Dear Mr. Shaver and Ms. Sprinkle: The North Carolina Department of Transportation (NCDOT) is proposing to replace Bridge No. 202 over Mulberry Branch on SR 1357 (Smith Avenue) in Brunswick County. The existing single span - 31 ft. bridge will be replaced with single span - 72 ft. bridge. A preliminary jurisdictional determination (PJD) was acquired on this project on June 27, 2018 and the project was assigned Action Id No. SAW-2015-00956. A revised jurisdictional features map was provided to you based on a review with DWR on July 26, 2018. Because this is a dead end NCDOT facility, a temporary onsite detour will be required to maintain traffic and emergency services access. Impacts associated with the onsite detour include 0.024 acres of temporary fill, 0.015 acres of hand clearing and 0.003 acres of beneficial excavation to restore natural grade and drainage. Impacts associated with the new permanent bridge structure include 0.053 acres of fill, 0.003 acres of beneficial excavation, 0.034 acres of mechanized clearing and 0.004 acres of hand clearing. Total permanent impacts (loss) for this project are 0.087 acres. The only utility relocations associated with this project include an AT&T and ATMC bore and overhead powerline relocation. There are no impacts associated with the bores however there are 0.090 acres of hand clearing associated with a temporary powerline relocation. Based on field observations and historical aerials, the area for the onsite detour is predominantly within the existing maintained overhead utility corridor and the new overhead utility corridor was clear cut in 2016 and is in early stages of natural succession. The attached permit drawings and utility plans provide more details on the proposed impacts. Protected Species: Per the NRTR update dated October 2021, habitat for wood stork is present within the project study area. Field surveys conducted were conducted on June 27, 2021 and no wood storks, nests or roost were observed therefore, the project falls within the PBE parameters specified in the letter from the USFWS dated August 16, 2021 and a biological conclusion of MANLAA is suggested by the Department. The Northern long-eared bat is also listed in Brunswick County, therefore a biological conclusion of MALAA is suggested in accordance with the US Fish and Wildlife Service revised programmatic biological opinion (PBO) developed in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. Temporary Detour Restoration Plan: The proposed 0.024 acres of riparian wetland restoration will consist of the removal of fill material used for the temporary onsite detour in the existing wetland areas. Geotextile fabric will be placed on natural ground that has been hand cleared prior to placement of fill during construction of the detour. Once the project is complete this fill material will be removed to pre-project elevations in order to match the adjacent wetlands. These areas will be revegetated with native seed mixture. No tree planting is being proposed since the aerial powerline will be relocated back into this existing aerial utility corridor. Following construction and removal of the detour, NCDOT and regulatory agencies will meet on-site to determine if the temporarily impacted wetland area has been restored to the pre-project elevation. If the site has not re-attained wetland jurisdictional status, NCDOT and the US Army Corps of Engineers will determine if additional monitoring or compensatory wetland mitigation is required. Regulatory Approvals: Section 404 Permit: NCDOT is proposing to construct this project under the conditions of Nationwide 3. Based on the current design and impacts, notification requirements are not applicable for this project and written approval from the USACE is not required. NCDOT will abide by all conditions listed in NW 18 and will include a copy of the certifications in the permit package and/or contract. Section 401 Permit: The associated 401 General Certification 4132 will also apply to this project. Notification thresholds or circumstances for these certifications are not applicable to this project therefore written concurrence from the Division of Water Resources (DWR) is not required. NCDOT will abide by all conditions listed in GC 4132 and will include a copy of the certifications in the permit package and/or contract. A 55' detour bridge with 18' clear roadway with single 11' lane will be constructed downstream of the proposed bridge.The detour bridge is designed for the 10 year storm with one proposed temporary outfall at the begin bridge right side. The detour bridge has 3:1 side slope on the left begin and end bridge, 2.3:1 side slope on the right begin bridge and 3:1 side slope on the right end bridge.
