Thanks for the email. I needed to check on a couple of things before I got back to you. We have concurrently addressing
your review comments and April's comments.
Regarding your comment, Exhibit 3 is showing the existing roadway culvert being replaced. The roadway was built prior
to any buffer rules being in effect. The existing pipe angle skew is 50 degrees. To make the culvert crossing more
perpendicular, we would have to relocate the stream. We didn't think that was a very good solution so we decided to
keep the pipe at its present angle. Reviewing your comment, we are showing the wetland impacts but failed to realize
that the buffer still exists even with this impact. The attached exhibit shows the revision. You mentioned about the
crossing of streams being allowable with mitigation. Is mitigation required in this instance?
On exhibit 5, since the roadway existed prior to the buffer rules, the zone 2 buffer stops where the maintenance ends
for the existing roadway. We have determined that to be approximately 30' from the centerline at this location.

I am reviewing the application for the above reference project, and in order to complete the review process, some
additional information is required:
1. Please provide the Division a copy of your response to the August 30, 2021 email from the U.S. Army Corps of
Engineers requesting additional information. [15A NCAC 02H .0502(c)]
2. The road crossing in Exhibit 3 does not appear to be a perpendicular crossing (between 75 and 105 degrees),
and it is unclear from the plans if there are any buffer impacts at this crossing. Road impacts other than
perpendicular crossings of streams are allowable with mitigation upon authorization. Please provide more detail
about the angle of this crossing and buffer impacts. [15A NCAC 02B .0714(11)]
3. I am having difficulty seeing where Zone 2 of the riparian buffer is located in relation to the proposed
impervious roadway in Exhibit 5. Please provide an updated plan with the edges of Zone 2 and the proposed
roadway clearly defined. [15A NCAC 02B .0611(b)(1)(F)]
