Colleen, We have coordinated with NCDOT to minimize the roadway impacts for Terry Road crossing. The present gravel roadway is 14', with 6' graded shoulders and then a utility corridor on both sides which comprises the 50' width. For the proposed improvements, the typical section was modified to reduce the graded shoulders from 6' to 4', utilize 2:1 sideslopes, and eliminate the sidewalk from the west side of the roadway section. This reduction allows us to reduce the stream impacts, wetland impacts and the buffer impacts. Please advise if these changes are acceptable to you. With this reduction to the buffer impacts to 704 SF for zone 1, 406 SF for zone 2, would the state still require mitigation for the impacts? For Exhibit 1, the majority of the wetland impacts is due to the extension of Genesee Road to connect into the proposed roadway from Terry Road. The minimum roadway centerline is 150' which is what is proposed. Pedestrian walkability throughout the subdivision was required by the Durham Planning, which is the reason for the sidewalk on both sides of the ditch section. For the pond, we minimized the footprint as much as possible. If we try to lower the pond elevation, there is not enough vertical relief to outlet it without redoing the drainage system on Genesee Road. If you have another alternative in mind please let me know and we can evaluate it further. Your application states that the road is currently 50 feet wide. Your new impact maps show 20 feet of road, plus 12 feet of grass, plus 10 feet of sidewalk, plus 1 foot shoulders on each side (2 feet) for a total of 44 feet wide, which should fit within the footprint of the existing use. I'm not seeing that on the map. Your map has the sidewalk on the eastern side of the road inside the buffer impacts but outside of the buffer impacts (within the existing use) on the western side. Your maps also indicate additional impacts outside of the 50 foot wide existing road. Does the current road have graded shoulders? What does the current cross section look like versus the proposed? Is it required to have a sidewalk on both sides of the street? The grading appears to be due to the road crossing itself, not the sidewalk. Please provide more details explain how these impacts are occurring solely from the sidewalk(s). Colleen, When talking with April about this wetland impact, we mentioned that the location of the pond was selected to minimize the impact to the wetlands given the topography constraints. The roadway connection to the south was required by Durham County for public safety purposes which locked in that location. The wetland delineation showed a narrow band that we felt was the best location to construct a stormwater device that has minimal impacts and would allow to provide for hydrologic connectivity to the wetlands. The total wetland impact at this location was 3,237 SF or 0.07 acres. For exhibit 3, we don't understand why buffer mitigation is required. We are placing the culvert in the exact location that has existed for over 20 years (if not longer). For us to modify the crossing to perpendicular would require additional stream impacts to move the stream channel to a perpendicular location. We feel that there are less environmental impacts to this location than it is to relocate the stream. We are also using baffles in the pipe to maintain the natural stream channel as best we can. If you feel we still need buffer mitigation, please let us know. I needed to check on a couple of things before I got back to you. We have concurrently addressing your review comments and April's comments. Regarding your comment, Exhibit 3 is showing the existing roadway culvert being replaced. The roadway was built prior to any buffer rules being in effect. The existing pipe angle skew is 50 degrees. To make the culvert crossing more perpendicular, we would have to relocate the stream. We didn't think that was a very good solution so we decided to keep the pipe at its present angle. Reviewing your comment, we are showing the wetland impacts but failed to realize that the buffer still exists even with this impact. The attached exhibit shows the revision. You mentioned about the crossing of streams being allowable with mitigation. Is mitigation required in this instance? On exhibit 5, since the roadway existed prior to the buffer rules, the zone 2 buffer stops where the maintenance ends for the existing roadway. We have determined that to be approximately 30' from the centerline at this location. Does this address your questions?
