PROJECT SUMMARY: Applicant is 200ft of bulkhead, 264' of retaining wall, 1,838ft2 of wetland fill for a driveway access, gravel parking area, 6' x 200' pier landward of proposed bulkhead, 2 —13' x 13' boatlifts, upland fill and grading, maintenance excavation within Battalina Creek and man-made canal. Michael and Mary Sargent 598 East Street Development — Maintenance Excavation, Wetland Fill, Upland and Boating Facility Beaufort County Project Setting The subject property is located at 598 East Street Creek in Belhaven, Beaufort County adjacent to Battalina Creek and a man-made canal. Current development on the lot includes a residence, driveway, 2 man-made basins one of which has side -to docking and a large wet -slip. The proposed development focuses on development around the larger man-made basin on the northern side of the property and the upland spoil areas on either side of the basin. Water depths in the center of the man-made basin average -9ft @NWL and connecting water depths in Battalina Creek are -6ft @NWL(permitted channel). The majority of the property is dominated by wetlands both coastal and non -coastal wetlands. Battalina Creek in the project location is designated is classified as SC, HQW, NSW by the Environmental Resources Commission. The uplands spoil area adjacent to the Iarge man- made basin on the northern side of the property is no subject to the 50ft DWR Buffer per correspondence with the DWR. Battalina Creek in this area is classified as Estuarine Waters, a Primary Nursery Area by the Division of Marine Fisheries, is closed to the harvest of shellfish, and no SAV has been observed in the area during sight visits during the April -September growing season. Proiect Description Wetland Fill The applicant is proposing to gain vehicle access to the upland spoil bank by filling an area of 404-wetlands approximately 35' wide by approximately 52' long impacting a total area of 1,838ft2 of 404-wetlands most of which is phragmites within the CAMA AEC. The need for the wider than average driveway is to facilitate access to the spoil area for vehicles maneuvering with boat trailers and making the turn from the existing driveway. The road will have a top width of 18' and fill slopes between 2:1 and 3:1. Silt fence will be in place until the fill material is stabilized. An 18" corrugated metal equalizer pipe will be placed under the filled access to allow for hydraulic connectivity. Bulkhead, Retaining Wall, and dockage Along the eastern shoreline of the man-made canal 200 linear feet of bulkhead is proposed starting at the wetland/upland interface at the head of the canal. A 6ft x 200ft dock is proposed to run parallel and landward of the proposed bulkhead. Two 10,0001b boat lifts for boats up to 25ft are proposed along the bulkhead. A retaining wall will extend approximately 114 linear feet along the wetland/upland interface to encapsulate the gravel parking area located Iandward of the 30ft CAMA buffer. The finished bulkhead and retaining wall will be elevated 4' above the existing ground in order to level the developed area of the spoil bank. The retaining wail will pick back up on the eastern side of the parking area and extend 150 linear feet along the coastal wetland line matching the other proposed retaining wall and bulkhead in elevation. Excavation Excavation is proposed in two locations; along the proposed bulkhead and within the channel leaving the man-made basin. The section within the basin along the proposed bulkhead will be 200ft x 10ft to a final depth of -5ft @NWL to facilitate operation of the boatlifts and side -to docking along the bulkhead. The canal depths average --9ft @NWL but there is a shoaled area near the mouth where depths drop to as low as -3ft @NWL. Maintenance excavation of an area 40ft wide x 120ft long x -1.5ft avg. to a depth of -5ft @NWL is proposed to provide suffice depth for navigation into the canal. This channel will tie into an existing channel permitted under active CAMA Major Permit 4118-15 which has a permitted final depth of -6ft @NWL. The excavation will be completed using bucket to barge methodology and offloaded on an adjacent property directly into dump trucks and hauled to a nearby upland stockpile area. Anticipated Impacts The project as proposed will result in the excavation of approximately 415 cubic yards of material from approximately 6,000ft2 of shallow bottom, shading of 338ft2 of shallow bottom, 404-wetland fill totaling 1,838ft2, and clearing and grading of approximately 9,000ft2 of uplands (spoil bank) within the CAMA 75' AEC. Noise and increased turbidity with the adjacent waterway are expected to occur during the maintenance excavation, bulkhead, and boatlift installation. The primary purpose of the proposed development on their property center around the existing man-made canal and improving boat and vehicular access. These development activities include construction of a driveway access across 404 wetlands to an upland area adjacent the canal, bulkhead, boatlift and dock construction and maintenance excavation within the man-made canal. Since purchasing the property in January of 2021, there have been two onsite meetings with state and federal regulatory agencies that include the NC Division of Coastal Management (DCM) NC Division of Water Resources (DWR) and US Army Corps of Engineers (USACOE) to disseminate respective overlapping regulatory jurisdictions and their associated permit requirements. The last onsite meeting was August 26, 2021. Present at this meeting was Mrs. Mary Sargent, property owner, Mr. Raleigh Bland, Project Manager USACOE, Mr. Steve Trowell, consultant on behalf of Sargent Properties and yourself. During this meeting the wetland delineation and type was confirmed by DCM and USACOE. The wetland area adjacent the canal and driveway was not delineated by DCM as a Coastal Wetland due to the absence of Coastal Wetland species. This area was vegetated by a dense stand of Phragmities likely as a result of impacts from the development of the canal and resultant spoil deposition and the driveway construction. There are also remnants of a ditch that traverses the area to be impacted by driveway fill. Prior to the meeting and confirmed by discussion with the respective agencies, the Tar -Pamlico River Basin Buffer per North Carolina Administrative Code (NCAC) 15A NCAC 02B.0734(3)(a)(I) and (ii) does not apply to the manmade canal and adjacent lands. Documentation of this decision by DWR Mr. Chris Pullinger is subject of an enclosed email dated June 21, 2021 from Mr. Pullinger. Therefore, buffer requirements fall back to DCM buffer standards found in 15A NCAC 7H.0209. At the conclusion of the meeting, it was determined that the project would seek authorization through a joint state and federal permit process administrated by DCM. The Town of Belhaven has a zoning program administered by the Town Manager, Mrs, Lynn Davis. The subject tract is zoned as Residential Agriculture. The proposed development has been found consistent with the Town zoning as documented in an email from Davis dated September 17, 2021 and since this is not a commercial project but for private residential then a certificate of zoning compliance is not required per Mrs. Davis's email dated November 1, 2021.. This proposed maintenance excavation will be accomplished using an excavator on a barge with a spoil containment system owned by an adjacent property owner. The material will be offload on an adjacent property directly into dump trucks and hauled to a nearby upland stockpile area.
