This permit shall be effective from the date of issuance until rescinded, and shall be subject to the conditions and limitations as specified therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein by reference. The downstream pump station operated by the Town of Oakboro is currently having issues with compliant operations. Until a plan to return to compliance and documented evidence is submitted that demonstrates a reduction in inflow and infiltration other permits will not be issued tributary to that pump station. Also, please respond on City of Locust letterhead signed by an official affiliated with the City in future response to requests made by this office. Please pay particular attention to Permit Condition 3 which requires that the wastewater collection facilities be properly operated and maintained in accordance with 15A NCAC 2T .0403 or any individual system -wide collection system permit issued to the Permittee. Permitting of this project does not constitute an acceptance of any part of the project that does not meet 1) 15A NCAC 2T; 2) the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996, as applicable; 3) and the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000, as applicable, unless specifically mentioned herein. Division approval is based on acceptance of the certification provided by a North Carolina -licensed Professional Engineer in the application. It shall be the Permittee's responsibility to ensure that the as -constructed project meets the appropriate design criteria and rules. Failure to comply may result in penalties in accordance with North Carolina General Statute §143-215.6A through §143-215.6C, construction of additional or replacement wastewater collection facilities, and/or referral of the North Carolina -licensed Professional Engineer to the licensing board. The sewage and wastewater collected by this system shall be treated in the Town of Oakboro VWVTP (NPDES No. NC0043532) prior to being discharged into the receiving stream. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This permit shall become voidable unless the wastewater collection facilities are constructed in accordance with the conditions of this permit; 15A NCAC 2T; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996, as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000, as applicable; and other supporting materials unless specifically mentioned herein. 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system -wide collection system permit for the operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T .0403: a. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed and shall be actively maintained. c. An operation and maintenance plan shall be developed and implemented. d. Pump stations that are not connected to a telemetry system shall be inspected every day (Le. 365 days per year). Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High -priority sewer lines shall be inspected at least once per every six-month period of time. f. A general observation of the entire sewer system shall be conducted at least once per year. g. Inspection and maintenance records shall be maintained for a period of at least three years. h. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina General Statute §143-215.1C. I 4. This permit shall not be transferable. In the event there is a desire for the wastewater collection facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 5. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 6. Per 15A NCAC 2T .0116, upon completion of construction and prior to operation of these permitted facilities, the completed Engineering Certification form attached to this permit shall be submitted with the required supporting documents to the address provided on the form. A complete certification is one where the form is fully executed and the supporting documents are provided as applicable. 7. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of the wastewater collection facilities. 8. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statutes §143- 215.6A through §143-215.6C. 9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement facilities. 10. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (local, state and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 11. Noncompliance Notification: The Permittee shall verbally report to a Division of Water Quality employee at the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. 2 Voice mail messages or faxed information is permissible, but shall not be considered as the initial verbal report. Overflows and spills occurring outside normal business hours may also be reported to the Division of Emergency Management at telephone number (800) 858-0368 or (919) 733-3300. Persons reporting any of the above occurrences shall file a spill report by completing Part I of Form CS-SSO (or the most current Division approved form), within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to ensure that the problem does not recur. Part II of Form CS-SSO (or the most current Division approved form) can also be completed to show that the SSO was beyond control. Permit issued this the 9th day of May, 2007. Please address the following by no later than April 30, 2007. 