This facility is a minor facility (flow < 1 MGD) discharging 100% domestic wastewater with a design
capacity of 0.10 MGD. This WWTP utilizes the following treatment components:
• Influent lift station
• Bar screen
• Equalization basin

• Tertiary filter
• Ultraviolet disinfection
• Back-up chlorine contact chamber with tablet -type chlorination and dechlorination

Notice of Intent to Issue a NPDES Wastewater Permit NC0065749 Ashe Planta-
tion WWTP The North Carolina Environmental Management Commission propos-
es to issue a NPDES wastewater discharge permit to the person(s) listed below.
Written comments regarding the proposed permit will be accepted until 30 days
after the publish date of this notice. The Director of the NC Division of Water Re-
sources (DWR) may hold a public hearing should there be a significant degree
of public interest. Please mail comments and/or information requests to DWR at
the above address. Interested persons may visit the DWR at 512 N. Salisbury
Street, Raleigh, NC 27604 to review information on file. Additional information on
NPDES permits and this notice may be found on our website: http://deq.nc.gov/

(5100 Brookshire Blvd., Charlotte, NC 28216) has requested renewal of NPDES
permit NC0065749 for the Ashe Plantation WWTP in Mecklenburg County. This
permitted facility discharges treated wastewater to Duck Creek within the Yadkin
- Pee Dee River Basin. BOD, Ammonia Nitrogen, fecal coliform, and total residual
chlorine are water -quality limited. This discharge may affect future wasteload
allocations in this portion of the Yadkin- Pee Dee River Basin.

Thank you for your consideration of our request. Ashe Plantation has an exemplary performance
record and CLTWater still intends to meet our requirement of staffing this facility five days a week. I
had previously discussed the change of the measurement frequency for temperature with Wes Bell
(NCDWR -Mooresville Regional Office) and he was not opposed to changing this frequency to
weekly. I have copied him on this email. If you need any further information concerning this

As you can see, Water Quality limited permits have a requirement for Daily temperature monitoring.
However, the Director has discretion to reduce Temperature monitoring to Weekly if sufficient cause
is given. If the facility has an exemplary performance record, or if the Regional Office inspectors
believe that a reduction to Weekly monitoring will not adversely impact proper O&M of the WWTP,
the permit may be changed to weekly monitoring for Temperature.

I've received a comment from Charlotte Water regarding draft NPDES permit NC0065749 - Ashe
Plantation WWTP. The permittee was requesting to change the temperature monitoring frequency
from daily to weekly to align with the measuring frequency of other parameters. The facility has
good compliance history during the last permit cycle, and the permittee said that they had discussed
the change with Wes before and he was not opposed to it. I just want to check with you and Wes
again to see what your recommendations are. I've also included the draft permit, updated fact sheet
and compliance history for your reference.

Application Overview
Please find the enclosed NPDES permit renewal application for Ashe Plantation WWTP. Below are a few
key points regarding the information that is included in the package:
1. Section #8 in the application is addressed with Attachment #1 (Outfall Map).
2. Section #10 (description of the treatment system) is addressed with Attachment #2.
3. The table in Section #13 is based on data collected from 01/01/19 — 08/31/20.
Modification Requests
In addition to the submission of the standard application materials, CLTWater is also respectfully
requesting that the Division of Water Resources (DWR) make two modifications to this permit upon
renewal:
1. Reduce the Measurement Frequency for effluent temperature from Daily to Weekly. We are not
aware of any reason that this parameter needs to be monitored this frequently. During a recent
inspection and discussion with DWR regional staff, there was speculation that this frequency was
simply a relic from past iterations of this permit. Adjusting this frequency to Weekly would also
bring this permit in line with the Oxford Glen permit, which is similar in terms of plant effluent and
receiving stream characteristics.
2. Modify the permit language specifying where the Upstream sample is to be collected. Currently
the permit says `Upstream = approximately 50 feet above the discharge point.",however due to a
steep embankment that is a safety issue for our laboratory staff, CLTWater requests that this
language be modified to allow for upstream sampling "...approximately 15 feet above the
discharge point." This issue was also discussed with DWR regional staff during our inspection
and the relocation of our upstream monitoring location to `approximately 15 feet above the
discharge point" this was their recommendation.

Attachment #2 - Treatment System Description
Ashe Plantation is a steel package plant that was approved for construction by the State of NC in February
1987 and constructed shortly thereafter. Although the influent lift station is below grade, the entire
treatment processes is above ground. Since CLTWater purchased the plant in 2016, several significant
improvements have been made at this facility. Thermal insulation blankets have been installed along the
treatment train walls in order mitigate low winter temperatures. Other major improvements are designated
with an asterisk (*) below in the equipment list.

located within subbasin 03-07-12 [HUC: 0304010507] of the Yadkin -Pee Dee
River Basin.

