and not all the additional sheets called out on that
construction. In addition, supplemental mapping/figures with aerial maps, delineation maps, etc. would be
beneficial to be able to fully understand and analyze the project. Therefore, please provide this additional
information.
b. Provide the following information for the applicant (i.e., The City of Charlotte)
- Point of contact (first and last name)
- Mailing address
- Telephone number
- Email address
c. The PCN lacked a signed Agent Authorization Form from the applicant (i.e., The City of Charlotte). Therefore,
please provide a signed Agent Authorization Form the point of contact listed above in "b".
d. The PCN states the purpose of the proposed project is to link to and extend the existing Torrence Creek
greenway. The original section of the Torrence Creek Greenway had 180 linear feet (0.03 acres) of stream
impacts and 0.064 acres of wetland impacts. These new permanent stream impacts of 38 linear feet (0.007

acres) will be considered cumulative with the previously permitted impacts. Therefore, compensatory
mitigation will be required for the 38 linear feet of stream impacts.
e. Please provide a signed Compensatory Mitigation Reservation Letter from NCDMS for the 38 linear feet of
permanent stream impacts.
f. Complete the Aquatic Resources Upload Spreadsheet for all aquatic resources located within the proposed
project area.
Please provide the information requested above in ONE consolidated response within 30-days of the date of this
correspondence. If you do not respond within 30-days, the request will be administratively canceled. Please contact me
via telephone or e-mail if you have any questions.

STORMWATER MANAGEMENT NARRATIVE
EXISTING CONDITIONS
The project site is located over six (6) parcels zoned as Neighborhood Residential (NR). The project
begins across from the entrance/exit to the existing Torrence Creek Greenway, continues
north/northeast through undeveloped parcels, crosses underneath Interstate 77 via an existing tunnel,
and terminates at an existing park -and -ride station located off Huntersville Gateway Boulevard in
Huntersville, North Carolina. The project site is located within the McDowell watershed protection
district and is currently classified as low density.
PROPOSED DEVELOPMENT
The proposed site development will consist of the addition of a five greenway segments for a total of
approximately 6,160 LF of asphalt and boardwalk greenway trail, which will persevere the low -density
classification of the project site with a total built upon area percentage of 1.2%. The disturbed area for
the project is approximately 3.30 acres. A combination of boardwalk, ditches, culverts, super elevated
trails were used to convey stormwater to the adjacent tributary or wetlands.
STORMWATER MANAGEMENT AND HYDROLOGIC CALCULATIONS
Hydrologic conditions were modeled using the Rational Method for a 10-year rainfall event. Hydraulic
modeling for evaluating the proposed storm crossings was performed using Hydraflow Express
Extension for Autodesk Civil 3D. Catchment areas were determined using a combination of field survey
provided by Dewberry and Mecklenburg County GIS data. Vegetative Conveyance is used along the
asphalt trail where super elevation of the trail cannot adequately convey water. See Section 3:
Stormwater Calculations for more information.
CONCLUSION
In conclusion, the stormwater improvements for the low -density project site appears to have adequate
capacity to convey the 10-year storm event through vegetative conveyance and culverts. See the
enclosed calculation package for more detailed information.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.
