Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville,NC 28801-2714 Subject: After-the-Fact Nationwide 3 Permit Application Narrative and Natural Resources Report Update DF17614.2044019 (formerly B-5900 and BP14.R004) Replacement of Bridge#430382 on SR 1835 Haywood County,North Carolina Dear Mrs. Amschler: The North Carolina Department of Transportation (NCDOT) Division 14 is replacing bridge #430382 on SR 1835 over Dutch Cove Creek in Haywood County(see map). This bridge was completely washed-out by Tropical Storm Fred on August 17, 2021 and is now being replaced quickly because it serves as the sole vehicle access to many residents of the community. The replacement will be a new bridge situated on approximately the same footprint of the old bridge. A written Nationwide 3 verification is hereby requested for the proposed unavoidable impacts of the replacement in part due to a"may affect not likely to adversely affect" determination for clearing of some potentially suitable bat roost trees. This project will be funded by the Federal Emergency Management Agency as part of a Federally Declared Emergency. Section 7 NCDOT coordinated with you and staffs with the United States Fish and Wildlife Service (USFWS)regarding Tropical Storm Fred related Section 7 and 404 permitting procedures on August 22 and 25, 2021 and in a field meeting on September 7, 2021. Also, in accordance with recent direction from the USFWS, the project was screened using IPAC to determine the potentially affected listed species. According to the screening conducted on October 1, 2021 the only federally listed species with the potential to be in or near the project area include Appalachian elktoe (Alasmidonta raveneliana), rock gnome lichen(Gymnoderma lineare), small whored pogonia(Isotria medeoloides), gray bat(Myotis grisescens), Indiana bat(Myotis sodalist), and northern long-eared bat(Myotis septentrionalis,NLEB). Section 7 Concurrence Division 14 Office Telephone: (828)631-114 253 Webster Road,Sylva,North Carolina 28779 430382 Page 2 December 9, 2021 Haywood County was received for the project on July 30, 2019 in association with initial planning for the planned replacement of this bridge (B-5900 federally funded). Due to the anticipated clearing of approximately 25 trees, including some trees that are potentially suitable as roosts, a"may affect but not likely to adversely affect" determination is applicable for Indiana bat. Appalachian elktoe are found in some well-oxygenated, cool-water rivers with moderate to fast flowing water and stable, mixed substrates of silt, sand, gravel, and/or cobble. This species is present Haywood County in the Pigeon River watershed. However, Dutch Cove Creek is too small to support mussels and the stream substrate is not suitable for mussels due to a heavy silt load. Dutch Cove Creek flows into Hominy Creek which also is heavily impacted with sedimentation. Natural Heritage element occurrence data for this species (NHP viewer checked on October 1, 2021) do not include records in this watershed. The project should therefore have no effect on this mussel. Rock gnome lichen can be found on rock faces at relatively low elevations in deep river gorges. A gorge or any rock faces with consistently humid conditions required by this plant are not present at the bridge. Therefore, the project will have no effect on this species. Small whorled pogonia usually occurs in open, dry, deciduous woods with acidic soil, though it can sometimes be found on slopes along streams and mesic forest in association with white pine and rhododendron. The habitats at the project site include a maintained road right-of-way, forest, and shrub-scrub overgrown fields. Although forested habitats will be impacted by construction there should be no effects of the project on pogonia because this plant has never been observed near the bridge in the many site visit surveys (May 26, 2016, June 21, 2016, June 11, 2019, and October 4, 2021). Moreover, the ground conditions in the forested areas that will be impacted by construction appear too shaded for this plant to occur due to thick ground and mid-story vegetation. Gray bats usually roost in caves or in/on structures year-round while Indiana bats and NLEB only winter in caves or mines with stable, but not freezing, cold temperatures. During warm seasons Indiana bats and NLEB usually roost on/in structures, under the shaggy bark of live trees such as white oaks, sycamores, and hickories, or in cavities or under the loose peeling bark of dead trees. Dutch Cove Creek is small and unlikely to serve as a foraging corridor for gray bats. It also has poor quality substrate and thereby poor macroinvertebrate productivity that would attract gray bats which typically forage over large waterbodies and streams/rivers. There are no caves near the bridge. The bridge was surveyed for bats and evidence of bat roosting on June 21, 2016 and June 11, 2019 and none were evident. Absence of bats and signs of bat usage will not need to be confirmed since the bridge was destroyed by the flood. This project will not require blasting, but it will require the removal of approximately 25 trees (>3 inch diameter) and short-term (couple days)percussive activity(e,g. guardrail post driving). 