1. The MRO must determine how available sewer capacity is shared by Locust and Stanfield. Please respond with information regarding your current systems operational capacity,, your allocated projects (and flow) to date, and any other information necessary to assess the current state of the tributary line shared by the Locust and Stanfield sewer system. The MRO assumes that you have already evaluated the total capacity of the tributary line and have determined how capacity for this line will be allocated until design capacity is reached. The MRO recognizes that capacity agreements with the Oakboro WWTP are a separate issue from flow tributary to the Main pump station. Please provide total design flow numbers associated with the force main and the contract which tracks Locust and Stanfield tributary capacities. Future sewer collection system applications will require a flow allocation letter signed by both Stanfield and Locust defining the design flow, actual flow, and subtracting the total volumes from the available capacity of the tributary force main, 2. There are significant SSO issues associated with the Main pump station downstream of your shared force main. Currently, the MRO is discussing corrective action plans for the pump station with the Town of Oakboro. Please be advised that until the MRO is satisfied that the actions taken by Oakboro to correct these issue are implemented tributary flow will not be permitted to the entire tributary system associated with the problem pump station. It is recommended that Locust and Stanfield participate in corrective action plans for the pump station because it is the only means of conveyance to the Oakboro WWTP at this time. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. We all look forward to solving this issue and feel that our most recent meeting with you and your staff was very productive. As you are aware the original response to your Notice of Violation (NOV) letter was submitted by the Town on March 26, 2007 which was accompanied by a Technical Memorandum (both attached) prepared by our office. Without repeating the contents of that transmittal l would restate the primary focus which included three main issues: 1) Review of existing Oakboro WWTP treatment capacities,2) Quantification of WWTP flow commitments and 3) Summary of improvements to Increase System Capacity. As requested at the April 3, 2007 meeting we have developed quantitative measures and timeframes for remedies to overflow conditions at the McCoy's Creek Pump Station. In that regard please find attached our suggested Corrective Action Plan for your review and comment. Please note that several of the proposed items are currently underway such as daily pump run monitoring, flow metering and field investigations. As a part of the Corrective Action Plan we have proposed a limited Inflow/ Infiltration project (Priority 3). This limited project is based upon our Sanitary Sewer Evaluation Study (SSES) report dated June, 2005 and direct field observations by the Town of Oakboro. On behalf of the City of Locust Board of Commissioners I would first like to relay my appreciation for your time and cooperation in this important matter. Please be assured that the City of Locust considers this a very critical issue and desires to move forward in addressing your concerns in a most prudent and practical manner. Before addressing your concerns I would like to provide a brief overview of "West Stanly" sewer operations including the collection, transportation and final treatment of West Stanly wastewater. Both Locust and Stanfield own and operate separate "Vacuum" sewer systems as manufactured by AIRVAC. Locust also operates several gravity sewer networks. The vacuum systems collect wastewater via a system of vacuum lines which conveys wastewater to central vacuum stations. Collected wastewater is then discharged from the vacuum stations into a common 12" force, shared by Locust and Stanfield, which delivers sewer flows from West Stanly to the Town of Oakboro (Overview map attached). All West Stanly wastewater flows received by Oakboro are then routed through the "McCoy's Creek" pump station for final pumping to the Oakboro wastewater treatment plant (WWTP). It should be noted that Locust is currently sending approximately 65,000 gallons per day and Stanfield is sending approximately 30,000 gallons per day on average to Oakboro. The original vacuum sewers, shared force main and improvements to the Oakboro WWTP were accomplished in the mid to late 1990's. As appropriate, the three municipalities (Locust, Stanfield, P.O. Box 1726 - 129 N. First St. - Albemarle, NC 28002 - 704-984-6427 OakbOro) entered into various and separate, lnterlocal Governmental Agreements for mutual benefit and assurance of servFces. Notably, Iwo agreernents Were executed. An agreement between Locust and O<akboro was executed on �tuty 5`�' 1995 (attached) setting forth, among other items, the provision of wastewater treatment 'for Locust wasCewator by Oakboro. This agreement allowed for an initial "free" capacity of 90,000 gallons per day and an allowance for an additional purchased capacity of 150,000 gallons per day for a 'total treatment capacity of 240 000 gallons per day. Based on Oakbora s permltted� WWTP capacity of 0.9 million gallons per day thus level of ccmmltment represents 27",il of plant capacity. Similarly it is my understanding that Stanfield has achieved a committed (free and purchased) capacity amount of 150,000 gallons per day or 17 ' of WWTP capacity. Of particular' interest, in reference to your most recert incFt iry, is the Interlocal Governmental