if these values fall below 50 µg/L.
5. Total Residual Chlorine monitoring and effluent limit effective only if chlorine compounds
are used for disinfection.
6. pH shall not fall below 6.0 nor exceed 9.0 standard units.
THERE SHALL BE NO DISCHARGE OF FLOATING SOLIDS OR VISIBLE FOAM IN OTHER
THAN TRACE AMOUNTS
A. (2) PERMIT REOPENER CONDITION: AMMONIA TOXICITY & NUTRIENTS
[NCGS 143-215.1 (b)]
This permit may be reopened to impose further controls, pH adjustment. or restrictions
upon the discharge of ammonia to the receiving stream. Endangered species in the
Goose Creek watershed exhibit a high degree of sensitivity to ammonia. Permit
modification may be required in order to ensure viable aquatic habitat with regard to
instream ammonia concentrations.
Studies conducted within the Goose Creek watershed demonstrate episodic events of
elevated concentrations of nutrients (nitrogen and phosphorous). High concentrations
of nutrients have the potential to create conditions detrimental to overall water quality
and the health of aquatic life. Permit modification may be required to include
monitoring that will help ascertain the impact of the discharge with respect to instream
concentrations of nutrients and to require controls on effluent nutrient concentrations
should the discharge be found to be a significant contributor to elevated nutrient levels
within the receiving stream.
A. (3) ELECTRONIC REPORTING OF MONITORING REPORTS
[NCGS 143-215.1 (b)]
Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted
and became effective on December 21, 2015.
NOTE: This special condition supplements or supersedes the following sections within
Part II of this permit (Standard Conditions for NPDES Permits):
• Section B. (11.) Signatory Requirements
• Section D. (2.) Reporting
• Section D. (6.) Records Retention
• Section E. (5.) Monitoring Reports
1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)1
The permittee shall report discharge monitoring data electronically using the NC
DWR's Electronic Discharge Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for
each month and submitted electronically using eDMR. The eDMR system allows
permitted facilities to enter monitoring data and submit DMRs electronically using

the internet. Until such time that the state's eDMR application is compliant with
EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be
required to submit all discharge monitoring data to the state electronically using
eDMR and will be required to complete the eDMR submission by printing, signing,
and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or
due to the facility being physically located in an area where less than 10 percent of
the households have broadband access, then a temporary waiver from the NPDES
electronic reporting requirements may be granted and discharge monitoring data
may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms
approved by the Director. Duplicate signed copies shall be submitted to the mailing
address above. See "How to Request a Waiver from Electronic Reporting" section
below.
Regardless of the submission method, the first DMR is due on the last day of the
month following the issuance of the permit or in the case of a new facility, on the last
day of the month following the commencement of discharge.
Starting on December 21, 2020, the permittee must electronically report the
following compliance monitoring data and reports, when applicable:
• Sewer Overflow/Bypass Event Reports;
• Pretreatment Program Annual Reports; and
• Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to
Request a Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1) (9), the permittee must identify the initial
recipient at the time of each electronic submission. The permittee should use the
EPA's website resources to identify the initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities
means the entity (EPA or the state authorized by EPA to implement the NPDES
program) that is the designated entity for receiving electronic NPDES data [see 40
CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic
reporting tool for each type of electronic submission and for each state. Instructions
on how to access and use the appropriate electronic reporting tool will be available as

well. Information on EPA's NPDES Electronic Reporting Rule is found at:

Electronic submissions must start by the dates listed in the "Reporting
Requirements" section above.
3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division.
To obtain an electronic reporting waiver, a permittee must first submit an electronic
reporting waiver request to the Division. Requests for temporary electronic reporting
waivers must be submitted in writing to the Division for written approval at least
sixty (60) days prior to the date the facility would be required under this permit to
begin submitting monitoring data and reports. The duration of a temporary waiver
shall not exceed 5 years and shall thereupon expire. At such time, monitoring data
and reports shall be submitted electronically to the Division unless the permittee re-
applies for and is granted a new temporary electronic reporting waiver by the
Division. Approved electronic reporting waivers are not transferrable. Only
permittees with an approved reporting waiver request may submit monitoring data
and reports on paper to the Division for the period that the approved reporting waiver
request is effective.

4. Signatory Requirements [Supplements Section B. (11.) (b) and Supersedes
Section B. (11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person
described in Part II, Section B. (11.)(a) or by a duly authorized representative of that
person as described in Part II, Section B. (11.)(b). A person, and not a position, must
be delegated signatory authority for eDMR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an
eDMR user account and login credentials to access the eDMR system. For more
information on North Carolina's eDMR system, registering for eDMR and obtaining
an eDMR user account, please visit the following web page:

Certification. Any person submitting an electronic DMR using the state's eDMR
system shall make the following certification [40 CFR 122.22]. NO OTHER
STATEMENTS OF CERTIFICATION WILL BE ACCEPTED:
"7 certify, under penalty of law, that this document and all attachments were prepared
under my direction or supervision in accordance with a system designed to assure that

qualified personnel properly gather and evaluate the information submitted. Based on
my inquiry of the person or persons who manage the system, or those persons directly
responsible for gathering the information, the information submitted is, to the best of my
knowledge and belief, true, accurate, and complete. I am aware that there are
significant penalties for submitting false information, including the possibility of fines
and imprisonment for knowing violations."
5. Records Retention [Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including
eDMR submissions. These records or copies shall be maintained for a period of at
least 3 years from the date of the report. This period may be extended by request of
the Director at any time [40 CFR 122.41].
