On December 1, 2021, the Division of Water Resources (Division) received your application
requesting a 401 Water Quality Certification from the Division for the subject project. The Division
has determined that your application is incomplete and cannot be processed. The application is on
hold until the following items are addressed:
1. Condition II.9 of General Water Quality Certification 4132 (GC 4132) states:

“All work in or adjacent to streams shall be conducted so that the flowing stream does not
come in contact with the disturbed area. Approved best management practices from the
most current version of the NC Sediment and Erosion Control Manual, or the NC DOT
Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams,
and other diversion structures shall be used to minimize excavation in flowing water.
Exceptions to this condition require application to and written approval from DWR.”
Section 3. Project Description, 3d. of the submitted PCN states: “The work will be performed
in the dry using silt curtains to isolate the work area and control turbidity.”
Section 4. Open Water Impacts, 4g. of the submitted PCN states: “At the contractor’s option,
the work may be accomplished in the dry by installing a temporary coffer dam around the
proposed work area” with the use of three rows of turbidity curtains. It is also stated that
“where the work is performed in the wet silt curtains shall be used to isolate the work area
and control turbidity.”
While silt curtains may reduce turbidity during project activities, their use alone does not
satisfy Condition II.9 of GC 4132. Furthermore, the use of silt curtains per Sheet C-5 of the
application may not be practicable at this location.
Please indicate how the proposed work shall be conducted so that the flowing stream does
not come into contact with the disturbed area. The proposed coffer dam is one option.
Another option may include the use of armor stone associated with the proposed scour
apron to create a temporary diversion around the work area. [15A NCAC 02H .0506(b)(1)]

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received, the Division will be unable to approve the application and it will be returned.