430382 Page 3 December 9, 2021 Haywood County A few trees to be removed appear suitable for bat roosting because they have peeling, loose, or rough bark. Trees will be removed from October 16 to March 31 when active tree roosting by bats is unlikely. There should be no night work for construction and there will be no permanent lighting installed on the project. There is no street lighting near the site and no other sources of light near the bridge. Removal of trees for the bridge project should not appreciably increase the illumination of the creek. For these reasons, and with the inclusion of"winter"tree clearing, we believe the project"may affect but not adversely affect" Indiana bat and be compliant with the 4D rule for NLEB. Section 106 The project is not expected to have effects on 106 resources. There was a"no survey required" determination rendered for archaeology. Consultation with the federally recognized tribes was undertaken under emergency procedures with comments requested by October 8,2021. No comments have been received to date. A determination of"no historic properties affected"was rendered for historic architecture. Impacts to Waters of the United States The only jurisdictional feature in the project area that will be affected is Dutch Cove Creek. (DEQ Class: Q. This creek has a large watershed and supports fish. It is believed to be Relatively Permanent Waters and under the jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessary to impact Waters of the United States in the French Broad River Basin(HUC 06010105060010). Specifically,NCDOT is requesting to perform fills for temporary dewatering and rip rap protection of unstable banks as specified in the following table. The following comments are provided in accordance with section 7 of the Endangered Species Act of 1973, as amended(16 U.S.C. 1531-1543) (Act). You have committed to remove trees required for the projects during October 15t'to April 151n, avoiding impacts to potentially roosting bats. Additionally, surveys for bats and evidence of roosting bats were negative (see attached table for specific dates). You have also committed to confirming the absence of bats and signs of bat usage before demolition. Accordingly,we concur with your determinations that the proposed projects may affect,but are not likely to adversely affect,the Indiana bat. As outlined in the Biological Opinion completed on the 4(d)rule for the federally threatened Northern long-eared bat (Myotis septentrionalis) on January 5, 2016,this activity is now excepted from take prohibitions for Northern long-eared bat,based on the project location. Project activities in the action area: (1) would not affect a known hibernation site; (2) are not located within '/4 mile of a known hibernation site, or; (3) are not located within a 150' radius of a known maternity (tree) site. Therefore, we believe the requirements under Section 7(c) of the Endangered Species Act(ESA) of 1973, as amended(16 U.S.C. 15 31 - 1543), are fulfilled. Obligations under Section 7 of the ESA must be reconsidered i£ (1)new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2)this action is subsequently modified in a manner that was not considered in this review, or(3) a new species is listed or critical habitat is determined that may be affected by the identified action. 3 The attached table summarizes the details of each project and any additional comments. SUMMARY OF HISTORIC ARCHICTECTURE AND LANDSCAPES REVIEW Description of review activities, results, and conclusions: Review of HPO quad maps,relevant background reports,historic designations roster,and indexes was undertaken on February 11,2016. Based on this review there are no NR, DE,LL, SL, or SS in the Area of Potential Effects (APE).The Haywood County online tax data was utilized to check for structures greater than 50 years of age. There are two standing structures in the APE greater than fifty years of age. One house built in 1940 and another which was built in 1960. Neither of these properties retains the architectural integrity to be eligible for National Register listing. The bridge itself,Haywood County Bridge No. 382,was built in 1964. The structure does not exemplify any distinctive engineering or aesthetic type and is not eligible for the National Register of Historic Places. No survey is required. Why the available information provides a reliable basis for reasonably predictin,- that there are no unidentirted sianifcant historic architectural or landscape resources in the proiect area: Using HPO GIS website and county tax data provides reliable information regarding the structures in the APE. These combined utilities are considered valid for the purposes of determining the likelihood of historic resources being present. The archaeological Area of Potential Effects (APE)for the project is defined as a 1,600 foot(487.68 m) long corridor running 630 feet(192.02 m) east and 970 feet(295.66 m) west and north from the center of Bridge No. 382. The corridor is approximately 200 feet(60.96 m) wide extending 100 feet(30.48 m)from either side of the road's centerline. SUMMARY OF CULTURAL RESOURCES REVIEW Brief description of review activities, results of review, and conclusions: The Bridge No. 382 replacement project is just west of Canton in the eastern portion of Haywood County, North Carolina. The project area is plotted in the southern half of the Canton USGS 7.5'topographic quadrangle(Figure 1). A map review and site file search was conducted at the Office of State Archaeology(OSA)on February 8,2016. No previously recorded archaeological sites have been identified within or adjacent to the APE, but one site(31 HW 164) is within a mile of the bridge. According to the North Carolina State Historic Preservation Office online data base(HPOWEB 2016),there are no known historic architectural resources within the APE that may yield intact archaeological deposits. Topographic maps,USDA soil survey maps, aerial photographs(NC One Map),historic maps (North Carolina maps website), and Google Street View application were examined for information on environmental and cultural variables that may have contributed to prehistoric or historic settlement within the project limits and to assess the level of ground disturbance. The APE for Bridge 382 runs roughly east to west but turns north at its western end. Dutch Cove Creek, which is crossed, drains to the north into Hominy Creek. These waterways are part of the French Broad drainage basin. The project area is primarily situated in a narrow drainageway(Figure 2). A small floodplain is found alongside the creek with small benches at either end of the project area. Strongly sloping side slopes are also present. The area is mostly forested with scattered residential