Upon review of the information attached, the proposed activities do not require a 401 or buffer permit.
The project does not occur in a buffered stream basin, and no impacts are proposed to streams or wetlands on-site.

Hi Jerry. After review of the plans sent in the email, it appears that the project will not result in any temporary or
permanent discharges of dredged or fill material in waters of the US. As such, the project does not require a permit from
the Corps of Engineers. If you feel that there may be impacts to waters of the US or have any questions, please let me

Dave and Ryan,
have attached roadway plans, maps, documents and surveys for a proposed
bridge replacement. The projects is Bridge #80 on Estes Rd in Rockingham County.
The WBS # is 17BP.7.R.123. Please note that NCDOT is attempting to utilize the
Nationwide 3 for construction of this project. The stream is not buffered and
consultation with USFWS has resulted in a concurrence of "May Affect, Not Likely
To Adversely Affect" for any potential endangered species (see attached
documents). Archaeological and architectural reports are also attached. All
conditions of the Nationwide 3 will be adhered to and impacts will not exceed
those established within the Nationwide 3 guidelines. An offsite detour will be
utilized. Construction is proposed to be bridge to bridge and high ground to high
ground with no proposed work within the stream. NCDOT is requesting an
acknowledgement that the Nationwide 3 is applicable for this project. Thank you
