Dear Mr. Trivedi:
The Division has recently reviewed the files associated with your permit and has determined
that it is appropriate to modify the permit to include an expiration date.
This permit modification shall be effective from the date of issuance and the expiration date
of the permit shall be October 31, 1991. This permit modification shall not alter or modify any
additional terms or conditions contained in the current permit.
If this requirement is unacceptable to you, you have the right to request an adjudicatory
hearing upon written request within 60 days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes,
and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604.
Unless such demands are made this permit shall be final and binding.

Wastewater Treatment System

In accordance with your application received June 30, 1986, we are forwarding
herewith Permit No.4041-R2, dated August 6, 1986, to Carolina Apple Processors, Inc.
for -the continued operation of tine subject wastewater -treatment facilities.
This permit shall be effective from the date of issuance until rescinded, and
shall supercede the renewal of Permit No. 4041 issued April 24, 1981, and shall be
subject to the conditions and limitations as specified therein. Please take notice of
Condition 19 which requires the installation of three groundwater monitoring wells
within ninety (90) days of issuance of this permit.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150E of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh North Carolina 27604.
If you wish to have the hearing before the Hearing Officer with this
Department, you must indicate in the petition that you waive the right to have the
contested case conducted by a Hearing Officer in the office of Administrative
Hearings, and wish to have the matter conducted in the Department of Natural Resources
and Community Development. Unless such demands are made this permit shall be final
and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General
Statutes of North Carolina as amended, and other applicable Laws, Regulations
PERMISSION IS HEREBY GRANTED TO
Carolina Apple Processors, Inc.

FOR THE
continued operation of a 20,000 GPD non -discharge industrial wastewater treatment
facility consisting of a 0.5 MG capacity aerated lagoon with two (2) 15 hp floating
:mochanical aerators,- a' clarifier, a . sludge holding --tank from -which sludge -will be
applied to approved nearby farmland, and spray irrigation facilities to apply
wastewater to approximately 7.05 acres of land,
pursuant to the application received June 30, 1986, and in conformity with the
project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded,
shall supercede the renewal of Permit No. 4041 issued April 24, 1981, and shall be
subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application received and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. The facilities shall be effectively maintained and operated at all
times so that there is no discharge to the surface waters, nor any contamination
of ground waters which will render them unsatisfactory for normal use. In event
the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, or failure of the irrigation area to adequately absorb the
wastewater, the Permittee, shall take such immediate corrective action as may be
required by the Division of Environmental Management.

5. In event the irrigation system ceases to function due to mechanical or other
problems,or in the event unsuitable weather conditions prevent the operation of
the spray irrigation system, the Company shall discontinue plant operations until
the system can be restored to proper operation.
6. Irrigation shall not be performed during inclement weather or when the ground is
in a condition that will cause runoff.

responsibility for damages to surface or ground waters resulting from the
operation of this facility.
11. No type of sludge other than that from Carolina Apple Processors, Inc. shall be
placed on the land application disposal site.

be sprayed onto the irrigation area.
13. Sludge shall not be applied in inclement weather or until 24 hours
rainfall event of 1 1/2-inch or greater in 24 hours.

property line and any applied sludge.

16. The Permittee shall employ a certified wastewater treatment plant operator
in responsible charge of the wastewater treatment facilities. Such operator must
hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
17. This permit shall become voidable unless the agreements between Carolina Apple
Processors, Inc. and the owners of the sludge application sites are in full force
and effect.
18. No land application of sludge or wastewater shall be undertaken when the season
high water table is less than three (3) feet below land surface.
19. Monitoring facilities shall be constructed and a groundwater monitoring program
shall be established as required by the Division of Environmental Management.
a. Within ninety (90) days of permit issuance, three monitoring wells, one
upgradient and two downgradient (one down gradient from the holding lagoon

one downgradient from the spray field), shall be installed to monitor
groundwater quality. The location and construction details for these wells
shall be by approval of the Division's Asheville Regional Office, from
which a well construction permit must be obtained.
b. The monitoring wells shall be sampled initially after construction and
thereafter every March, July, and November for the following parameters:
NO3 pH
Total Coliforms Total Organic Carbon
Total Dissolved Solids Chloride
Water LEVELS SO4
The measurement of water levels shall be made prior to sampling for the
remaining parameters.
c. Any additional groundwater monitoring, as deemed necessary by the Division,
shall be provided.
