Based on the project description, the following Nationwide Permits (NWPs) won't fit: NWP 3 (Maintenance): This NWP does not authorize...stream relocation projects. NWP 18 (Minor discharges): This NWP does not authorize discharges placed for the purpose of a stream diversion. NWP 45 (Repair of Uplands Damaged by Discrete Events): Can only be used to restore uplands when eroded/destroyed by discrete storm events (not long term erosion over time), and the permittee must submit a PCN within 12 months of the date of the discrete damage to the structure. NWP 58 (Utility Line Activities for Water and Other Substances): For the construction, maintenance, or repair of utility lines, there must be no change in pre -construction contours of waters of the United States. NWP 13 may be the only NWP that could fit. A PCN would be required due to the fact that the project would involve discharges into a special aquatic site (riffle -pool complex). Since this permit is typically used to stabilize stream banks in place, care would be needed to justify that the proposed action minimizes impacts to waters to the maximum extent practicable. Depending on the design (e.g. natural channel design principles used?), the Corps may consider requiring compensatory mitigation depending on the loss of channel length, quality of the existing stream channel proposed to be re -aligned, etc. Hopefully this helps as planning proceeds. -Dave Bailey David E. Hi Dave & Sue, Hope you are doing well. We wanted to reach out and ask about a future project for the City of Greensboro. There is a culvert (under Devonshire Drive) that discharges into a stream flowing towards a detention pond (see attached map). There is a sewer manhole immediately next to the stream and one aerial sewer crossing that the City wants to protect from the migration and incision of the stream. For the design, we are planning to realigning the channel to avoid the manhole and installing grade control (i.e., boulder vanes) to protect the sewer crossing. The stream is about 427 ft from the culvert to the pond. Since the NWPs changed recently, could you tell us where this project would fall? Would buffer impacts be required? ARCADIS Would it trigger a PCN review? Thanks!
