I just spoke with Cort and he just spoke with the customer for this job, as we have done our best on getting everything to you guys that you need in order to get this approved the customer has decided to back out of doing the project at this time. In that case, I have attached the receipt from the payment we made when we submitted the application and we need to have this amount refunded. The amount was for $246.36. The email yesterday had the application attached with it, can you confirm that this is the correct application you are needing? Also, since we already submitted it, do we have to resubmit it again? Yes, this is concerning the Watson shoreline stabilization application. Your application is incomplete. Please answer my questions from the email that I sent on 12/7 and respond via email directly to me. Also, for the turbidity standard, we're not sure how to do this. We will not be in the water at all during this project as we are trying to complete it while the water is down. Please describe how you will perform the project so that turbidity standards will not be violated. If you are working while the lake is drawn down, you can state that in your response. This is known as working in the dry. On October 31, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project, with the required fee received on November 4, 2021, and additional information received on December7, 2021. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Page 5 of the DWR Shoreline Stabilization application carries the signature of Arron Cort Carringer. In order for Arron Cort Carringer to sign, the application package requires an agent authorization letter from the applicant that is signed by the landowner. A sample agent authorization letter can be found on the USACE website (http://www.saw.usace.army.mil/Portals/59/docs/regulatory/regdocs/Permits/SAMPLE AGENT AUTHORIZATIO N FORM.pdf). [15A NCAC 02H .0502(a)(11)] Both the agent (you) and the landowner need to sign this form. 2. Please provide a site plan showing the proposed shoreline stabilization area as an overlay including jurisdictional features. Please cleanly draw or delineate the site boundaries on the map. [15A NCAC 02H .0502 (a)(9) You can use a survey drawing or Macon County GIS parcel data to show the location where you plan to place rip rap on the shoreline. 3. Please specify the size of material proposed for shoreline stabilization. Per Condition II. 20 of GC 4145 (attached), rip -rap used for shoreline stabilization must be of a size and density to prevent movement by wave action. [15A NCAC 02H 0506(b)(2)] 4. Lake Nantahala is classified as B; Trout waters. NC Water Quality Standards specify that the turbidity shall not exceed 10 Nephelometric Turbidity Units (NTU) in streams, lakes, or reservoirs classified as Trout waters. Please discuss how your project will meet the turbidity standard. [15A NCAC 02B .0211 (21)] Please state whether you will be working in the dry when the lake water is drawn down. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by January 4, 2022. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