properties that are open. Ground disturbance is mixed with the residential properties graded and level to accommodate houses or mobile homes on the side slopes and floodplain. According to the USDA soil survey, four soil types are found within the APE(see Figure 2). The floodplain is composed of the Cullowhee-Nikwasi complex(CxA). This sandy loam series is somewhat poorly drained to very poorly drained with a slope of less than 2 percent. It is also subject to frequently flooding. This is a stony loam soil that is well drained and with a slope of 8 to 15 percent. Inspection of benches with Google Street View shows that these areas are smaller than depicted by the soil survey image. They are also dissected by small tributaries. Due to their limited extent and erosion from dissection, a significant archaeological site is not likely to be encountered within the project limits on this series. Lastly,the side slopes consists of the Hayesville-Urban land complex(HeC)or the Evard-Cowee complex(EvE). Both of these series are well drained clay loams or clays. The Hayesville-Urban land complex has a slope of 2 to 15 percent,but it appears to be greater than 15 percent when viewed by Google Street View. The Evard-Cowee Complex is much steeper with slope at 30 to 50 percent. Slope of 15 percent or more is not usually tested since significant sites are not likely to be found. A review of OSA's site files shows few investigations or reviews carried out in the area. Only one site (31HW164) is reported within a mile of the bridge and its location is suspect. This prehistoric site was identified by the University of North Carolina at Chapel Hill in 1964 during their archaeological study of the Appalachian Summit. It is situated upstream in a wide floodplain made up of Dillsboro loam unlike the current project area. Overall, further work is needed in the region to better understand settlement patterns,but the scope and location of the current project area will not provide the necessary data. A review of the historic maps suggests no evidence of a significant resource within the APE. The 1901 Asheville USGS topographic map shows Israel Road not crossing Dutch Cove Creek but continuing south (Figure 3). The map also identifies Dutch Cove Creek as South Fork. Structures are plotted as well,but appear to be located north of the project area. Structures on the eastside of Dutch Cove Creek suggest that a road was present but not shown. The 1925 Soil Map for Haywood County displays a similar picture with no changes(Figure 4). By the 1930s,highway maps begin to illustrate an unimproved road that is similar to existing Israel Road. The 1938 Highway Map for Haywood County plots this road crossing Dutch Cover Creek with the possibility of three structures near the APE(Figure 5). Regardless,none of these structures have been recognized as significant. Brief Explanation of why the available information provides a reliable basis for reasonably predicting that there are no unidentified historic properties in the APE: The defined archaeological APE for the proposed replacement of Bridge No. 382 in Haywood County is unlikely to impact intact and significant archaeological deposits. This is due wet soils within the floodplain, steep slopes, disturbance from grading and leveling for modern homes, and minimal extent of suitable surface along the benches. As long as impacts to the subsurface occur within the defined APE, no further archaeological work is recommended for the proposed replacement of Bridge No. 382. If work should affect subsurface areas beyond the defined APE, further archaeological consultation might be necessary. Please note as well,this federally funded project requires a Tennessee Valley Authority(TVA)26(a) permit and is subject to the conditions outlined in the 2003 joint letter from TVA and the Federal Highway Administration(FHWA)to the North Carolina State Historic Preservation Officer(NCSHPO) covering lead federal agency designations for Section 106 purposes. Please see below a map depicting most of the repair sites we have been dealing with in Haywood County following the recent storm Fred. We have many in Transylvania as well. Most of all the sites shown in red have been fixed already, many did not even affect streams but were pavement repairs or debris removal. But, in the blue shading are the sites or areas where we would appreciate an okay, if possible,to proceed with ongoing work into the trout moratorium due to urgency. The two northernmost sites are bridges included in what I sent to you all earlier. These are on poor quality streams and likely not trout issues as well. The 3 southern sites and the circle around several sites are all on trout water. Two of them are bridge replacement and were included in information I sent before. One additional site (bridge 420 on West ForkPigeon River) has a slide that we need to fix relatively soon as well (see picture 89). That slope is still sloughing and I suspect will continue to do so over winter because of freeze/thaw and the site's high elevation. The circle with several sites is where several of us looked at damage on Tuesday. An example of the damage in this area is shown in attached picture DSCN5928. Repairs to shoulders will generally involve mostly the placement of clean boulders or rip rap at the pre-strorm creek bank alignments. The bridge work will mostly involve rip rap placement, though there will be stream disturbance for temporary pipe crossing removal and channel restoration as well. I hope this information helps. We would appreciate any thoughts you have on proceeding with this work into the trout moratorium. I know you reccommended to Crystal earlier on that we should do work quick as possible, but we please just need confirmation that includes work into the trout moratorium if needed. Even though these are emergency actions,we have design work to complete on the bridges in next few weeks, so it is likely work on these bridges would be starting late next month or November, if we can.