Agreement executed between the Town of Stanfield and City of Locust. This agreements signed on March 19'r, 1997 (attached) set forth the framework for the sharing of the 12' force man to include a 50`h undivided legal and beneficial interest to both parties. It is stated in the agreement that the 5.0% ownership would apply to construction costs, tap revenues, maintenance costs, etc, it is my understanding that the 50% beneficial ownership would then translate to an equally shared 50% ownership to both parties for the actual "capacity" of the force main, in order to establish the capacity of the shared force main I have reviewed available "As -Built" drawings„ operations & maintenance manuals and have performed various field surveys and visits. Our office has previously performed limited hydraulic modeling on various portions of the West Stanly force main network prior to your letter. It appears that all existing vacuum stations were designed around a 750 gallon per minute (gp.m) discharge pumping rate, which would provide for a self -cleansing velocity of 2 feet per second in a 12' force man Our field observations indicate that the vacuum stations are operating above the 750 gpm rate and more likely are producing upwards to 1200 gpm in some instances. While not prepared to concretely establish a force main capacity by this writing I will nonetheless relay that it is my position that the 12°` force main should be able to deliver approximately 1000 gallons per minute based on currently installed pumping capacity both ii Locust and Stanfield. As you are aware there are many factors which can influence the total daily capacity of the force main including available wet well storage, pump rum times, pumping capacities, etc A total daily flew capacity of approximately 1 rgallons per day could be achieved based on a total d'srlly pumping time of 16 hours* Obviously total daily force main capacity is highly influenced by peak loading and the ability of facilities to accomrn+odate and buffer peak flows. It is my observation that constructed facilities are operating as intended and appear to functioning well. Another observation that is somewhat cbvious is the fact that there are multiple pump stations connected to the 12" shared force main. Currently there are four rtaain stations contributing flow to the shared force malnwhich are 1) Meadowcreek 'Vacuum Static) a 2) Browns Hill Road 'Vacuum Station, 3) Stanfield Vacuum Station and 4) The Locust East Sanitary Pump Station. All four stations are capable of 2 of 4 delivering flow to Oakboro individually. The result of the multiple pump connections is that full utilization of the 12' force main can not be achieved due to the inevitability of simultaneous pump operation and the lack of flow equalization. We have had various discussions over the past several months concerning the modification of pumping protocols out of West Stanly, Discussions have centered on the idea of a regional pump station, located in the Locust) Stanfield area, to include flew equalization facilities, This approach would substantially increase the shared force main capacity primarily through the provision of flow equalization and extended pumping times. While this idea is not fully developed or yet needed we are continuing to move forward with developing this concept. The following table summarizes current capacities and utilization: Available Capacity at Oakboro WWTP Average Daily Flow, Dry 65,f100 gallons per day r 30,000 gallons per day Weather 24fl,008 gallons per day \ 150,000 gallons per day Percent Utilization of 27% Available WWTP Capacity Estimated Force Main Capacity 500,000 gallons per day 500,000 gallons per day Allocation Percent Utilization, Force Main Capacity l have had discussions with City of Locust officials concerning the need going forward to provide for full and accurate accounting of the shared force main capacity, It appears that this will not be an issue for either municipality and that efforts are underway to provide for this accounting system, Although a valid concern for all parties it is evident from the above tabulation that neither Locust nor Stanfield are in jeopardy at this time of exceeding their flow allocation. Z F A I, as well as you, am aware of several pending developments that have expressed interest in the Locust area which could impact the force main allocation. Although not in contractual form it would only be prudent that the effecting municipality be responsible for abating any condition that would impact the force main allocation arrangement. As discussed above we feel that a regional pumping station with flow equalization will be inevitable which will provide for increased force main capacity for both Locust and Stanfield, Efforts in this regard should be initiated later this year. On Friday, April 13`h, 2007, the Town of Stanfield, Town of Oakboro and the City of Locust held a joint meeting which included various local officials. The tone of this meeting was very cordial with all relevant West Stanly sewer issues brought to the table. Items discussed included shared force main capacity, growth, accountability, and more importantly the need to re-establish dialogue on pertinent sewer issues relating to all three municipalities. It is was my understanding that from this meeting all parties have agreed to examine related issues on a regular basis. Again, thank you for your time and consideration.
